Dear Mr. Gibson:
On May 20,1999, staff from the Fayetteville Regional Office of the Division
of Water Quality inspected the T.G. Gibson Farm swine facility. It was observed
that portions of the inside slopes of the lagoon failed to have an adequate grass
cover. The lagoon marker did not adequately reflect the level within the lagoon
and freeboard records were not being recorded as required by the General Permit
that was originally issued to this facility on June 9, 1997. General Permit
condition 111.2 states that "If not already installed at this facility, a waste -level
gauge to monitor waste levels shall be installed within 60 days of issuance of the
COC under this general permit. This gauge shall have readily visible permanent
markings indicating the maximum liquid level at the top of temporary liquid
storage volume, minimum liquid level at the bottom of the temporary liquid
storage volume, top of dam elevations. Waste lagoon and storage pond levels
shall be recorded weekly on forms supplied or approved by the DWQ".

It was noted from the inspection that the coastal bermuda stand in one of the
spray fields was weak in some areas. The farm did not contain a copy of the
Certificate of Coverage (COC) and the General Permit on-site. General Permit
condition I.4 states that "A copy of this General Permit, COC, certification forms,
lessee and landowner agreements, and the CAWW shall be readily available at
the farm (stored at places such as the farm residence, office, outbuilding, etc.)

where animal waste management activities are being conducted for the life of this

permit. These documents shall be kept in good condition and records shall be

maintained in an orderly fashion. .

In regard to the deficiencies noted during the inspection, the following actions are requested:
1. Continue to work on establishing a grass cover on the inside slopes of the lagoon to prevent
erosion.
2. Consult with a technical specialist to modify or replace the current lagoon marker in order to
accurately reflect the maximum and minimum liquid level elevations based on the lagoon design.
3. Immediately begin to record freeboard levels weekly in order to be in compliance with the
General Permit.
4. Evaluate the coastal bermuda at the end of the growing season to detennine if resprigging will
be required to establish an adequate crop in the areas of the spray field mentioned above.
5. Maintain a copy of the COC and the General Permit on the farm site.
Please provide a written response to this office on or before June 25, 1999 regarding corrective
actions taken or planned. Nothing in this Ietter should be taken as absolving this facility of the
responsibility and liability of any violations that have or may result from these deficiencies. If you

This is in response to your letter of May 28, 1999 noting
deficiencies in my swine facility in Scotland County. The
corrective actions have been taken:
1. I have began monitoring the grass growth on the inside
slopes of the lagoon and using best management practices to
encourage growth and prevent erosion.
2. I have consulted with Ed Holland with Scotland County
NRCS and Bryan Spell with Dogwood Farms, Inc. to install the
correct lagoon marker as required.
3. As of June 1, 1999, freeboard levels have been recorded
weekly as required by the General -Permit.
4. I have consulted with Ed Holland on the coastal bermuda
and will monitor the growth at the end of the growing season to
determine if resprigging is necessary in 2000.
5. Copies of the Certificate of Coverage and General Permit
have been posted on the farm site.
I apologize for the deficiencies noted in your letter and any
inconvenience they may have caused. Hopefully, the corrective
actions I have taken will bring my swine facility into compliance
with the General Permit. I appreciate your cooperation in this
matter.
