You are hereby notified that, having been permitted to have a non discharge permit for the subject animal
waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 214
.0217 Permit.
On January 26, 2001, staff from the Fayetteville Regional Office of the Division of Water Quality
performed an inspection of the Dogwood S-6 Farm located in Harnett County. The inspection revealed that
the freeboard level of the lagoon was sixteen inches which is less than the minimum required in the General
Permit for this facility. The General Permit condition M.6.e. states: " The Permittee shall report by telephone
to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first
knowledge of the occurrence of any of the following events: e. Failure to maintain storage capacity in a
lagooti/storage pond greater than or equal to that required in Condition V(3) of this General Permit."
The Division of Water Quality requests that the following item(s) be addressed:
1. Lower the lagoon to the designed freeboard, weather permitting.
Failure to comply with the above conditions may result in the facility losing its General Permit and being
required to obtain an individual non discharge permit for the facility.
Please be advised that the Division of Water Quality is sending this to the Director for consideration of
enforcement for this violation. Furthermore, the Division of Water Quality has the authority to levy a civil
penalty of not more than $25,000.00 per day per violation.

You are hereby notified that, having been permitted to have a non discharge permit for the subject animal
waste disposal system pursuant to 15A NCAC 2H.0217, you have been found to be in violation of your 2H .0217
Permit.
On January 9, 2002, the Fayetteville Regional Office of the Division of Water Quality received written
notification from Premium Standard Farris indicating incidences of PAN rate overapplication for the 2001-2002
winter pumping season. The review of this notification revealed that the PAN rate for the 2001 winter crop had
been exceeded by 2 pounds, per the CAWMP for this facility, in Zone L. This is a violation of the General Permit
issued to this facility under Section II., Operation and Maintenance Requirements, Number 4., which states: "Land
application rates shall be in accordance with the CAWMP. In no case shall land application rates exceed the Plant
Available Nitrogen rate for the receiving crop or result in runoff during any given application."
The Division of Water Quality requests that the following item(s) be addressed:
1. Avoid overapplication of nitrogen either agronomically or hydraulically.
Failure to comply with the above conditions may result in the facility losing its General Permit and being
required to obtain an individual non -discharge permit for the facility.
Please be_advised that this notice does not prevent the Division of Water Quality from taking enforcement
actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the
authorityto levy a civil penalty of not more than $25,000.00 per day per violation.

Event Description: Commercial Hog Farm owner called to report a hog waste spill of an unknown amount from
barn into a nearby irrigation field. The owner advised that the spill originated from S-6 bam location 43-7. Owner and
employees walked the perimeter and checked the ditches/ streams next to the farm and found no signs of any of the
waste product reaching the waterways. Caller will immediately call local DENR office to report the

Dear Sir:
On January 27, 2000, you or staff from your farm notified the Fayetteville Regional Office
of the Division of Water Quality, as required by General Permit condition 111.6.e, that the freeboard
level of the lagoon was less than the minimum required by the General Permit. The liquid level of
the lagoon was reported as 17 inches. General Permit condition V.3 states that "The maximum
waste level in lagoons/storage ponds shall not exceed that specified in the CAWMP. At a
minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides
adequate storage to contain the 25 -year, 24-hour storm event plus as additional 1 foot of structural
freeboard.",
The Division of Water Quality will take no further action for this reported incident at this
time. However, you are asked to please notify this office in writing within 15 days of receipt of this
letter as to what date the lagoon was lowered to the required freeboard level. This information is
essential in determining if the lagoon was lowered within the specified time frame in which the Plan
of Action (POA) allotted. It will also close this event out within your file. If you have any questions

This letter is in reference to the Notice of Deficiency that was issued to Dogwood Farms
S-6 on May 27, 2000. The Notice of Deficiency makes reference to the irrigation records
being kept by field rather than by pull, and it also makes reference to there being a poor
stand of coastal bermudagrass in some of the spray fields.
We are in the process of changing the irrigation system that we will be using at Dogwood
S-6. When this system has been completely installed, we will have a system that we can
keep the records correctly by effectively wetted zones or pulls.
If there is anything else that I can do to assist you please feel free to contact me as soon as
possible. Thank you for your assistance in this matter.

On May 15, 2000, staff from the Fayetteville Regional Office of the
Division of Water Quality inspected the Dogwood Swine Facility S-6. It
was observed that the irrigation records are being maintained by field rather
than by acres in the wetted area (pull) which suggest that a shortage of
wetted acres exist. In addition, the Bermuda grass had a poor stand in some
areas of the waste application fields.
In regard to the deficiency noted during the inspection, the following
actions are requested:
1. Maintain waste application records by pull on separate IRR -2 forms
for each crop. Be prepared to conduct a wetted acres determination
in the near future.
2. Evaluate the bermuda grass crop in all waste application field§ and
work to improve the stand either through weed and harvest
management or by resprigging if necessary.
Please notify this office on or before June 25, 2000 at the address below
as to the actions taken or proposed to be taken to resolve this deficiency.
Nothing in this letter should be taken as absolving this facility of the
responsibility and liability of any violations that have or may result from
these deficiencies.

This letter is in response of the notice of deficiency that was given to Dogwood Farms
S-6 (facility # 43-07}. The Plan of Action that was presented to NCDENR-DWQ on
February 4, stated that we had 30 days to lower the lagoon level to a level that was greater
than the one foot Freeboard plus a 25 year 24 hour storm (19"). The date that we reached
the goal of the plan of action was March 2, 2000.

You are hereby notified that, having been permitted to have a non discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2H
.0217, you have been found to be in violation of your 2H.0217 Permit.
On February 3, 1999, staff from the Fayetteville Regional Office of the
Division of Water Quality inspected the Three B Farms swine facility. This office
was informed on January 26, that the lagoon level was around 19 inches, therefore
a routine inspection was performed at the site. It was observed that the lagoon
contained only 17 inches of freeboard at the time of the inspection. Some of the
irrigation fields contained low areas with standing storm water. The crops in these
areas were poor to nonexistent. The Certified Animal Waste Management Plan
states that the fields are to be sprigged in coastal bermuda with a small grain over
seed for winter application. The facility failed to have an adequate, gauged marker
according to the General Permit issued to this facility on July 14, 1997. General
Permit condition III.2 states that "If not already installed at this facility, a waste -
level gauge to monitor waste levels shall be installed within 60 days of issuance of
the COC under this general permit. This gauge shall have readily visible permanent
markings indicating the maximum liquid level at the top of the temporary liquid
storage volume, minimum liquid level at the bottom of the temporary liquid storage
volume; top of dam elevations.". The marker did not accurately reflect these levels
according to representatives from Carroll's Foods which accurately determined the
freeboard level of the lagoon through the use of a transit on the day of the
inspection.

This is to advise you that an inspection was conducted of your swine farm on February
7, 1996. The inspection revealed that no permanent cover crop has been established as of yet
which is in clearly not in accordance with your Certified Waste Management Plan (CWMP)
which is a violation of Title 15A of the North Carolina Administrative Code, Chapter 2,
Subchapter 2H, Section .0217(d).
It has been noted that your CWMP plainly states that your farm will need 44 acres of
coastal Bermuda grass on which to land apply waste and your lagoon is designed to have
approximately 6 months of storage if managed properly. This plan was signed and dated April
2, 1994 which would then allow you up to 6 months to clear the land and establish a cover crop
and begin spraying. Otherwise, the storage capacity of the lagoon will be exceeded and the
lagoon dam integrity will subsequently be compromised. It was earlier observed that a breach
in the lagoon lining allowed waste water to escape via an underground vein that discharged on
to a down gradient field. However, this discharge of waste was quickly controlled by creating
a small "containment pool" and the breach was later repaired. In addition, a previous inspection
revealed that waste from the above mentioned lagoon was being pumped to a new lagoon for
another new farm in order to charge it. This action was noted to lower the old lagoon level and
thereby obtain the necessary 1 foot of freeboard and the 25 year 24 hour storm event storage
capacity on the date of inspection. Therefore, it is recognized that while the new lagoon will

The facility failed to have a copy of:the General Permit,"Certificate of Coverage, and a soil
report for the crop year 1998 on the farm for review. This is required by General Permit condition
I.4 which states that "a copy of this General Permit, COC, certification forms, lessee and landowner
agreements, and the CAWMP shall be readily available at the.farm (stored at places such as the farm
residence, office, outbuildings, etc) where animal waste management activities are being conducted
for the life of this permit. These documents shall be kept in good -condition and records shall be
maintained in an orderly fashion.
The facility was also in violation of the CAWMP. The CAWMP had been updated to.include
the 100 lbs/acre of plant available nitrogen (PAN) on the small grain over seed. 'However, only an
application of 50 lbs/acre of PAN could be applied between September 15 and October 30, and
another additional 50 lbs/acre could be applied starting in February through March. The facility
applied wastewater in January, which clearly violates the time frames defined in the CAWMP.
The Division of Water Quality requests that -the following items be performed:
1. Lower the lagoon level to the required freeboard on a suitable waste application field as soon'as
weather permits and per the CAWMP.
2. Consult'with a technical specialist or the local NRCS district for assistance in correcting the low
areas in the waste application fields in order to establish a crop so that these areas can be utilized for
waste application on a more routine basis.
3. Consult with a technical specialist•to modify or replace the current lagoon marker in order to
accurately reflect.the low point of the lagoon dike and the maximum and minimum liquid level
elevations based on the lagoon design. I I _
4. Please provide specific actions proposed to prevent,future freeboard deficiencies at this facility,
to maintain compliance with the CAWMP or the General Permit.
5. Adhere to all of the General .Permit conditions and application windows determined by the
CAWMP. .
6. Provide a detailed explanation as to why the lagoons had reached such high levels.
Failure to comply with the above conditions may result in the facility's. General Permit being
revoked and being required to -obtain an individual non -discharge permit for the facility.
Please be advised that this notice does not prevent the Division of Water Quality from taking
enforcement actions for this violation or any past or future violation. Furthermore, the Division of
Water Quality has the authority to levy a civil penalty of not -more than'$10,000 per day per
violation.

provide you with a way to keep the old lagoon level in compliance, a cover crop should have
been established for spraying purposes as the new lagoon will fill up with waste from the old
lagoon and the waste generated by the new farm. Furthermore, it is clear that a winter cover
crop has not been established as was recommended in a previous correspondence and it is again
strongly suggested that one be established in the future so as to avoid potential excessively high
lagoon levels in the winter months. This office is also aware that recent wet weather and the
lagoon seepage has hampered efforts to establish a winter cover crop. Nevertheless, it is obvious
that a permanent crop of bermuda was not established and the CWMP was not followed.
Consequently, the purpose of this letter is to advise, you (1) To immediately begin'
establishing a permanent crop of coastal bermuda as your CWMP states, (2) To warn you that
it is a violation of North Carolina General Statutes to discharge to the surface waters of the State
without a permit. The Division of Environmental Management has the authority to levy a civil
penalty of not more than $10,000.00 per day per violation and failure to comply with these rules
can result in civil and/or criminal penalties or the facility may be required to apply for an
individual nondischarge permit.
It is requested that you forward to this office, at the address on the bottom of the previous
page, on or before March 25, 1996 a written statement indicating by what date you will have a
cover crop established and what actions you have taken to comply with CWMp. It is strongly
recommended that you contact Mr. Parks Blake at (910) 893-7584 for advice concerning this
matter.
It is also recommended that you contact this ofce upon receipt of this letter if you have

This letter is in response to the Notice of Violation dated on March 1, 1999, as you know
we are selling the farms to Dogwood Farms, a division of Lundy's Packing Company. The
sale of all swine facilities will take place on or before March 18, 1999, As per the terms of
the offer to purchase agreement we entered into with Dogwood Farms, we are currently
having the wetable acres determination done and will continue to work with Dogwood
Farms to ensure that the farms comply with CAWMP regulations following the closing.
This should take care of any faults in the current design and bring the design up to the new
wetable acres standards. We have purchased an additional 10 acres of land adjacent to the
upper field and are currently obtaining quotes for the timber and clearing of this tract. This
tract will add 7 acres of additional spray.field to the existing plan and there are two other
areas that will be clearfd to give another 3 acres of spray field. This should give us more
than enough acres of spray field to handle the annual output from this farm. Carroll's
Foods has already started depopulating this farm and will have the remainder of their
animals of site on Marph 25, 1999,
Item 1: We are currently working to lower the lagoon at this utilizing CAWMP guidelines
and application windows as weather permits.
Item 2: As stated above, we are currently working with representatives from Dogwood
Farms, MRCS and a P.E. contracted by both parties to ensure that the farms comply with
the wetable acres requirements and that the fields have adequate cover crops.
Item 3: Will work with Dogwood Farms and NRCS to modify our current lagoon markers
to more accurately indicate freeboard levels.
Item 4: Will work with Dogwood Farms until the lagoon has the minimum of 19 inches of
freeboard at which time Dogwood Farms will take over the waste management of this
site. After Dogwood Farms takes over the waste management of this site we can't offer
any assurances for any future deficiencies.
Item 5: We are adhering to all conditions of the General Permit and application windows
of the CAWMP
Item 6: The lagoon levels were 2 to 3 inches below the best management marker at the
end of October when we stopped applying waste to our fields, in accordance with
CAWMP. Due to seasonal rains and not being able to spray until February 1, 1999, we
had an increase in our lagoon level to the 17 inches you indicated in your report.

This letter is being sent in response to a Notice of Deficiency letter issued by your office on the
above mentioned facility managed by Murphy Brown, LLC.
As noted in an e-mail, the lagoon level was self reported on February 10, 2010 as being out of
compliance and a 30 day Plan of Action was submitted to your office. The lagoon 67061 (S6 Sow
Farm) was pumped down to the lowest level of 49" on August 21, 2010, which was 4" below stop
pump. From August 21" until the lagoon was reported out of compliance on February 10th, our rainfall
total was 29.9". This facility was impacted by chronic rainfall which saturated application fields. These
conditions did not allow us to land apply in accordance with permit conditions for an extended period of
time. Instead of land applying in a manner that would have possibly caused there to be ponding or
runoff, we stored the excess rainfall in our lagoon system. As soon as the weather and field conditions
allowed, land irrigation resumed. This facility's freeboard was back in compliance on 2/19/2010, only
being out of compliance for a total of 10 days and reported in E-mail format to DWQ on 31812010.
As of today, October 15, 2010, current lagoon level of 67061 is 46", which is .4" below stop
pump.

On February 10, 2010, the staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section
(APS), were notified by Mike Cudd of a high freeboard level in one or more of the facilities lagoons.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1300, you have been
found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine
Waste System General Permit No. AWG 100000 as follows:
Deficiency 1:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's CAWMP
in accordance with Condition V. 2. Of Swine waste System General Permit No. AWG 100000,
On February 10, 2010, a lagoon/storage pond level was documented at 20 inches of freeboard. A level of
20 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan.
Continue to follow the proposed actions outlined in your flan of Action (POA) submitted to the
Fayetteville Regional Office. Take all necessary additional steps to insure lagoon levels remain in
compliance with Section (2) of your permit.

If you have. not already done so, provide a written response to this Notice of Deficiency once lagoon
levels are back in compliance.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to
the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that
twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance
with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.
