Director Division of Water Quality Subject: Dry Litter Poultry NPDES Permit Coverage NPDES Application NCA 183036 Mountaire Sayaphet Farm Scotland County The Division of Water Quality (Division) was required by the U.S. Environmental Protection Agency (EPA) to develop a National Pollutant Discharge Elimination System (NPDES) permit program for dry litter poultry waste management systems. Under this new program, your above referenced facility was required to submit an NPDES permit application prior to construction. Due to a recent decision by the U.S. Court of Appeals for the Second Circuit, facilities are no longer required to obtain coverage under an NPDES permit based solely on the size of the facility. Only farms that discharge to Waters of the State are required to obtain permit coverage. Based on the federal court decision and your information in your permit application, your facility is no longer required to obtain NPDES permit coverage prior to construction- If you would like to withdraw your permit application, please sign and return the enclosed permit application withdrawal form. Please note that if, in the future, your facility does discharge waste into Waters of the State, you will be required to obtain coverage under an NPDES permit. This file should include: 1) Form -Poultry Dry Litter Management Plan indicating ownership, location, waste generated and signed certificate. (Enclosed) 2) DRY -Form 1 - Record of Litter Removal, DRY -2, and DRY-3(Enclosed) 3) A waste analysis; a composite sample of the litter must be taken each time you clean out. Domestic and industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. 17.'A protective cover of.appropriate vegetation will be established on all disturbed areas .(lagoon embankments, berms, pipe runs, etc.). Areas shall be fenced, as necessary, to protect the vegetation. Vegetation such as trees, shrubs, and other woody species, etc., are limited.to areas where considered appropriate. Lagoon areas should be kept. mowed and - accessible.. Berms and.structures should. be inspected_ regularly for evidenee.of erosion, leakage, or discharge. 18. If animal production at tiny facility is to be suspended or terminated, the owner is responsible for obtaining and implementing a "closure plan". which will: eliminate the possibility of an illegal discharge,. pollution, and erosion. 19.. Waste_handling-structures, -piping, pumps, reels, etc:, should be inspected on a ire"r basis to prevent breakdowns; leaks, ,and spills. A regular maintenance. checklist should be'kept on site. 20. Animal waste can be used in a rotation that includes vegetables and other crops for direct human consumption. However, if animal waste is used on crops for direct'human consumption, it should only be applied pre -plant with no further applications of animal waste during the.crop season. 21. Highly visible markers shall be installed to mark.the top and bottom elevations of -the temporary storage (pumping volume)- of all waste treatment lagoons. -Pumping shall be managed to maintain the liquid level between the markers. A marker will be required to mark the maximum storage volume for waste storage ponds. - ------ ------------------------------------ - - - - -- - - Preview Database Version 2.0 Date Printcd 7/1/2003 Specification Page 3 SUMMARY OF ENVIRONMENTAL REGULATIONS The following are the environmental regulations affecting poultry dry litter systems as summarized by the Senate Bill 1217 Interagency Croup. 1. Dry litter wifl be sampled as close to the time of application as practical_ bit at Ieast within 60 days of land application for waste analysis. The state average N content for dry litter as shown in the North Carolina Agricultural Chemical Manual published annually by NCSU may be used to calculate application rates in lieu of individual waste analysis, however, waste analysis is still required. For more information about proper procedures for sampling manure for nutrient analysis, see Cooperative Extension Service publication number AG -439-33, Soil Facts; WasteAnalysis. 2. Litter will not be'stockpiled within 100 feet of perennial streams or groundwater wells. 3. Soils from fields receiving poultry litter applications will be sampled annually for a standard -soil fertility analysis- For more in#'ornration about proper piocedures for sampling mahure•for , nutrient analysis, see Cooperative Extension Service publication number AG -439-30, Soil Facts: Careful Soil Sampling -The Key to Reliable Soil Test Information. 4. Lime will be applied in accordance with the standard soil test report to assure suitable conditions for crop growth. 5.
