Box 1767 Larinburg, NC 28353 Subject: NOTICE OF VIOLATION Carroll's Farm 7572 Facility No. 78- 12 Robeson County Dear Mr. Mehlenbacher: You are hereby notified that; having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 214.0217 Permit_ On March 1, 2004, staff from the Fayetteville Regional Office of the Division of Water - Quality responded to a call from your company regarding a waste spill that had occurred on Farm 7572 in Robeson County. The release occurred according to company personnel at around 11:30am that day. Mr. Mehlenbacher was notified about 2:30 pm and called the FRO around 4 :00pm. The farm staff discovered wastewater coming through a crack in the foundation wall outside one of the confinement houses_ Wastewater accumulated outside of the confinement house as efforts were made to correct the problem- Meanwhile the wastewater moved over ground to a drain pipe. It continued through the pipe and into a drainage ditch which outflows into a swamp area. At the time of DWQ staff arriving farm personnel had made a series of three dams in the head of woods and had also plugged the drainage tile. They were pumping wastewater from the dammed locations back into .the lagoon_ Inspector Mark Brantley and 1 walked the edge of a pond that the water from the woods would have drained into if not for the dams and did not see any adverse environmental impacts at that time. He stated company protocol required him to assess the situation before he reported it to DWQ. [n this instance several hours of response time were lost in a situation where expertise in environmental response to such releases could prove critical. The objective of the industry and governmental agencies should be to protect our environmental resources by working together to lessen impacts from unpermitted releases of waste. Discussions with Mr. Mehlenbacher later focused on developing a more effective approach to these commonly occurring releases. The Division of Water Quality requests that the following items be addressed: 1. Provide a detailed description of events and results of any investigation into the spills cause or causes. 2. Provide figures of quantity of waste lost to include method of determination, total gallons released and amount recovered. 3. Detail any prevention, inspection, mechanical, or procedural changes implemented in order to prevent or lessen future occurrences of this nature. 4. Notification to the appropriate regional office should be "as soon as possible" and follow- up notification could be beneficial after you have performed further onsite assessment. We understand that your protocol may influence reporting'but we ask for as immediate notification as possible so as to reduce the time interval between discovery, reporting, and response. Lengthy intervals of this kind may be viewed in a negative manner. 5. Consider training farm personnel in situations which might result in an unpermitted release of waste such as but not limited to plugged or damaged lines. These responses could include blocking of potential waste exit routes as repairs are made to limit waste movement from the immediate area, thus preventing releases to " Waters of the State ". Failure to comply with the above conditions may result in the facility losing its General Permit and being required to obtain an individual non -discharge permit for the facility. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. N. C. The discharge pipe had become blocked causing water in the pit to back up. It rose to a level that allowed it to flow out through a crack in the foundation sidewall. The farm began to "snake" the line to break loose the blockage and were successful. They believed that the spill had not gone but a little way into a ditch along the fence line. They called their Production Manager at 1:30 p.m. to report the spill. The Production Manager immediately called me. I arrived on the scene around 2:15. We discovered that water had spilled into an underground drain line and had begun to enter a drain ditch. We dammed the ditch up and also constructed two darns down stream in case any wastewater got ahead of us. We had our backhoe, four land management staff and three production staff containing the water. A trash pump, hose and PVC pipe was used to pump water back into the farm's lagoon. We estimate that no more than 2-300 gallons had escaped the farm and that all of it was recovered. I notified DWQ at 4:15 p.m. Larry Baxley arrived about an hour later. Rawls DWQ 1t Q Regional Water Quality Supervisor This letter is in response to your request dated 3/9/2004 concerning an NOV for our farm 7572, facility number 78-12 in Robeson County. On March 1 ", 2004 wastewater was found leaking from a foundation crack the farm's breeding barn. This release was found a little before noon. The farm staff immediately began unplugging a clogged drain line that caused a pit to back up. The backup allowed the water to get to a level that found a crack in the foundation. The farm believed that they could handle the problem. Water continued to trickle while the staff unclogged the line. They later became aware that water had gone further than they originally thought. It had reached an underground drain line used for removing surface rain water. The farm contacted their Production Manager and LNM Manager around 2:30 p.m. Water was feared to be heading toward a swamp area along side the farms entrance road, which would then flow into a pond. Three dams were constructed W%head of the flow to insure no wastewater reached the pond. DWQ was notified at 4:00 p.m. and arrived about 5:30 p.m. Water was pumped from the swamp back into the lagoon although it was not determinable how far wastewater had reached. The swamp was still relatively clear of any discernible wastewater. Larry Baxley and Mark Brantley, both with DWQ, walked the edge of a pond and did not see any adverse environmental impacts. The farm staff was reminded that they are to activate the EMS emergency activation plan for any spill of wastewater regardless of how far they think it may have gone. They have also been instructed to locate all access points for rainwater drainage. In the event of future releases they are to dam these points to prevent wastewater from entering. On April 5"' the LNM manager addressed the entire management staff, reminding them that any wastewater spill is required to have immediate notification to their Production Manager and LNM staff. They were also asked to locate all surface water drains and to be prepared to block these in the event their farm would have spill. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
