Dear Sir or Madam:
Thank you for your recent submittal of the information requested in our letter dated April 16,
2003. We greatly appreciate the effort that you made in compiling this information and sending
it to our Fayetteville Regional Office by the date required. We also appreciate the fact that you
reported the problem with high freeboard to our staff as required by your permit and worked with
our staff to manage the problem once it occurred.
Upon review and consideration of the information submitted, the Fayetteville Regional Office
has determined that no further compliance/enforcement actions will be taken by the Division for
these high freeboards.
Also, based on your actions to properly operate your facility, the Division of Water Quality
hereby rescinds the Notice of Violation that was issued to you on April 16, 2003, and replaces it
with this Notice of Deficiency.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range..
These methods include, but are not limited to, water conservation practices, adding additional
application sites, updating your cropping systems, adding additional and/or more flexible
application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate
levels throughout the year. Our staff looks forward to continuing to work with you and your
Technical Specialist to evaluate and implement any needed changes to your system.

On March 6, 2003, a representative of your animal operation informed the Division of
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility.
This lack of adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility on July 28, 1997. In addition to this Notice of Violation (NOV), this non-
compliance is subject to an appropriate enforcement action by DWQ. This action can consist of
one or more of the following: a civil or criminal enforcement action; an injunction; and/or a
requirement to apply for coverage under an individual permit. The action chosen will be based
on complete evaluation of all factors that resulted in the inadequate freeboard; the actions taken
to restore the needed freeboard; and the actions being proposed to prevent the problem from
reoccurring.
To assist us in our review, please provide the Fayetteville Regional Office with an
evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future freeboard
violation(s). This evaluation and strategy must include but is not limited to the following:
Current Freeboard level(s)
Freeboard level records in the lagoon(s) for the past 12 months up to the date of submittal
Spraying records for the past 12 months up to the date of submittal

Rainfall records for the past 12 months for this site up to the date of submittal (if

Cropping system and PAN specified in the CAWMP. If the cropping system was not in
compliance with the facility's CAWMP, provide details of the cropping system in place
for the past 12 months.
A summary of actions taken to restore the needed freeboard in the lagoon(s) including but
not limited to removal of animals from the site, delay of restocking of animals, pumping
and hauling waste to another site (specify site), securing additional irrigation equipment,
and securing additional spray sites.
A description of water conservation measures in use at the facility and the date(s)
installed.
If the lagoon level(s) are still in violation of the facility's CAWMP and Permit, provide
an updated Plan of Action as to how the facility will return to compliance.
Provide a detailed description of the actions taken or proposed to be taken to insure that
there are no further freeboard violations at this facility.
This information must be received by the Fayetteville Regional Office at the following
address no Iater than 10 days following receipt of this letter.

Once this information is received and evaluated by the DWQ staff, a determination will
be made as to the appropriate compliance/enforcement actions to be taken. Each case will be
evaluated on its own merit. The efforts by the owner/producer to notify DWQ of the problem,
efforts made to resolve the problem once identified, and efforts proposed to prevent future
problems will be positive factors in this determination.
Nothing in this letter should be taken as removing from you either the responsibility or
liability for this non-compliance or future cases of non-compliance_ If you have any questions
regarding this letter, please do not hesitate to contact our Fayetteville Regional Office Staff at
(910) 486-1541.

You are hereby notified that, having been permitted to have a non -discharge permit for the
subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to
be in violation of your 2H.0217 Permit.
On September 25, 2003, staff from the Fayetteville Regional Office of the Division of Water
Quality responded to a call from your company regarding a waste spill that had occurred on Farm_
7706. At the time of staff arriving at the scene repairs had been completed to a recycle line that
had ruptured and released wastewater for an extended period of time_ The wastewater had
traveled several hundred yards away from the lagoon, across pastureland and into a head of
woods. It then followed the low-lying land features into a thickly covered area believed to be the
headwaters of Beaverdam Creek. The company was responding by damming the Flow of waste
and by constructing sump -holding areas with heavy equipment_
The Division of Water Quality requests that the following items be addressed:
1. Provide a detailed description of events and results of any investigation into the spills cause
or causes.
2. Provide figures of quantity of waste lost to include method of determination, total gallons
released and amount recovered.
3. Detail any prevention, inspection, mechanical, or procedural changes implemented in order
to prevent or lessen future occurrences of this nature.

On May 1, 2001, staff from the Fayetteville Regional Office of the Division of Water Quality were
noti#led by you that an over -application of PAN had occurred on Farm # 7706 located in Scotland
County. The reported over -application occurred on pull 20 in the amount of 11 pounds and pull 10-b in
the amount of 13 pounds, which was in excess of 20 percent on the small grain overseed with an
application rate of 50 pounds. In addition, over -application reportedly occurred on pull 9-b and pull 8 in
the amount of 6 pounds and pull 5 in the amount of 7 pounds. The owner/operator is required to notify
the Regional Office in accordance with the General Permit condition II1.61 which states:
"Overapplying animal waste either in excess of the limits set out in the CAWMP or where runoff
enters surface waters".
A subsequent submittal by Murphy -Brown on July 23, 2001 identified an over -application of 6.5
pounds exceedance of the 50 pound small grain overseed on pull 20 after correction of the waste
application records. In addition, over -application remained the same on pull 8 at 6 pounds and pull 5 at 7
pounds..
Upon review and consideration of the information submitted, the Fayetteville Regional Office has
determined that the Notice of Violation issued on May 10, 2001, will be rescinded and reissued as a

This letter is in response to the violations on the farms noted above. We have taken different measures
to try and prevent these problems from reoccurring.
This year we are using a summary sheet that lets us know the hours left to pump per hydrant.
7681-3: We intend to add 2 hydrants. We will need an irrigation design and the work done.
S-'3-.2) 7706: We installed pressure regulators plus one bam with individual waterers.
7078-2: We purchased additional land and have an irrigation design. This work is now in
process.
7171: We have worked out an agreement with a local landowner to spray on his land. The
planning process & installation to add the spray field need to follow.
7701: Pressure reducers have been installed and water goal reduction put in place.
7702: Water saving devices has been installed and water reduction is occurring.
We are trying to reduce water usage on all farms. In addition to our regular water usage, we have dealt
with excessive rainfall this past year. We have tried to put ourselves in a better position this season but
the rainfall did hurt us.

permit for the subject animal waste disposal system pursuant to 15A NCAC 2H
.0217, you have been found to be in violation of your 2H .0217 Permit.
On June 29, 2000, staff from the Fayetteville Regional Office of the Division of
Water Quality performed an inspection of Farm #7706 in Scotland County. The
inspection revealed that the PAN rate had been exceeded on pulls ##4 and #8 by 8
and 18 pounds respectively. This is a violation of the CAWNT for the farm and
therefore is a violation of the General Permit. The inspection also revealed that
there is weed competition with the bermuda crop in some areas of the field that
need attention.
The Division of Water Quality requests that the following item(s) be
addressed:
1. Implement actions to ensure that over application does not occur. Close
monitoring of PAN balances is recommended to avoid over application.

, On January 31, 2000, you or staff from your farm notified the Fayetteville Regional Office
of the Division of Water Duality, as required by General Permit condition I11,6.e, that the freeboard
level of the lagoon was less than the minimum required by the General Permit. The liquid level of
the lagoon was reported as 18 inures. General Permit condition V.3 states that'The maximum
waste level in lagoonstsbrage ponds shall not exoeed that specified in the CAWMP. At a minimum,
maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate
storage to contain the 25-rear, 24-hour stop event plus as additional 1 foot of structural freeboard.'.
Time Division of Water Quality will take no further action for this reported incident at this
time. However, you are asked to please notify this office in writing within 15 days of receipt of this
letter as to what date the lagoon was lowered to the required freeboard level. This information is
essential in determining 6 the lagoon was lowered within the specified fire frame in which the Plan
of Action (POA) allotted. It will also close this event out within your fie. If you have any questions

As the result of the recent complaints from Scotland County citizens. I investigated a
Carroll's Foods, Inc. service facility currently under construction. This is a company and
facility known as Fairley Site #2 (Carroll's #7706) it was inspected on June 2, 1994.
My investigation revealed that this facility had animals stocked in one of the finished
buildings, but the required certification for Animal Waste Management has not been
approved or submitted to DEM. The lagoon was not constructed in accordance with design
plans and the Soil Conservation Service would not approve the waste management
certification. By stocking the animals prior to certification 15A North Carolina
Administrative Code 2H .0217 (a)(1)(g) was violated. It is the opinion of this office that
Carroll's Foods failed to act in accordance with the requirements of 15A NCAC 2H .0217(c)
and should be assessed a civil penalty for this violation pursuant to G.S. 143-25.6A(h).
The Carroll's company is currently preparing a written response to this violation and
once it is received, we will provide you with the official company explanation.
Please find the attached Notice of Violation Assessment of Civil Penalties letter for
the Director's signature for your review.

This letter is intended to provide you with relevant factual information regarding the
design and construction process for the above referenced farm. In accordance with our
normal procedures the site for this farm was investigated by Mr. Billy H. Jones, P.E.,
Area Engineer with USDA Soil Conservation Service on 10/29/93 and found suitable for
construction of a swine waste treatment lagoon.
A facility design and waste management plan was prepared and submitted to Mr. Matt
Kinane, District Conservationist in Scotland County on 12/30/93. The lagoon design
specified a lagoon 14 feet total depth. The design was approved by Mr. Billy Jones, P.E.
Our earth moving contractor informed us on 5/25/94 that the lagoon was finished and
ready for final inspection. An inspection was done by Mr. Howard Hobson, of our staff
(formerly USDA Soil Conservation District Conservationist, Sampson County) and Mr.
Billy Jones, P.E. At the time of this inspection it was discovered that due to
miscommunication between the upper management of our contractor and the on site
superintendent that the lagoon had been constructed to a finished total depth of eleven
feet rather than the fourteen foot total depth shown on the approved design. When we
were informed of the problem we immediately consulted with Mr. Jones about making
necessary changes to correct the error. After discussing several alternatives it was
decided that it would be advisable to expand the surface area of the lagoon by moving
the lagoon dike rather than excavating an already built and compacted bottom in order
to achieve original storage volume requirements. The original design was modified by
Mr. Billy Jones and the contractor immediately began making the specified changes. As
of this date the changes are nearly complete and final inspection and certification is
anticipated this week.
The problem for us has been the fact that we purchased and arranged for delivery of our
breeding stock animals to coincide with completion and certification of the facility. In
this particular situation we, in good faith, relied on the representation of our contractor
that the lagoon was built as designed when, in fact, it was not built as designed. We
acknowledge that Carroll's Foods is ultimately responsible for the occurrence of the
problem and may be subject to a notice of violation under the :new regulations. It is very
important to note, however, that our buildings are designed and constructed in such a
way that we can store all waste within the house for a period of time. In this case we
anticipate no problem storing all waste within the building until the necessary work is
completed to have a certified lagoon. The bottom line here is that no waste or discharge
will be placed in the lagoon before it is inspected and certified.
To assure that we don't find ourselves in this situation again we have implemented a
set of procedures and policies whereby a mid course, 75% complete, and 100% complete
checks will be carried out by our in house professionals. Final inspections by a
designated technical specialist will be completed and a copy of a "Certification For New
or Expanded Animal Feedlots" will be required before any animals can be placed on our
farms. The same procedure will be followed for all of our contract growers' operations.
We deeply regret that the situation on Farm 7706 has occurred but be assured that there
was no intention of not being in full compliance with all relevant rules and regulations.
There will not be any effluent or waste placed in the lagoon prior to its certification.
Furthermore we have no intention of allowing such a situation to reoccur.
As you decide bow your agency will respond to this event, we ask simply that you take
into consideration our history of environmental responsibility, the unique set of
circumstances surrounding this particular situation, and our commitment to insure that
such a situation doesn't reoccur.

supply you with any information we have.

As the result of the recent complaints from Scotland County citizens. I investigated a
Carroll's Foods, Inc. service facility currently under construction. This is a company and
facility known as Fairley Site #2 (Carroll's #7706) it was inspected on June 2, 1994.
My investigation revealed that this facility had animals stocked in one of the finished
buildings, but the required certification for Animal Waste Management has not been
approved or submitted to DEM. The lagoon was not constructed in accordance with design
plans and the Soil Conservation Service would not approve the waste management
certification. By stocking the animals prior to certification 15A North Carolina
Administrative Code 2H .0217 (a)(1)(g) was violated. It is the opinion of this office that
Carroll's Foods failed to act in accordance with the requirements of 15A NCAC 2H .0217(c)
and should be assessed a civil penalty for this violation pursuant to G.S. 143-25.6A(h).
The Carroll's company is currently preparing a written response to this violation and
once it is received, we will provide you with the official company explanation.
Please find the attached Notice of Violation Assessment of Civil Penalties letter for
the Director's signature for your review.
