STEVENS DIRECTOR 41 NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES DiviSION OF WATER QUALITY FAYETTEVILLE REGIONAL OFFICE DIVISION OF WATER QUALITY January 12, 2000 Ms. Betty Herring 795 Five Bridges Road Clinton, NC 28328 Subject: Notice of Violations Alpine Swine Farm Facility No. 82-36 Sampson County Dear Ms. Herring: You are hereby notified that, having been deemed permitted to have a non discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 2H .0217 Permit. On October 28, 1999, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an annual inspection of your swine farm, (located off SRI 100 in Sampson County). The inspection revealed that waste application records were inadequate and that no soil or waste samples had been collected as required. In addition, the CAWMP needs to be written by pull with the acreage calculated per pull to assist with recordkeeping as well as the irrigation system needs calibrating. At the time of the inspection, the following required information was not available for review: checklist for odor, insect, and mortality, and the lagoon design. The Division of Water Quality requested at that time of the investigation that the following items be addressed: 1. Ms. Herring needs to contact a technical specialist for assistance with recordkeeping. No IRR -2 forms were available for the facility and the IRR -1 forms were not acceptable due to inadequate information. Consult a technical specialist for assistance in calibrating the irrigation equipment and with the modification of the CAWW in regard to acreage in the pulls to assist with waste application records. 3. Consult with a technical specialist for assistance with obtaining the missing components of the CAWMP. 4. Collect waste samples within 60 days of waste application or every 120 days (quarterly) to prevent non-compliance. 5. Collect soil samples yearly or within 365 days of the previous samples. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Futhermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. If you have and explanation for these violations that you wish to present, please respond to this office on or before February 11, 2000. Your explanation will be reviewed and if an enforcement action is deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his consideration. This Review, undertaken in accordance with G.S. 143-215.1 OD, is one of two visits scheduled for all registered livestock operations during the 1999 calendar year. The Division of Water Quality will conduct a second site inspection. During the Review, it was noted that there were not any irrigation records on the farm site. The farm was noted in 1998 by Division of Soil and Water Conservation and Division of Water Quality regardingg setting up irrigation records for a running balance of nitrogen applied to spray fields. Mr. Bowen, which is the farm manager, needs to contact his technical specialist regarding setting up irrigation records for the farm site. Waste samples of lagoons need to be taken every 120 days. Waste samples of lagoon were dated 4-18-97, 9-2-97, and 5-8-98. Soil samples need to be taken once a year on all spray fields. No soil test results were on the farm site at the time of the operational review. You are strongly encouraged to contactour certified technical specialist for help. You may also want to contact your local Soil andWaterConservation District Office since they may be able to provide you with additional technical and/or financial assistance to implement corrective best management practices. Please remember that in order for your facility to be in compliance with environmental regulations, animal waste cannot be discharged into the waters of the State, and the animal waste collection, treatment, storage and disposal systems must be properly sized, maintained and operated under the responsible charge ofya certified operator.
