Robeson County Dear Mr.Brown: On July 17, 1997, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an inspection of the Brown's of Carolina swine facilities noted above. At the time of the inspections, no one with nutrient management was present at any of the sites .Therefore, the waste management plans for these farms were not available to the inspector and a complete inspection could not be performed. In regard to the deficiency noted during the inspection, the following actions are requested: Please provide this office with a copy of the waste management plans for the above mentioned farms so that a review of the plans may be conducted and the inspections completed. Please provide a written response to this office on or before J* 31-1997 as to the actions taken or proposed to be taken to resolve this deficiency. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have resulted or may result from these deficiencies. At time of inspection, a complete set of irrigation records were not available for review. In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Lower the lagoon level to the required freeboard on a suitable waste application field as soon as weather permits. 2. Consult with a technical specialist in order to design a more permanent solution to address the problem of standing water in the irrigation fields. 5. Item #1: As of April 24`x, farm 21 was at 19 inches of freeboard and farm 26 was at 23 inches. We have been and continue to pump these two farms, weather permitting. We are using extreme care in pumping where we have cut temporary ditches in order to insure that no wastewater leaves the farm. Item #2 & #3: Any necessary mowing and reseeding around lagoons will be completed by May 15t'. Lagoons are normally mowed on a regular basis and our efforts will be to keep them mowed on a regular basis. Reseeding will be done with proper seed and fertilization rates_ Item #4: Initial contact and discussion has already begun with technical specialist to develop a plan to remove surface water and eliminate opening a temporary ditch. In my previous statement, I indicated we would make this happen between the wheat and soybean crops_ This should reflect a completion date by June 3&. Item #5: A copy of the waste management plan and all records will be placed in the office at farm 21. The pumping records will be updated bi-weekly or as irrigation events take place. The complex manager will continue to have all plans and records as well as field sheets for the two weeks the farm copy may be missing. This should be completed by May 31. Box 487 Warsaw, NC 28398 March 21, 2000 SUBJECT: NOTICE OF DEFICIENCY Farm # 26 Facility No. 78 - 41 Permit No. AWS780041 Robeson County Dear Mr. Vinson: On February 7, 2000, you or staff from your farm notified the Fayetteville Regional Office of the Division of Water Quality, as required by General Permit condition 111.6.e, that the freeboard level of the lagoon was less than the minimum required by the General Permit. The liquid level of the lagoon was reported as 17 inches. General Permit condition V.3 states that `The maximum waste level in lagoonststorage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoonststorage ponds must not exceed the level that provides adequate storage to contain the 25 -year, 24-hour storm event plus an additional 1 foot of structural freeboard.'. The Division of Water Quality will take no further action for this reported incident at this time. However, you are asked to please notify this office in writing within 15 days of receipt of this letter as to what date the lagoon was lowered to the required freeboard level. This information is essential in determining if the lagoon was lowered within the specified time frame in which the Plan of Action (POA) allotted. Facility Registration No. 7841 Robeson County Dear Mr. Davis: On June 19, 2000, staff from the Fayetteville Regional Office of the Division of Water Quality inspected the Brown's of Carolina # 21& 26 Company swine facility. It was observed from a review of the waste application records for the farm that a minimal over -application of plant available nitrogen (PAN) had occurred during the previous small grain overseed crop. In addition, the waste application field has a drainage problem in two areas that needs correcting to prevent ponding of wastewater and surface water. Also, at the time of the inspection the center pivot main power board circuitry had been destroyed by lightning and requires immediate attention as this is the only means of irrigation on the farm. In regard to the deficiencies noted during the inspection, the Mowing actions are requested: Immediately initiate the planned corrections to the waste application field drainage problem so that the soybean crop can be planted. 2. Repair the center pivot electrical components to allow waste application to prevent a high freeboard condition. Please notify this office on or before July 20, 2000 at the address below as to the actions taken or proposed to be taken to resolve this deficiency.
