SUBJECT: NOTICE OF VIOLATION
Administrative Code 15A NCAC 2H.0217
Kettrell Strickland Swine Farm
Facility No. 82-75
Sampson County
Dear Mr. Strickland:
You are hereby notified that Kettrell Strickland Swine Farm, which
has been permitted to have a nondischarge permit for an animal waste
disposal system pursuant to 15A NCAC 211.0217, has been found to be in
violation of its 2H.0217 Permit.
On August 17, 1999, staff from the Fayetteville Regional Office of
the Division of Water Quality conducted and annual inspection of Kettrell
Strickland Swine Facility 1-6 located off SR1324 in Sampson County. The
inspection revealed that the Certificate of Coverage and the General Permit
were not available for inspection as specified by General Permit condition
(section 1, item 4). In addition, the weekly freeboard levels were not being
maintained as required by General Permit condition (section III, item 2).
Also, a review of the Division of Soil and Water operation review revealed
that the freeboard was 15 inches at the time of their inspection.

Mr. Strickland was required to report to the Division of Water Quality Regional Office as
specified in General Permit edition (section Ell, item 6e), when the lagoon level was less than
that specified by the CAWMP or the 25 -year, 24-hour storm event plus 1 foot of structural
freeboard per General Permit Condition (section V, item 3).
The Division of Water Quality requested that the following items be addressed:
1. Locate a dopy of the General Permit and the Certificate of Coverage for the facility and
maintain with the CAWMP and other records on-site. Should you require another copy of
the General Permit and Certificate of Coverage please contact Sonya Avant or Sue
Homewood at (919) 733-50$3.
2. Begin immediately to record the lagoon levels weekly on the sheet provided by the Division
of Water Quality with your General Permit or another form approved for this record.
3. Be aware that the failure to notify the Division of Water Quality of the high freeboard
condition could result in an enforcement action.
Please be advised that this notice does not prevent the Division of Water Quality from
taking enforcement aciton for this violation or any past or future violation. Furthermore, the
Division of Wates Quality has the authority to levy a civil penalty of not more than $25,000 per
day per violation.
Please provide a written response to this office on or before October 1, 1999, regarding
corrective actions taken or planned. if you have any questions concerning this matter, please

In accordance with North Carolina General Statute 143-215.10G, all animal operations who receive an animal
waste management system permit will be charged in each year of the term an annual permit fee. Annual permit fees are
billed following the issuance of the permit and then annually thereafter on the anniversary of that date. Your animal waste
management system permit was issued on 8118198.
Y.;ur annual permit fee for the period of 8118198 - 8117199 is $100.00. Your payment was due 10/3/98. Because
this fee was not fully paid within 30 days after being billed, this letter initiates action to revoke the subject permit,
pursuant to 15 NCAC 2H .0205 (c) (4). and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, the subject permit is hereby revoked unless the required Annual
Animal Waste Management System Permit fee for your animal operation is received within that time. Operation of an
animal waste management system without a valid permit is a violation of North Carolina General Statute 143-215.1 and is
subject to the assessment of a civil penalty of up to $10,000 per day. Your payment should be sent to:
