You are hereby notified that, having been permitted to have a National Pollutant Discharge Elimination (NPDES)
permit for the subject animal waste disposal system pursuant to N. C. General Statutes 143-215 et seq. and
Section 402 of the Clean Water Act, you have been found to be in violation of your NPDES Permit.
Violation 1: Discharge of animal waste to surface waters as prohibited by your facility's permit
(Permit No. NCA200000 Section 11.)
On December 12, 2005 Division of Water Quality personnel observed animal waste flowing from your waste
application field, into a ditch that runs along Creek Road and then emptying into an unnamed tributary of Indian
Swamp.
Required Corrective action for Violation 1:
If you have not already done so, immediately cease discharging and begin efforts to recover the discharged animal
waste. This waste must be handled as prescribed by your CAWMP and applicable state law, Additionally, take all
necessary steps to ensure this violation does not reoccur.

The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the
following items on or before January 20t6 2005 unless another time frame is indicated below:
1. Copies of all the pumping records, lagoon levels, rainfall records and waste analyses for this farm from
January 1, 2005 to the present along with a copy of your CAWMP.
2. Please have the OIC for this farm include an explanation as to how this violation occurred.
3. Please have the OIC include a list of the steps that will be taken to prevent this violation from occurring in
the future.
Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions
for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy
a civil penalty of not more than $25,000.00 per day per violation.
If you have an explanation for these violations that you wish to present to this office, please forward a detailed
explanation, in writing, of the event noted and why you feel that this office should not proceed with recommendation
for enforcement. This office should receive information in the time frame requested within this letter. Information
provided to this office will be reviewed and, if enforcement is still deemed appropriate, your explanation will be
forwarded to the Director with the enforcement package for his consideration.

You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste
disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 2H.0217 Permit,
Violation 1: Failure to meet monitoring and reporting requirements as specified in the facilities Swine
Waste Management System General Permit as listed below.
1. The facility had not conducted an inspection of the waste collection, treatment, and storage structures on a
weekly, monthly or after storm events of greater than one inch in 24 hours. These records had not been kept for the
past several years.
Required Corrective Action for Violation 1:
Please begin to perform all record keeping conditions required by your permit. These include but are not limited to
weekly lagoon levels, monthly waste treatment system inspections, monthly stocking records, and inspections of
the waste treatment system after storm events of greater than one inch within 24 hours.
This office recognizes that the farm has not operated at full capacity for several years, but as long as the permit
remains in effect all compliance conditions must be followed and maintained. It is the expectation of this office that
Ben - Mar Farms will, '1f in operation at any capacity, adhere to the conditions of the permit and operate within
compliance guidelines.
The Fayetteville Regional Office will assist you in understanding and complying with your permit if that assistance is
requested. This office will conduct another compliance inspection in early 2005 to verify the compliance efforts
being made on your farm.

Mr. Guyton:
As required by the NPDES Permit, this letter serves as a written report of the discharge
that occurred at Dan Lewis Farms (NCA278078) on December 12, 2005.

The discharge was caused by jhe cattle grazing in the sprity area; evidently, the cows
flipped the "kill %witch" that turns off the engine used to retrieve the gun to the reel.
Consequently the gun remained in the same place in the pull for approximately 45
minutes causing the effluent to pool on the ground and move over the ground to the road
side ditch.

At approximately 10:00 a.m. on December 12, 2005, I started the first of three guns used
on th6 farm to apply effluent- Then I went to 5ct up and start the oa-Ler 2 guns on the stune
1'anr :. This took about 45 minutes. On returning to check the first gun, l noticed that it
was not tieing reeled in and immediately went to the hydrant to turn off the flow of
effluent. At 180 gpm, the estimated amount of effluent in one location on the spray field
was 8100 gallons.
Una*arc that there was an overland flow of effluent moving',toward the road side ditch, 1
I 'l; left the site for approximately 45 minutes leaving the gun turned off. On returninb to the
site, f saw the effluent approaching the road side ditch and observed you there as well. As
regrlstrd, my farm employee and 1 dammed the ditch with a shovel in 3 locations to
prevent as much effluent as possible from reaching the nearby branch.
Leaving the employee to monitor the darns in the ditch, 1 went for a pump and tank and
pumped the effluent out of the ditch, into the tank and back into the lagoon. This was
repeated at 7:00 p.m. that night and again at 7:00 a.m. the next morning.

The discharged liquid removed from the ditch on the first pumping was approximately
1500 gallons and would have been almost all effluent. On the second pumpint, of the
ditch,?the liquid removed was about 700 gallons. By the third time: pumping the liquid
out of the ditch, on 12/13/05. we estimated that the ligtud was 50/50 effluent and water
seepin(; out of'the ground with a quantity of about 1000 gallons.

2. A subsoiler will be usjed in increase the permeability of the soil on the farm.
There has been some soil compaction as a result oi'having cattle on the spray
fields.
3.. The "kill switch" that;waS turned off by the cows will be secured.
4, if necessary, the cows will be removed from the spray fields during pumping.

The waste from vour animal facility must be land applied at a
specifies rate to prevent pollution of surface water and/or
groundwater. The plant`riuLrients in the animal waste should be used
to reduce the amount of commercial fertilizer;required for the crops
in the fselds where the waste is to be applied_'
This waste utilization plan uses nitrogen as;;the limiting nutrient.
Waste should bo analyzed;,befare each application cycle. Annual soil
tests are strongly encouraged so that all plant nutrients can be
balanced{,for realistic yields of the crop to be grown.
Several ,factors are important in implementing your waste utilization
plan in :order to maximize the fertilizer value of the waste and to
ensure t`�iat it is applied in an environmentally safe manner:
1, " Alwaya apply waste based on the needs. of the crop to be
grown and the nutrient content of the waste. Do not apply
more nitrogen than the crop can utilize.
2.,: Soil types are important' as they have different infiltration
rates, leaching potentials, cation exchange capacities, and

available water holding capacities.
3 _ ; Normally waste shall he aPnl.; f=d tn'; land eroding at less than
5 tons per acre per year. Waste may be applied to land
eroding at 5 or more tons per acre annually, but less than
10 tons per acre per -year proviailiy Uhat adequate filter
strips are established.
4.! Do not apply waste on saturated soils, when it is raining,
or when the surface is frozen. Either of these conditions
i may result in runoff to surface waters which is not allowed
under DWQ regulations.

SLUDGE APPLICATION: �
The wastel utilization plt must contain provisions for periodic land
application of sludge at,';agronomic rates. The sludge will be nutrient
rich and will require precautionary measures to prevent over application
of nutrie#ts or other elements_ Your production facility will produce
approximately 1953.6 pounds of plant available nitrogen per year in the
sludge.
If you remove tte sludge every 5 years, you will have approximately 9768
pounds of,, PAN to utilize .j, Assuming you apply ,;this PAN• to hybrid
bermudagrass hayland at,the rate of 300 pounds of nitrogen per acre, you
will need! 32.55 acres ofland. If you apply the sludge to corn at
the rate of 125 pounds of'nitrogen per acre, you will need 78.144 acres
