We greatly appreciate the effort that you made in compiling this information and sending it to our Fayetteville Regional Office by the date required. We also appreciate the fact that you reported the problem with high freeboard to our staff as required by your permit and worked with our staff to manage the problem once it occurred. Upon review and consideration of the information submitted, the Fayetteville Regional Office has determined that no further compliance/enforcement actions will be taken by the Division for these high freeboards. Also, based on your actions to properly operate your facility, the Division of Water Quality hereby rescinds the Notice of Violation that was issued to you on April 16, 2003, and replaces it with this Notice of Deficiency. In the future, please continue to evaluate ways to maintain freeboard levels in the required range. These methods include, but are not limited to, water conservation practices, adding additional application sites, updating your cropping systems, adding additional and/or more flexible application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate levels throughout the year. Our staff looks forward to continuing to work with you and your Technical Specialist to evaluate and implement any needed changes to your system. Director Division of Water Quality April 16, 2003 t _ 232003 On March 7, 2003, a representative of your animal operation informed the Division of Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility. This lack of adequate freeboard is in non-compliance with the Certificate of Coverage issued to this facility on June 9, 1997. In addition to this Notice of Violation (NOV), this non- compliance is subject to an appropriate enforcement action by DWQ. This action can consist of one or more of the following: a civil or criminal enforcement action; an injunction; and/or a requirement to apply for coverage under an individual permit. The action chosen will be based on complete evaluation of all factors that resulted in the inadequate freeboard; the actions taken to restore the needed freeboard; and the actions being proposed to prevent the problem from reoccurring. To assist us in our review, please provide the Fayetteville Regional Office with an evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future freeboard violation(s). Provide a detailed description of the actions taken or proposed to be taken to insure that there are no further freeboard violations at this facility. This information must be received by the Fayetteville Regional Office at the following address no later than 10 days following receipt of this letter. Director Division of Water Quality You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H _0217, you have been found to be in violation of your 21-1.0217 Permit. On September 1, 2004, staff from the Fayetteville Regional Office of the Division of Water Quality visited Carroll's Farm 7701. Carroll's employee Matt Mehlenbacher notified DWQ staff of a waste release from one of the confinement houses. At the time DWQ staff arrived, they found evidence that waste had exited the back comer of the confinement house through a foundation wall crack_ The waste then moved across a farm road and traveled down slope through approximately 100 yards of woods to an area of swamp flat water. Company personnel had constructed a small berm to prevent the waste from entering the waters of the swamp. An estimated one to five gallons did enter the swamp waters and thus the waters of the state_ Company personnel had constructed catch basins and the accumulated waste was being pumped back into the lagoon. Subsequent follow up documented a completed clean up with minimal potential adverse environmental impacts observed. During the DWQ inspections, the following violations were noted: Violation 1: Any discharge of waste that reaches surface waters is prohibited. Contained in your CAWMP (Permit No. AWS780031, Required Specifications For Animal Waste Management #1.} When the inspectors arrived at the farm on September 1, 2004, waste had exited the farm proper and had flowed into the nearby swamp waters. Your CAWMP specifications state " Animal waste shall not reach surface waters of the state by runoff, drift, manmade conveyances, direct application, direct discharge during operation or land application. Any discharge of waste that reaches surface water is prohibited. This constitutes a violation of your Permit. Required Corrective Action for Violation 1: In regards to this point the company reacted to mitigate the release and recover as much waste as possible. Waste handling structures, piping, pumps, reels, ect. should be inspected on a regular basis to prevent breakdowns, leaks, and spills. A regular maintenance checklist should be kept on site. Required Corrective Action for Violation 2: If you have not already done so, regularly inspect the complete waste treatment system on this farm for potential problems. Special attention should be given to the foundation walls of the confinement houses for cracks. Such cracks should be repaired immediately and any other maintenance problems addressed. If possible the cause of the plugged line should be identified and if needed steps taken to prevent the same occurrence in the future. The Division of Water Quality requests that, in addition to the specified corrective actions above, please submit the following items on or before September 30, 2004: 1. Please have the OIC for this farm include an explanation as to how these violations occurred. 2. Please have the OIC include a list of the steps that will be taken to prevent these violations from occurring in the future. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for these violations or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. The irrigation record (IRR -2) was calculated for the entire field area and not for the actual application area of the hydrant, resulting in a higher nitrogen balance. In order to correct this deficiency you are requested to implement the following: 1. The certified waste management plan does not calculate the actual area available for irrigation or the area of each hydrant to allow for computing nitrogen balances. Please upgrade your certified waste management plans to identify the individual waste application areas by hydrants and the acerage encompassed. 2. Begin immediately to calculate the nitrogen balance for the crop on a per hydrant basis on the IRR -2 form to prevent exceedances of the crop uptake. 3. Laurinburg Division Farms: 7681-3, 7706, 7078-2, 7702, 7171 Dear Sir. P11 This letter is in response to the violations on the farms noted above. We have taken different measures to try and prevent these problems from reoccurring. This year we are using a summary sheet that lets us know the hours left to pump per hydrant. 7681-3: We intend to add 2 hydrants- We will need an irrigation design and the work done. 7706: We installed pressure regulators plus one bam with individual waterers. 7078-2: We purchased additional land and have an irrigation design. This work is now in process. 7171: We have worked out an agreement with a local landowner to spray on his land. The planning process & installation to add the spray field need to follow. 7?- 3) 7701: Pressure reducers have been installed and water goal reduction put in place. 7702: Water saving devices has been installed and water reduction is occurring. We are trying to reduce water usage on all farms. In addition to our regular water usage, we have dealt with excessive rainfall this past year.
