Howes, Secretary G Andrew McCall, Reglonal Manager DIVISION OF ENVIRONMENTAL MANAGEMENT Water Quality Section September 22, 1995 Mr. Randy Hamilton Hamilton Swine Farm Route 4, Box 687 Dunn, N.C. 28334 SUBJECT: NOTICE OF VIOLATION Unpermitted Discharge of Swine Waste Hamilton Swine Farm SR 1778 Harnett County Dear Mr. Hamilton: On the night of July 29, 1995 as a result of a citizens complaint an inspection was conducted of your animal operation by the Fayetteville Regional Office. The complaint alleged and the inspection confirmed that swine waste had entered an Unnamed Tributary (UT) to the Cape Fear River, Class WS -V. Please be aware it is a violation of North Carolina General Statutes to discharge wastewater to the surface waters of the State without a permit. The Division of Environmental Management has the authority to levy a civil penalty of not more than $10,000 per day per violation. The investigation further revealed that the waste had entered the UT in part due to the following: 1. The manner in which the waste was land applied. 2. A brief rainstorm event (The event was noted to be less intensive than a 25 year 24 hour storm event). The purpose of this letter is to advise you, (1) To take all necessary corrective actions to prevent similar discharges in the future. You are strongly urged ed to contact Parks Blake, District Conservationist with NRCS at (910) 893-7584 or other appropriatc persons to obtain technical guidance in order to receive a certified waste management plan. 1 You are asked to- contact this office in writing on or before October 1, 1995 as to the steps taken to prevent similar discharges in the, future.
