Royal — McArthur Farm Permit # 82-0131 Sampson County Incident # 20160457 NOD -2016-PC-0659 Dear Mr. Royal: Dimaor On February 16, 2016 staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) were notified by Curtis Barwick of a high fteeboard level in the 41 lagoon. We wish to thank Curtis Barwick and Mr. Royal for notifying DWR of this incident. As a result of this incident, you are hereby notified that having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have been found to be in violation of your Certified Animal Waste Management Pian and the Swine Waste System General Permit No. AWG 100000 that you are covered to operate under, as follows: Deficiency 1: Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste System General Permit No. AWG100000. On February 16, 2016 a lagoonistorage pond levels were documented at 17.0 inches. A level of 19.0 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan. Required Corrective Action for Deficiency 1: DWR has received a copy of your 30 -Day Plan of Action (POA) for the high freeboard occurrence. Take all necessary additional steps to insure lagoon levels remain in compliance with your Certified Animal Waste Management Plan and permit. Moriah Church Road Clinton, NC 28328 Dear Mr. Royal: October 11, 1999 SUBJECT: NOTICE OF DEFICIENCY McArthur Farm Facility No. 82-131 Sampson County On August 25, 1999, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a routine inspection of your swine facility located in Sampson County. It was observed that the inside slopes of the lagoon did not contain a suitable grass cover in some areas. A review of the irrigation records indicated that a Plant Available Nitrogen (PAN) rate of 100 pounds for small grain overseed had been used this past winter. However, the Certified Animal Waste Management Plan (CAWMP) specified the PAN rate for small grain overseed as only 50 pounds. It was also noted that one of the waste application fields had been utilized for the construction of a new home. Some areas of the coastal bermuda had some competition with other grasses. The Division of Water Quality requests that the following items be performed: 1. Establish a grass cover on the inside slopes of the lagoon to prevent erosion. 2. Contact a technical specialist in order to update the CAWMP to increase the PAN rate from 50 pounds to 100 pounds or apply waste at the rates currently specified in the CAWMP. 3. Consult with a technical specialist in order to revise the CAWMP to reflect the change in use of one of the waste application fields, and to determine if the farm will have enough acreage to continue to produce a nitrogen deficit. 4.
