OFFICE June 24, 1998 Re: Notice of Deficiency Facility No. 78-15 This letter is in response to the Notice. of Deficiency received for BOC -24, Registration No. 78-15. Ater reviewing this document I see that most of these items are covered by our complex managers routine inspections and repairs. The erosion problem and mowing are part of our on-going maintenance. I will check and see that if not done by now that it will be corrected as soon as possible. As far as the irrigation records are concerned, we are working on this item for all of our farms, and it too should be corrected soon. In regard to item #4, we will check to see if it is not allowed to use this as a shade area. If not, then this too will be corrected. Robeson County Dear Mr.Brown: On July 17, 1997, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an inspection of the Brown's of Carolina swine facilities noted above. At the time of the inspections, no one with nutrient management was present at any of the sites .Therefore, the waste management plans for these farms were not available to the inspector and a complete inspection could not be performed. In regard to the deficiency noted during the inspection, the following actions are requested: Please provide this office with a copy of the waste managemezu plans for the above mentioned farms so that a review of the plans may be conducted and the inspections completed. . Please provide a written response to this office on or before July 31, 1997 as to the actions taken or proposed to be taken to resolve this deficiency. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have resulted or may result from these deficiencies. It was observed that there were some serious erosion problems on the back slopes of the sow lagoon. Erosion was also noted around the inlet irrigation pipe on the dike of the finishing lagoon. The inside banks of the isolation lagoon contained high weeds and need to be mowed around. It was also noted that irrigation records need some improvement_ Irrigation records indicated that the number of acres had not been calculated for each pull for each of the spray fields. It was observed that cows were allowed into a wet area feeding into the Little Marsh Swamp. In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Consult with a technical specialist for assistance in regard to rectifying the erosion problem around the back slopes of the sow lagoon along with the erosion problem on the finishing lagoon. 2. Box 487 Warsaw, NC 28398 SUBJECT: NOTICE OF DEFICIENCY Farm # 24 Swine Facility Registration No. 78-15 Robeson County Dear Mr. Davis: On June 19, 2000, staff from the Fayetteville Regional Office of the Division of Water Quality inspected the Brown's of Carolina # 24 Company swine facility. It was observed from a review of the waste application records for the farm that a minimal over -application of plant available nitrogen (PAN) had occurred during the previous small grain overseed crop. In addition, two of the discharge pipes are in need of repair to prevent further damage to the piping or possibly result in a discharge. Also, two cattle loafing areas adjacent to the waste application fields have a serious buildup of decaying hay and other food products (approximately 12 to 18 inches in depth) resulting in a black water discharge ponding after heavy rams. In regard to the deficiencies noted during the inspection, the Mowing actions are requested: 1. Immediately initiate the planned corrections to the loafing areas adjacent to the waste application field to prevent a discharge. 2. Repair the discharge pipes to prevent further damage and or a possible discharge.
