On July 25, 2012, staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section (APS) was
notified of overapplication of waste on the spray fields. On July 27, 2012, APS staff conducted a partial record
review and on August 16, 2012 APS staff did a compliance inspection at B& Y Family farms and the permitted
waste disposal system. We wish to thank you and your wife for notifying DWQ of this incident and assisting
during the review and inspection.
As a result of this incident and inspection, you are hereby notified that, having been permitted to have a non -
discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste System
General Permit No. AWG 100000 that you are covered to operate under, as follows:
Violation 1:
Failure to apply animal waste at rates in accordance with your permit and Certified Animal Waste Management
Plan: (Permit No. AWG 1000, Section 11. 4)
During late 2011 and early 2012, excessive amounts of Plant Available Nitrogen (PAN) were applied on all spray
areas to the overseed crop. The maximum PAN rate stated in your Waste Management Plan for that season is 80 lbs
per acre.
Required Corrective action for Violation 1:
Please take all necessary steps to insure this violation does not reoccur. The steps could include but are not limited
to: familiarizing yourself with the requirements of the Certified Animal Waste Management Plan (CAWMP),

careful planning of spray events, submission of your records in a timely manner for workup or keeping yaws- own
spray records, modification of your CA WMP, and cleanout of the waste lagoon (due by July 2013).
Violation 2:
Failure to conduct a sludge survey in accordance with Condition III. 19. of Swine Waste System General Permit
No. AWG100000. "All facilities ... shall conduct a survey of the sludge accumulation in all lagoons every year."
The last sludge survey was done on 10128/10, although your permit was not in effect until July 2011.
Required Corrective Action for Violation 2:
Please conduct a sludge survey by the end of 2012, and annually thereafter.
You are required to provide a written response to this Notice by September 21, 2012. Please include in your
response all corrective actions already taken and a schedule for completion of any corrective actions not addressed,
Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the
Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five
thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms,
conditions, or requirements of a permit under authority of G.S. 143-215.6A.

Our second violation was failure to conduct a sladge survey. We plan to
have that done before the and of the year in 1012 We will be surge to
