Drawer 856 Warsaw, NC 28398 Subject: NOTICE OF VIOLATION Administrative Code 15A NCAC 2H .0217 Carroll's Foods Farm # 7078 Unit 2 Facility No. 83-13 Scotland County Dear Mr. Stutts: You are hereby notified that, having been Permitted to have a non discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H.0217, you have been found to be in violation of your 2H.0217 Permit. On June 30, 2000, staff from the Fayetteville Regional Office of the Division of Water Quality performed an inspection of Carroll's Farm 47078 unit 2 located in Scotland County. The inspection revealed that over application of - nitrogen had occurred on the small grain overseed in excess of the limits specified in the CAWMP by more than twenty percent. Follow your CAWMP in regards to nitrogen amounts to he applied to the crop. Failure to comply with the above conditions may result in the facility losing it's General Permit and being required to obtain an individual non discharge permit for the facility. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. Please provide a written response to this office on or before September 15 2000 regarding corrective actions taken or planned. Laurinburg Division Farms: 7681-3, 7706, 7078-2, 7702, 7171 Dear Sir: rx- E, P This letter is in response to the violations on the farms noted above. We have taken different measures to try and prevent these problems from reoccurring_ This year we are using a summary sheet that lets us know the hours left to pump per hydrant. 7681-3: We intend to add 2 hydrants. We will need an irrigation design and the work done. 7706: We installed pressure regulators plus one bam with individual waterers. - 4-P 7078-2: We purchased additional land and have an irrigation design. This work is now in process. 7171: We have worked out an agreement with a local landowner to spray on his land. The planning process & installation to add the spray field need to follow. 7701: Pressure reducers have been installed and water goal reduction put in place. 7702: Water saving devices has been installed and water reduction is occurring. We are trying to reduce water usage on all farms. In addition to our regular water usage, we have dealt with excessive rainfall this past year. On May 1, 2001, staff from the Fayetteville Regional Office of the Division of Water Quality were notified by you that an over -application of PAN had occurred on Farm # 7078-2 located in Scotland County_ . The reported over -application occurred on pull 4-a in the amount of 13 pounds which is in excess of 20 percent on the small grain overseed with an application rate of 50 pounds. The owner/operator is required to notify the Regional Office in accordance with the General Permit condition 111.61. which states: "Overapplying animal waste either in excess of the limits set out in the CAWMP or where runoff enters surface waters". The Division of Water Quality requests that the following items be addressed: 1. Submit an explanation of what occurred that resulted in the over -application of PAN to the waste application field as required by your General Permit. 2. Submit a copy of the past rear of freeboard records for the facilih'. 3. Submit a copy of the past year of irrigation records for the facility. 4. Ross, Jr., Secretary Alan Klimek, P.E., Director Division of Water Quality On July 30, 2002, staff from the Fayetteville Regional Office of the Division of Water Quality, conducted an inspection of Farm # 7078-2 in Scotland County. The inspection revealed that the Bermuda grass crop in most waste application fields was adequate, however; continued efforts were needed to control the weeds and grasses. In addition, dontinue the efforts to establish a suitable grass cover on the inside slope of the lagoon dikes. Also, a review of the irrigation records (IRR -2 forms) identified a problem with the spring application on the bermuda grass in several fields. The plant available nitrogen (PAN) applications in a two week period in April amounted to as much as 243 pounds on one field (pull) which exceeds the recommended agronomic rate of 60 to 80 pounds per cutting of bermuda. The Division of Water Quality requests that the following items be addressed: 1: Consider the use of chemical herbicides such as Plateau for control of grass competition. Contact an agronomist for assistance with recommendations. 2: Continue efforts to establish a suitable grass cover on the inside slope of the lagoon dikes. 3. Review the IRR -2 forms with the OIC for the facility and explain the necessity of irrigating all risers throughout the season to prevent agronomic issues. In the future, please continue to evaluate ways to maintain freeboard levels in the required range. These methods include, but are not limited to, water conservation practices, adding additional application sites, updating your cropping systems, adding additional and/or more flexible application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate levels throughout the year. The Waste Utilization table shown below summarizes the waste utilization plan for this operation. This plan provides an estimate of the number of needed to use the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown, their nutrient requirements, anu proper timing of applications to maximize nutrient uptake. This table provides an estimate of the amount of nitrogen required by the crop being grown and an estimate of the nitrogen amount being supplied by manure or other by-products, commercial fertilizer and residual from previous crops. An estimate of the quantity of solid and liquid waste that will be applied on each field in order to supply the indicated quantity of nitrogen from each source is also included. A balance of the total manure produced and the total manure applied is included in the table to ensure that the plan adequately provides for the utilization of the manure generated by the operation. Animal operations that generate liquid waste and utilize waste storage facilities (lagoons or holding ponds) may apply more or less waste in any given year than is annually generated by the facility. In order to determine whether the plan adequately utilizes the waste produced by the facility, the storage capacity table included in this plan should be reviewed to ensure that the design capacity of the storage facility is not exceeded during the planning period. Depending on the requirements of the crop and the nutrient content of the waste, some nutrients will likely be over or under applied if animal waste is being utilized. Waste should be analyzed before each application cycle and annual soil tests are required if animal waste is being applied. Soil tests should be used to balance the nutrient application amounts with the realistic yields of the crop to be grown. Nutrient management plans may require that the application of animal waste be limited so as to prevent over application of phosphorous when excessive levels of this nutrient are detected in a field.
