SUBJECT: NOTICE OF DEFICIENCY

Dear Mr. Jones:
On May 19, 1999, staff from the Fayetteville Regional Office of the Division
of Water Quality inspected the J.D. Farm swine facility. It was observed that the
lagoon dikes were not properly being maintained and portions of the back slopes
contained some erosion. The lagoon marker did not adequately reflect the level
within the lagoon and the lagoon contained substantial amounts of trash (bottles,
syringes, needles, etc.). The General Permit originally issued to this facility on
May 19, 1997 states in condition H.12 that "Lagoons/storage ponds shall be kept
free of foreign debris including, but not limited to tires, bottles, light bulbs,
gloves, syringes or any other solid waste.".
It was noted from the inspection that small grain over seed had been planted
in some of the spray fields. However, according to the Certified Animal Waste
Management Plan (CAWMP) small grain over seed is not part of the cropping
system for the facility. The small grain over seed had been allowed to head out
and had not been removed from the spray fields. It was also observed that the
coastal bermuda was poor to nonexistent in some of the spray fields. General
Permit condition III.4 states that "An analysis of the animal waste shall be
conducted as close to the time of application as practical and at least within 60
days (before or after) of the date of application.". Only one waste sample was
taken in 1998 according to the on-site records. The CAWMP specified that a total
of 72 acres was available for irrigation, however irrigation records indicated that
there was approximately 100 acres being wetted by the irrigation system.

In regard to the deficiencies noted during the inspection, the following actions are requested:
1. Establish vegetation on the back slopes of the lagoon dike to prevent further erosion.
2. Consult with a technical specialist to modify or replace the current lagoon marker in order to
accurately reflect the maximum and minimum liquid level elevations based on the lagoon design.
3. Contact a technical specialist in order to revise the CAWMP to reflect the current crops along
with the specified Plant Available Nitrogen (PAN) rates for each crop.
4. Immediately remove the small grain over seed from the spray fields to prevent damage to the
coastal bermuda. Need to maintain the coastal fields that have recently been resprigged to allow the
coastal to establish.
5. Take a waste sample as close to the date of application as practical but at least 60 days before or
after application.
6. The CAWMP and irrigation records must coincide with one another to accurately reflect the
actual acres in the spray fields.
Please provide a written response to this office on or before June 25, 1999 regarding corrective
actions taken or planned. Nothing in this letter should be taken as absolving this facility of the
responsibility and liability of any violations that have or may result from these deficiencies. If you

Carolina Swine Farms, Inc.

Dear Mr. Jones:
You are hereby notified that Carolina Swine Farms, Inc., which has
been deemed permitted to have a nondischarge permit for an animal waste
disposal system pursuant to 15A NCAC 21-1.0217, has been found to be in
violation of its 2H.0217 Permit.
On April 12, 2000, staff from the Fayetteville Regional Office of the
Division of Water Quality conducted a routine inspection of the Carolina
Swine Farm. The inspection revealed that the small grain overseed had not
been removed on or before the compliance date and the small grain crop was
poor to non-existent in most areas. In addition, waste had been applied
outside of the allowable application windows for the crop and soil samples
had not been collected in the last year. The irrigation records for waste
application were being maintained on one (1) IRR -2 form for both crops.
A referral was submitted to this Division on May 2, 2000, and a
follow-up inspection was conducted on May S, 2000. The inspection
revealed that the waste application fields were not planted in the required
crop and some of the fields had been cut possibly in preparation for the
establishment of the Bermuda crop.

The Division of Water Quality request that the following items are addressed:
1. Immediately remove the small grain overseed if you have not done so already.
2. Review the certified animal waste management plan (CAWMP) to familiarize yourself
with the small grain overseed planting, waste application, and crop removal windows.
3. Begin maintaining waste application records on separate IRR-2 forms for each crop.
4. Collect soil samples annually and implement the recommendations to maximize crop
production.
Failure to comply with the above conditions may result in the facility losing its deemed
permitted status and being required to obtain an individual non -discharge permit for the facility.
Please be advised that this notice does not prevent the Division of Water Quality from
taking enforcement actions for this violation or any past or future violations. Futhermore, the
Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00
per day per violation.
Please provide a written response to this office on or before June 23, 2000, regarding
corrective actions taken.
