It was observed that the small grain overseed crop had not been removed in acordance with the time frames stipulated in your certified animal waste management plan (CAWMP). In addition, the lagoon dikes had saplings on the back slopes that require removal. In regard to the deficiencies noted during the inspection, the following actions are requested: Remove the small grain overseed to prevent the loss of the Bermuda grass stand immediately. Review the memorandum attached to your CAWMP that stipulates the time frames for the establishment, application windows, and the harvesting of the small gain overseed crop to prevent future violations. 2. Cut and remove the saplings on the backslope of the lagoon and maintain the weed and grass at or below knee height to allow inspection for burrowing animals problems and or possible seepage. Please notify this office on or before August 15, 2000 at the address below as to the actions taken or proposed to be taken to resolve this deficiency. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have or may result from these deficiencies. These suggestions are a result of discussions within the NC State University Forage Production Workgroup, a group .comprised of NC State faculty and MRCS agency personnel with expertise with the crops. There are limited documented research responses of some of these practices on the many soils and environments where these crops are currently being grown. The Forage Production Workgroup has taken the available data and used the combined experiences and realistic estimates of key people to come up with suggestions that will allow farmers to incorporate these crops and practices into waste management plans. As data become available to - substantiate or refute these suggestions, the Forage Production Workgroup will make appropriate changes. Bermuda Over -seeded Wah Cereal Rye and Annual Ryegrass Currently two types of `Yyegrass" are being used for winter overseeding in fields used for animal waste management. Cereal rve is a winter annual smallgrain that looks similar to wheat, barley and oats. dual ryearass is a winter annual grass that looks aarcb like tall fescue. Both of these grasses, when growing during the winter on bermuda sod, can have significant impact on subsequent bermuda yields. In effect, the total yields. from an awe growing the combination of bermuda with these winter annuals will usually yield between 1-2 tons more per acre than bermuda growing alone for the year. Therefore, the total amount of PAN /acre for the year is about 100 Is more than for bermuda alone. Although cereal rye and annual ryegrass are suitable crops for overseeding, the management of the crops are different and thus practices implemented are dependent on the crop selected. The most consistent stands are obtained from drilling rye into short (less than 3 inches tall) bermudagrass sod If drilling is not possible, the seeds may be broadcast on short Bermuda sod followed by a light cultivation with a disc or tillage implement. The seeding rate for broadcast planting of seeds should be 1.5 times the rate for drilled seeds. The last application of animal waste is to be applied to the bermuda prior to August 31. An application of 501bslacre of Plant Available N (PAN) may be applied between September 15 and October 30. An additional 50 lbs/acre of PAN may be applied in February -March. If rye growth is harvested on time and does not significantly shade the bermuda, PAN -rates for the subsequent bermuda crop are based on realistic yields of bermuda. A harvest is required prior to heading or April 7, which ever comes first. This is necessary to minimize the potential for shading bermuda and reducing its yields. The PAN rate for grazed systems with bermuda ovetseeded with careal rye must be reduced in accordance with NRCS Technical Standard #590. Annual Ryegrass Annual ryegrass should be planted by October 15 to provide the best opportunity to get winter growth. The most consistent stands are obtained from drilling ryegrass into short (less than 3 inches tall) bermudagrass sod. If drilling is not possible, the seeds may be broadcast on short bermuda sod followed by alight cultivation with a disc or tillage implement. If additional PAN is applied to the tyegrass in April -May, the PAN rate for the bermuda must be reduced by a corresponding amount. This is necessary because ryegrass growth during April -May will reduce bermuda yields and shorten the time bermuda can fully utilize the N. A harvest is required by heading or April 7, which ever comes first to prevent shading of emerging bermuda during April -May period. To favor the production of the bermuda, additional harvests of ryegrass will be required when the ryegrass canopy reaches 12 to 15 inches height. The PAN rate for grazed systems with bermuda overseeded with annual ryegrass_.must be reduced in accordance with NRCS Technical Standard #590. On June 8, 2001, staff from the Fayetteville Regional Office of the Division of Water Quality performed an annual review of the Slippery Rock Farm in Harnett County. The review revealed that over application of nitrogen had occurred on pull #1 by 15 pounds per acre and outside the approved windows for application under the 100 pound rate plan for small grain overseed. It was also noted that over application occurred on pull 1-43 by 69 pounds per acre under the same circumstances. These are violations of your Certified Animal Waste Management Plan. The Division of Water Quality requests that the following item(s) be addressed: 1. Avoid over application of nitrogen either agronomically or hydraulically. 2. Provide this office with a copy of the irrigation records for the past twelve months. 3. I applied more effluent to finish the fourth cutting we normally get. I do understand I went past your recommended date of September 1 for applying effluent. However from a page of our animal waste utilization plan the dates are April thru September. As a graduate of North Carolina State University and under the direction of Dr. James T. Greene, he emphasized there is a window of application not a site specific date. He also wrote the recommendations for DENR on animal waste application. This window is based on temperature, soil moisture, crop moisture and crop maturity,to mention a few elements. Considering the above circumstances I ask for a non -penalty charge. This is the first problem I have incurred and I assure you we have not intentionally over applied. On June 7, 2002, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an inspection of the above referenced facility in response to a public complaint. During the inspection, it was noted that the waste application field had a weak to nonexistent coastal bermuda grass stand. This is in violation of your General Permit which Section I1.2 states, "A vegetative cover shall be maintained on all land application fields and buffers in accordance with the CAWMP." It was also noted that the lagoon banks were overgrown and not accessible for inspection. This is in violation of your General Permit which Section 11.10 states, "A protective vegetative cover shall be established and maintained on all lagoon/storage pond embankments (outside toe of embankment to maximum pumping elevation), berms, pipe runs, and surface water diversions. Trees, shrubs, and other woody vegetation shall be removed in accordance with good engineering practices. Lagoon/waste storage pond areas shall be accessible, and vegetation shall be kept mowed." The complaint concerned the stand of )ermuda grass in the application fields and the overgrowth of the lagoon dikes. Upon review of the farm, it was found that the bermuda ;rass was nonexistant in the spray fields. The lagoon dikes were overgrown with large weeds (poke weed, blackberries) and several small rees (gums, pines). Mr. Craig was contacted by telephone and informed ofthe findings. He was informed that the bermuda fields would Lave to be resprigged either ASAP or next spring.
