Robbins, North Carolina 27325 Subject: NOTICE OF VIOLATION/NOTICE OF INTENT Administrative Code 15A NCAC 2T.1304 NOV-2017-PC-0074 Indian Hills Farm Facility No. 63-8, Permit No. AWS630008 Moore County Dear Mr. Moore, ROY COOPER Governor MICHAEL S. REGAN Secretary S. JAY ZIMMERMAN Director A complaint was received by the NC Division of Water Resources (DWR) on October 13, 2016 about municipal waste application and initially investigated on October 21, 2016 by DWR-Water Quality Regional Operations Section staff. Once it was determined that animal waste was applied, an additional visit was conducted on November 2, 2016 by DWR. Staff inspected spray fields where lagoon sludge was applied from a lagoon cleanout from the above referenced permitted facility. We wish to thank Mr. Tony Moore, who was present and assisted during the site visit. Mr. Moore indicated that he provided the Natural Resource Conservation Office (MRCS) in Moore County with all the information needed to complete a Waste Management Plan to conduct the sludge cleanout in July 2016. The Waste Management Plan was not completed by the NRCS until January 2017. And received by Mr. Moore on January 17, 2017. As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T. 1304, you have been found to be in violation of your permit as follows: Violation 1: Failure to have a Certified Animal Waste Management Plan prior to applying animal waste sludge onto spray fields. (Permit No. AWS630008, AWG10000 Section 1.3 and II. 2). Application records indicated sludge was applied to spray fields on October 17-22 and October 24-25. However, at the time of application, no Waste Plan was completed and on -hand prior to applying waste. All fields where waste is applied must be in the waste plan. Required Corrective Action for Violation 1: If you have not already done so, please provide a Waste Plan for the sludge removal and all applicable records (pumping records, laboratory analyses for the waste/sludge, etc.). The Division of Water Resources requests that, in addition to the specified corrective action above, please submit the following items on or before March 8, 2016. 1. An explanation from the OIC for this farm regarding how this violation occurred. 2. A list from the OIC concerning the steps that will be taken to prevent this violation from occurring in the future. You are required to take any necessary action to correct the above violations on or before March 8, 2017 and to provide a written response to this Notice by March 8, 2017. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.
