Faircloth 1557 Andrews Chapel Road Roseboro, NC 28382 Subject: NOTICE OF VIOLATION Administrative Code 15A NCAC 2H .0217 F & W Farms / B-T Farm Facility No. 82-53 Sampson County Dear Mr. Faircloth: You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal systern pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 2H.0217 Permit. On August 15, 2003, staff from the Fayetteville Regional Office of the Division of Soil and Water conducted an operational review of your swine farm located on SR 1246 in Sampson County. During that routine inspection, it was noted that the facilities recordkeeping was not in order. Records of applications, samples, and lagoon levels must be taken as required by the NPDES Permit and failure to do so is a violation of a permit condition. This unsatisfactory recordkeeping condition contributed to the over application of P.A.N. which occurred to the 2002/2003 small grain crop on pull 13, While the recordkeeping deficiency contributed to the over applications it does not excuse it. The over applications have been documented in our files and similar future over applications will result in enforcement action being taken. Please be advised that such over applications are inconsistent with your Waste Utilization Plan. Further evaluation of this matter may be conducted in the future, The Division of Water Quality requests that the following items be addressed: 1. Improve recordkeeping by following permit guidelines for applications, samples, lagoon levels and new approved forms. 2. Avoid over application of PAX by improving recordkeeping procedures and taking waste samples 60 days prior to or after any waste applications. N. C. Any deviation from your CAWMP should involve a technical specialist. Failure to comply with the above conditions may result in the facility losing its General Permit and being required to obtain an individual non -discharge permit for the facility. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. If you have an explanation for this violation that you wish to present, please respond to this office by December 11, 2003. Faircloth 1557 Andrews Chapel Road Roseboro, North Carolina 28382 SUBJECT: Operation Review Notice of Referral for F & W Farms 1 B-T Farm, Facility Number 82-53 Sampson County Dear Mr. Faircloth, NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES On August 15, 2003, an operation review was conducted of F & W Farms 1 B-T Farm, facility number 82-53, in Sampson County. This review, undertaken in accordance with G.S. 143- 215.1OD, is one of two routine site visits scheduled for all subject animal operations in 2003. Staff from the Division of Water Quality will conduct a separate compliance inspection. During the operation review, the following items were noted: • Nitrogen over application to the 2002/2003 small grain rye crop as follows: Pull Field Over Applied Amount P.A.N. The over applied amount for pull 13 is greater than 10% allowed by the waste plan and requires a notice of referral to the Division of Water Quality. • Field 5 was not planted to bermuda as shown in the waste plan. G.S. 143-215.10E requires staff from the Division of Soil and Water Conservation to notify the Division of Water Quality and the owner/operator of these observed violations. A copy of the operation review report is enclosed for'your information. Site findings and recommended corrective actions as discussed are noted in the comment sections. Please remember that in order for your facility to remain in compliance with environmental regulations, animal waste cannot be discharged into the waters of the State, and the animal waste collection, treatment, storage and disposal systems must be properly maintained and operated under the responsible charge of a certified operator. Waste samples are good 60 days efore and 60 days after date of sample. 9. Keep lagoon level records with farm paperwork. Freeboard levels on farm go back to 10/21/02. Maintain records for 5 1. Field 10, pull 12 is now partly in bermuda. Low area of field has no stand of Bermuda. Area will probably need drainage fork before bermuda stand can be established. Waste plan will be revised to make pull only on high side of field where ermuda is. Soybeans in field 9 (pull 11) have drowned due to wet weather. This pull has not been pumped on. Avoid umping on this field until next crop is planted. Conditional amendment may be needed to waste plan if other fields run short n P.A.N. balance on IRR 2 forms. See technical specialist if waste plan amendment is needed. 2. Field 5 is shown as bermuda in waste plan. Soybeans are planted there now (beans have not been pumped on). Inable to sprig field 5, will sprig next year. If have to pump on soybeans in this field get waste plan conditional amendment ,om Curtis Barwick. Field 10 is shown as soybeans, corn, and wheat in waste plan--bermuda is on part of field 10 now. Waste plan needs to be revised to bermuda in field 10 (well drained area). L` Start using wettable acre determination for irrigation purposes and record keeping (IRR 2). Be sure acres for each pull IRR 2 match acres for each pull on wettable acre determination. Noted on last inspection. Be sure to use correct waste alysis on IRR 2 records. Waste analysis are good 60 days before and 60 days after date of sample. Move pumping done I rye over seed during the month of March, 2003 to 2003 bermuda crop on IRR 2 records and adjust P.A.N. on IRR 2 forms cordingly. 5. Be sure to inspect lagoon after any rainfall event of one inch or greater and initial rainfall records. Need to use approved )rm for rainfall records. i ote: Mow lagoon banks near toe of slope when weather permits to remove small woody saplings. On August 26, 1999, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a complaint investigation of your swine facility located in Sampson County, followed by a routine inspection on September 1,1999. It was observed that the lagoon level was in the emergency storage level (17") and the Division of Water Quality had not been notified. General Permit condition 111.6.(e) states that "the Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of any of the following events: (e) Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V(3) of this General Permit.". A review of the irrigation records indicated that some pumping events during May and April were not covered by a current waste sample. General Permit condition 111.4 states that "An analysis of the animal waste shall be conducted as close to the time of application as practical and at least 60 days (before or after) of the date of application.". It was also noted that freeboard records were not being maintained weekly as required by the General Permit. Freeboard records had not been recorded since May. General Permit condition 111.2 states that "Waste lagoon and storage pond levels shall be recorded weekly on forms supplied or approved by the M.". The Division of Water Quality requests that the following items be performed: 1. Lagoon #2 contained high vegetation and needed to be mowed around. There was some erosion noted around the buildings due to a lack of grass cover between and around the buildings. It was also observed that there was some standing surface water between the buildings and the lagoons. The irrigation fields did not contain the crops as designated in the certified animal waste management plan (CAWMP). The CAWMP was written for a soybean and wheat rotation. However, corn was planted in one of the larger spray fields. There were also two of the spray fields that did not contain a crop. The farm technician indicated that coastal Bermuda was going to be sprigged in these two fields. OFFICE In response to your letter dated June 8, 1998 regarding Notice of Violation for Brown's of Carolina Farm 94, Facility No. 78-85, Robeson County, please find the following response to the items addressed in your letter. As you know, most of the lagoons were extremely high as a result of this winter's weather. As a result, our approach has been to steadily lower lagoons, pumping onto growing crops at agronomic rates. To have pushed a lot faster could have resulted in run-off and jeopardized the environment. As of June 22, 1998, the lagoon in question had been lowered out of the freeboard and we will continue to pump environmentally safe and agronomically correct until lagoons are down to appropriate levels. 2. & 3. Our policy on farms has been to appropriately landscape all farms upon completion of construction. This farm was completed in the fall of 1997. I sent landscape crews in on several occasions but each time it was simply too wet to work. Since your visit, most dirt work has been finished and the farm awaits final grading and seeding. This should be completed in the next 30 days. 4. Mowing is normally done on a regular basis. Your inspection just fell at a time when my personnel had gotten behind with other jobs and had not had a chance to mow and clean up. We are working on ways to better insure that dikes and other service areas are mowed regularly. 5. The CAWMP as originally written was changed in the fall to a half corn and half wheat and soybean rotation to make for a more continuous year round pumping agenda rather than concentrated periods that taxed equipment and labor. Unfortunately, the correct paper work did not make it into the plan. We are in the process of correcting this and will forward you a copy of the revised plan within 15 days of this letter. On September 18, 1998, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an follow-up inspection of Farm #7681-3. It was noted that the Certified Animal Waste Management Plan (CAWMP) reviewed at the time of the inspection did not include grazing of cows along with small grain over seed for winter application. These practices were be conducted on the farm. However, Mr. Stuffs contacted our office at a later date and stated an old CAWMP for that farm was reviewed at the time of the inspection. The current CAWMP did include grazing along with over seeding of small grain for winter months. A plant available nitrogen (PAN) rate of 325 pounds was used for irrigation records. The PAN rate listed in the old CAWMP for coastal was 305 pounds per acre. As a result of the incorrect PAN rate used for the irrigation records, there was some over application on some areas of the coastal bermuda fields. I apologize for not writing earlier, but I was not sure what I should do and after attending, a CEASE meeting. last night I decided that this incident needed to be heard iia your offior also. On Feb. 25, 1999 (Wed.) I had a citizen call late in the evening and mention the this farm (421/#26) was spraying onto fields standing with water. It was after hours and I did not call it in to the FaycttevMe office. Then on Feb. 27* (Fri) another citizen called me around 12 o'clock and told me the same thing. I immediately called DWQ and reported this to Jeffery Brown. I did not hear back from him that evening, so on Monday (March 2" d I called to find out what had born done. Jeffery informed me that because they were short staffed that no one was able to actually visit the site. However, be made a phone call to the farm and spoke with Glean Davis, Brown's operator. W. Davis admitted to the spraying and of course wanted to know how DWQ bad found ouL Jeffery asked him if be was spraying because the lagoon was at a dangerous level and Mr. Davis told him "no." 1Nk. Davis informed Jcffcry that he would stop the spraying. (Please keep in mind that their fields looked like they had small ponds standing on them) I then called Bob Heath to discuss this with him I asked Bob what was the criteria for issuing a violation He admitted that this incident would fall in this catcgoM but since no one from DWQ had gone out and seen it for "themselves" they could not issue a violation. I find this very bard to swallow. If we have two eye witnesses and Mr. Davis admitting to it, what more is nvcded? Especially when there was no appsreat reason for him to be spraying± Bob did say that if we saw them doing it again to please call it in and some one would definitely go out the next time. (I doubt even Brown's would be ignorant enough to try it again) He also said they would try to gcx out there to check on their lagoon to be on the safe side. I have not heard bask from them, so I do net know if D WQ followed up on that or not This is the same farm that took waste from the Buckhorn farm when they were mandated to reduce their lagoon. If DWQ cleared Buckhorn to apply more waste to the #21 & 26 they should have had enough freeboard not to have to spray themselves. - something does not add up hxo.
