Dunbar 816 West Covington Street Laurinburg, NC 28352 Subject: NOTICE OF VIOLATION Administrative Code 15A NCAC 2H .0217 Hog's Breath Inc., Swine Farm 'Facility No. 47-1 Hoke County Dear Mr. Dunbar: You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 2H.0217 Permit. On April 12, 2000; staff from the Fayetteville Regional Office of the Division of Water Quality conducted an annual inspection of your swine farm located off SRI 118 in Hoke County. During that routine inspection, it was noted that trash piles remained in the newly cleared land around pulls #13 and #14. You were instructed to remove the trash piles to accommodate irrigation and facilitate newly sprigged Coastal Bermuda growth. The Division of Soil and Water conducted a compliance review of the farm'on October 19, 2000 and noted that the trash piles had not been cleared and the Bermuda grass needed to be resprigged. Staff from the Division of Water Quality conducted the 2001 annual inspection for the above referenced swine farm on June 22, 2001. During that inspection, it was noted that the trash piles around pulls #13 and #14 had not been removed as previously instructed. It was also noted that resprigging had not occurred on these pulls as previously instructed. The inspection also revealed little to no Coastal Bermuda stand in pulls #7, #13, and #14 with the dominant vegetative cover being competition weeds. A soil sample had not been submitted for 2000. Submit a timetable for removal of trash piles from the fields in pulls #13 and 914 within a maximum of 60 days. 2. -Submit a timetable for the establishment of the required crop (Bermuda grass) in pulls #7, #13, and #14 within a maximum of 60 days. 3. Submit a copy of the past year of irrigation records for the facility. 4.- :Submit a copy of the certified animal waste management plan (CAWMP). Failure to comply with the above conditions may result in the facility losing its General Permit and being required to obtain an individual non -discharge permit for the facility. Please be advised that this notice does not prevent.the Division of Water -Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. You are hereby notified that the Fayetteville Regional Office of the Division of Water Quality will have no choice but to recommend an enforcement action to the Director of the Division of Water Quality should the appropriate crops not be established as called for in your Certified Animal.Waste Management Plan. - If you have an explanation for this violation that you wish to present, please respond to this office by July 17,2001. The irrigation records available for 1998 and 1999 indicated that the facility only pumped a total of approximately 801,000 gallons in the past 15 months while the facility's anticipated waste generated for the time period is approximately 9,800,000 gallons. It was observed that the certified animal waste management plan (CAWMP) was not on site and that no pump records and no waste analysis were available for review. A letter was issued by the Division of Water Quality requesting additional information on or before April 18, 1997. A fax was received on April 18, 1997 with some of the requested information. A copy of the certified animal waste management plan was submitted with a questionable pump record IRR -1 form. No waste analyses or IRR -2 pump record forms were ever received. The time required for Lhe planned fluid level to be reached (permanent +.temporary storage) may vary due to soil conditions flushing operations, and the amount of fresh Water added to the systam. The designed 6 months temporary storage is an estimated volume based on: 1) waste from animals; 2) excess rainfall after evaporation; and 3) the largest 24 hour (one day) rainfall that occurs on the average of once every 25 years. The volume of waste generated from a given number of animals will be fairly constant throughout the year and from year to year. This estimate is based on 7 inches of excess rainfall whim is equal to or exceeds the highest 6 months excess in a year. The average annual excess rainfall is approximately a inches. Therefore, an averse of 8 inches of excess rainfall will need to be camped each year. T99 25 year rainfall will not be a Factor to consider n an annual pumping cycle, but this storage volume must always be available. Keep vegetation on .the embankment and areas adjacent to the lagoon mowed annually. Vegetation should be fertilized as needed to maintain a vigorous stand. 6. Repair any eroded areas or areas damaged by rodents and e5tabllsh in vegetation. 7.' All surface runoff is to be diverted from the lagoon to stable outlets. 8. Keep a minimum of 25 feet of grass vegetated buffer around waste utilization fields adjacent to perennial streams. Waste will not be applied in open ditches. Do not pump within 200 feet of a residence *or within 100 feet of a well. 9. The Clean Water Act of 1977 prohibits the discharge of pollutants into waters of the United States. At the time of the inspection, no records were available on the farm for a comprehensive review. In order to complete the required annual compliance inspection, the following information must be submitted to the address listed below: .__�A copy of the certified waste management plan. 2. Pumping records for the application of waste since 911196. 3. A copy of the waste analysis report for the most recent lagoon sample. You are requested to submit the above listed information to this office on or before April 18,1997. Please be aware that all swine facilities with a liquid waste collection system designed for a minimum of 250 hogs must have a certified waste management plan on or before December 311, 1997. The district NRCS office, Agriculture Extension office, or the Division of Soil and Water have specialist available to assist you with upgrading of existing facilities and certification.
