Dear Mr. Davis:
On April 9, 1998, staff from the Fayetteville Regional Office of the Division of
Water Quality inspected the Brown's of Carolina Farm #21 and 426 swine facility.
It was observed that the facility's waste lagoons were in the emergency storage
level (13.5 inches and 18 inches) according to the marker. There were a few bare
spots on the inside slopes of the lagoon on farm #26. It was also noted that the
inside banks of the lagoon on farm #21 needs to be mowed to prevent problems
with rodents. Surface water was standing in several areas of the spray field.
Ditches had been dug in order to drain the standing surface water as a temporary
solution to the problem. At time of inspection, a complete set of irrigation records
were not available for review.
In regard to the deficiencies noted during the inspection, the following actions
are requested:
1. Lower the lagoon level to the required freeboard on a suitable waste
application field as soon as weather permits.
2. Establish a suitable grass cover on the inside slopes of the lagoon on farm #26.

Mr. Brown,
This letter is in response to your letter dated April 17, 1998, Notice of Deficiency,
Brown's of Carolina, Faun 21 & 26, Registration No. 7841, Robeson County.
Item #1:
As of April 24`x, farm 21 was at 19 inches of freeboard and farm 26 was at 23
inches. We have been and continue to pump these two farms, weather permitting. We
are using extreme care in pumping where we have cut temporary ditches in order to
insure that no wastewater leaves the farm.
Item #2 & #3:
Any necessary mowing and reseeding around lagoons will be completed by May
15t'. Lagoons are normally mowed on a regular basis and our efforts will be to keep
them mowed on a regular basis. Reseeding will be done with proper seed and
fertilization rates_
Item #4:
Initial contact and discussion has already begun with technical specialist to
develop a plan to remove surface water and eliminate opening a temporary ditch. In my
previous statement, I indicated we would make this happen between the wheat and
soybean crops_ This should reflect a completion date by June 3&.
Item #5:
A copy of the waste management plan and all records will be placed in the office
at farm 21. The pumping records will be updated bi-weekly or as irrigation events take
place. The complex manager will continue to have all plans and records as well as field
sheets for the two weeks the farm copy may be missing. This should be completed by
May 31.

Dear Mr. Davis:
On June 19, 2000, staff from the Fayetteville Regional Office of the
Division of Water Quality inspected the Brown's of Carolina # 21& 26
Company swine facility. It was observed from a review of the waste
application records for the farm that a minimal over -application of plant
available nitrogen (PAN) had occurred during the previous small grain
overseed crop. In addition, the waste application field has a drainage
problem in two areas that needs correcting to prevent ponding of wastewater
and surface water. Also, at the time of the inspection the center pivot main
power board circuitry had been destroyed by lightning and requires
immediate attention as this is the only means of irrigation on the farm.
In regard to the deficiencies noted during the inspection, the
Mowing actions are requested:
Immediately initiate the planned corrections to the waste application
field drainage problem so that the soybean crop can be planted.
2. Repair the center pivot electrical components to allow waste
application to prevent a high freeboard condition.
Please notify this office on or before July 20, 2000 at the address
below as to the actions taken or proposed to be taken to resolve this
deficiency. Nothing in this letter should be taken as absolving this facility of
the responsibility and liability of any violations that have or may result from
these deficiencies.

EXHIBIT 14 NOTES
[11 This drowing is intended to illustrate basic on-site conditions and proposed
lay -out of the swine effluent spray irrigation fields, irrigation zones, and
pipe routing for the Clear View Farm near Ellerbe. NC. Certain items shown
on this drawing ore symbolic and ore ore not intended to represent exact
dimensions. The irrigation sstem is proposed and may change slightly some from
this drawing. Spray field slopes are proposed and are yet to be cleared for crops.
[21 This drawing is to serve only as an illustrotion for the reviewer and was not
prepared by a surveyor. The engineer took property line dimensions and stream
locations from USES topo maps, aerial photographs, Lox maps, and on-site
measurements, thus malting the scale and north arrow approximate. This drawing
is not to be used for property line verificoLions or deed purposes.
131 Most above ground and underground utilities are not shown on this drawing but
should be located prior to any soil disturbances.
[41 Crops receiving animal waste must be mointoined and kept in good condition,
On -the -ground irrigation patterns sholl be as close as possible to those shown on
this drawing, but some minor olternotions is an operational reality. Animal waste
shall not be applied more than 30 days prior to planting a crop or 30 days from in
crop breaking dormancy.
[51 Spray zones shall honor all boundary set -backs established by regulation. Wetted
area set -hocks shown are suggested as minimums based on this being a new irrigation
-backs are listed in the written specifications. The farmer shall be
sys+-em. All set
responsible for measuring all in--the-field set -backs, making sure they meet regulations.
The operator shoil always allow for wind drift when irrigating animal waste. Surface
run-off of animal waste is prohibited.
[61 This form is not. expanding and will maintain the same permitted SteadLy. State Live Weight.
[71 The operator shall make every effort to operote the system as designed and
in accordance with the written specifications provided by the engineer. This
Exhibit is only a part of the totol Certified Animal Waste Management, (CAWMP).
Slight changes in the day-to-day operation of on irrigotlon system is an operational
reality, but the operator must try to match cropping patterns and irrigation amounts
to the CAWMP details. Significant changes in the CAWMP should be recorded.
[81 The former or irrigation installer may substitute specified components if those
components ore compatible with the intent of the design and will enhance system
performance. In addition. the irrigation installer may add additional cut-off valves,
air relief valves. etc. as per on-site conditions.
[91 Persons and ar-umols shall be kept out of fields when being irrigated. Sediment
and soil erosion s' all be controlled on all meld receiving animal waste.
[101 All animal wos e. irrigation shall be done by a certified operator.
[111 Elevations, hydraulic heads, pump rotes. precipitation rates. application volumes.
etc. ore discussed in the written CAWMP.
[121 Irrigation equI an+- is: 1) Kif co Ag Rain Hard Hose Traveler. Model T25A. with 880
Feet. of 2.5 inch I.D. hose. 2) Gun is a Nelson SR 100R nozzle with 0.77 inch ring: 3) Pump
is ❑ Kif co-Coprnri PTO driven pumpp. Model D3/65 with 4 inch inlets and outlets: 4) A
Form tractor will drive the pump: 51) Force main piping will be 4 inch gasket or glue
,Joint PVC pipe.
[131 Field acres not shown under Irrigation may be broadcast with animal waste
provided it Is applied at agronomic rates. However, only irrigation is being discussed
in the revised CAWMP.
[141 The manufacturer's published wetted diameter for this nozzle at 90 psi is 2175
feet. The engineer reduced the published diameter by 90% per the directions found
in the Cooperative Extension Publication AG -553-7. The corrected wetted diameter is
250 feet as shown on this drawing. The lane spacings were chosen to be 70% of the
corrected wetted diameter or 175 feet. Irrigated acres ore of fective design acres
and not total wetf.ed acres.
[151 Prorer
rty east of stream B --B ma or not be purchased by North Moore Management,
but way it is not scheduled for irrigation at this time.
[161 When crossing a stream with the force main, sleeve the force main inside a larger
diameter PVC pipe at least 20 feet either side of the stream. Stabilize the sleeve pipe
of the stream crossing as needed. Seal the sleeve pipe ends so water and soil does
not enter between the sleeve pipe and the force main.
