You are hereby notified that, having been permitted to have a non -discharge permit for the
subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to
be in violation of your 2H .0217 Permit.
Violation 1: Failure to conduct a sludge survey for 2008 in accordance with your permit,
Section Ill Condition 19.
On March 30-31, 2009, compliance inspections were conducted at your facilities. A review
of your records showed no sludge surveys were done during calendar year 2008 for lagoons
on these farms.
Required Corrective Action for Violation 1:
Conduct a sludge survey of the first lagoon(s) receiving waste for each farm for calendar year
2009, as soon as practicable. Please send copies of the new sludge surveys to the Fayetteville
Regional Office by June 1, 2009.

If any lagoon is in the process of "spring turn over", please delay its survey until it settles. If any
lagoon's sludge depth exceeds its liquid treatment depth, please complete the new survey form,
found on our website at
http://h2o.enr.state.ne.uslaps/afou/Forms.htm under Supplemental Reporting Forms.
Please be advised that this notice does not prevent the Division of Water Quality from taking
enforcement actions for this violation or any past or future violation. Furthermore, the Division
of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per
violation.

Subject: Notice of deficiencies at our Wet Creek facility #63-01, Holly Ridge #63-06,
Deerfield #63-07, Indian Hills #63-08, Dixie #63-03.
Dear Mr. Hasty,
I am writing in regards to the lack of current soil samples for the facilities 63-01,
63-06, 63-07, 63-08. We have taken and sent off samples as of May 16, 2000. When
results of the samples are returned the appropriate applications of lime will be done.
Facility 63-03 needed the rye over seed cut, this was done on May 5, 2000. This
would have been done earlier but weather did not permit such. Freeboard levels are
now being recorded. On May 9, 2000 Jerry Hall and Kevin William installed a
lagoon level marker.

Dear Mr. Purvis:
You are hereby notified that, having been permitted to have a non discharge permit for
the subject animal waste disposal system pursuant to 15A NCAC 214 .0217, you have been
found to be deficient in your 21-1.0217 Permit.
On May 3, 2000, staff from the Fayetteville Regional Office of the Division of Water
Quality conducted an inspection of the Holly Ridge Farm in Moore County. It was observed
that annual soil samples had not been taken.
In regard to the deficiency noted during the inspection, the following actions are
requested:
Take annual soil samples of all fields receiving animal waste and lime accordingly.
Please provide a written response to this office on or before May 22 2000 as to the
actions taken or proposed to be taken to resolve this deficiency. Nothing in this letter should
be taken as absolving this facility of the responsibility and liability of any violations that have
resulted or may result from these deficiencies.

The most prevalent problem surrounding the Holly Ridge
lagoons is erosion. There is moderate erosion on the
outside back slope of the western lagoon, moderate to
severe erosion on the back slope between the lagoons
and on a few areas at the northeast corner of the
eastern lagoon. The diversion that drains water away
from the eastern lagoon is eroding very severely.
CORRECTIVE ACTION NEEDED: Smooth by grading and/or
disking and establish perennial vegetation on all
eroded and/or bare areas. Do not allow trees to grow
on any parts of dam.
Investigation of the backtoe of the western lagoon
revealed a possible seepage problem. Seepage around
the toe of a lagoon can be indicative of structural
integrity problems. This seepage needs to be evaluated
by a professional engineer to see if it is a potential
hazard to the integrity of the dam. According to our
engineering policy we do not evaluate this type of
problem because we did not originally provide design or
construction assistance. Once the engineer has made
his written report to you we need to receive a copy.
This must be done before we can proceed with .0200
certification. I have enclosed a list of professional
engineers who do this type of work and are certified
technical specialist for .0200.

Vegetation on the areas that were not eroding basically
looked fairly good.. However, there were a few places
where it was getting over grown. Brambles and a few
small trees were getting started. CORRECTIVE ACTION
NEEDED: Mow or weed -eat frequently enough to keep
perennial vegetation growing well and small trees or
brambles from getting started. Remove any small trees
that can not be mowed down from the inside and outside
slopes of dams.
