Klimek, P. E. Director Division of Water Quality Coleen H. Sullins, Deputy Director Division of Water Quality You are hereby notified that, having been permitted to have a non discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H .0217 and Section 402 of the Clean Water Act, you have been found to be in violation of your permit. On April 3, 2003, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a site visit to the above referenced facility in response to a complaint of waste -runoff from the sprayfield. Upon arrival at the facility, it was observed that wastewater had runoff during a waste application event and exited the sprayfield. Waste exited the field in two areas, entering a dry ditch and ponding in a low area. This is in violation of your permit. The Division of Water Quality requests that the following item(s) be addressed: 1. Inspect future irrigation events at more frequent intervals to prevent fixture occurrences of runoff. 2. Review Best Management Practices (BMPs) and possibly amend to include flow control structures to prevent a similar incident in the future. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. Please provide this office with a written response as to the actions taken or proposed to be taken to prevent this circumstance in the future on or before Sentember 10, 2003. Box 789 Wallace, NC 28466 Subject: Notice of Violation DIVISION OF WATER QUALITY January 20, 1998 Administrative Code 15A NCAC 2H .0217 Triad Farms Facility No. 82-126 8z 82-127 Sampson County Dear Mr. Salmon: You are hereby notified that, having been deemed permitted to have a non discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 2H .0217 Permit. On December 21, 1997, staff from the Fayetteville Regional Office of the Division of Water Quality performed an inspection of your farm located off SR 1946 after receiving a complaint regarding waste being applied to a saturated field. The inspection revealed that the waste was ponding and running off the field into a road ditch. The waste was contained in the field and the ditch and no discharge to surface water occurred. The Division of Water Quality requests that the following items be addressed: 1. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $10,000.00 per day per violation. Please provide a written response to this office on or before February 20, 1998 regarding corrective actions taken or planned.
