Livestock Farm Facility No. 82-184 Sampson County Dear Mr. Allcox: On June 23, 2000, staff from the Fayetteville Regional Office of the Division of Soil and Water performed a review of the S. E. A. Livestock Farm in Sampson County. The review revealed that there was over application of nitrogen to the small grain crop by seven pounds with no revision to the CAWMP. It was also noted that the waste analysis had not been taken within sixty days of the March 2000 application of waste. These deficiencies were referred to the Division of Water Quality, as required, By The Division of Soil and Water. In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Avoid over application of nitrogen in the future. 2. Secure waste samples within 60 days of application of waste. Please provide this office with a written response, by November 7 2000, as to the actions taken, or proposed to be taken, to resolve the deficiencies noted. Ross, Jr., Secretary Alan Klimek, P.E., Director Division of Wager Quality On July 2, 2002, staff from the Fayetteville Regional Office of the Division of Water Quality, conducted an annual inspection of the Sea Livestock Farm in Sampson County. The inspection revealed that the inside slope of the lagoon dikes had no grass cover and the rear waste application field had a problem with weeds and grasses. In addition, an inspection of the front waste application field identified wastewater ponded in the buffer area between the irrigation hydrant and the ditch in a grassed waterway. The Division of Water Quality requests that the following items be addressed: 1. Consult with a crop specialist for assistance with the appropriate measures and or chemicals to be applied to correct the problem with competition (grasses and weeds) . 2. Contract an irrigation specialist to install or repair the irrigation system to prevent future waste application problems. Adjust the speed of the reel as necessary adjacent to the grassed waterway to prevent ponding and possible runoff. 3. Curtail the use of the chemical " Round Up" on the lagoon dikes to prevent the loss of the required grass cover. Livestock Facility No. 82-184 Permit No. AWS820184 Sampson County NOD -2010 -PC -1073 Dear Mr. Allcox: On February 15, 2010, the staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section (APS), were notified by Sherwood Allcox of a high freeboard level in one or more of the facilities lagoons. As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1300, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General Permit No. AWG 100000 as follows: Deficiency 1: Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's CAWMP in accordance with Condition V. 2. Of Swine waste System General Permit No. AWG 100000. On February 15, 2010, a lagoon/storage pond level was documented at 18 inches of freeboard. A level of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan. Continue to follow the proposed actions outlined in your Plan of Action (POA) submitted to the Fayetteville Regional Office. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.
