Howes, Secretary EDEHNR DIVISION OF WATER QUALITY September 9, 1997 CERTIFIED MAU, TT REcErLPT REQUESTED Mr. Ricky Smith Route 1, Box 36 Roseboro, NC 28382 SUBJECT: NOTICE OF DEFICIENCY Ricky Smith Nursery Farm Registration No. 26-12 Cumberland County Dear Mr. Smith: On August 27, 1997, staff from the Fayetteville Regional Office of the Division of Water Quality inspected the Ricky Smith Nursery swine facility. It was observed that the facility did not have the correct crop planted in the waste application field. The lagoon was near the emergency storage level (21 inches) according to the lagoon marker and the lagoon dikes needed a cover grass established in several areas. In regard to the deficiencies noted during the inspection, the following actions are requested: I . Consult with a technical specialist for assistance in regard to establishing a cover grass on the lagoon dikes and establishing the appropriate crop in the waste application field in order to allow irrigation to commence to prevent a problem resulting from the lagoon level rising into the emergency storage zone. 2. The IRR -2 form needs to conform to the CAWMP in terms of the field numbers and the acreage in the field. Additionally, a map illustrating the hydrant location and pulls is needed to insure that the entire acreage in the field is receiving waste equally. Each pull will require a separate IRR -2 record. Please notify this office on or before October 8, 1997 at the address below as to the actions taken or proposed to be taken to resolve this deficiency. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have or may result from these deficiencies. It was observed that the appropriate waste samples were not used in calculating the plant available nitrogen (PAN) applied to the crop. In addition, the fescue pasture has a problem with weeds (primarily dogfennel). In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Begin immediately using the appropriate waste samples for the lagoon in which the waste was pumped and within 60 days of waste application. 2. Consult with a technical specialist in regard to the weed problem in the fescue waste application field. Easley, Governor William G. Ross Jr., Secretary North Carolina Department of Environment and Natural Resources Coleen H. Sullins, Director Division of Water Quality You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T.1300, you have been found to be in violation of your 2T.1300 permit. Violation 1: Failure to complete irrigation equipment calibration and sludge survey: (Permit No. AWS820436, Section II condition 24 and Section III condition 18, respectively.) On May 23,2007 a routine compliance inspection of your facility showed no equipment calibration or sludge survey had been performed as required by the Permit. Required Corrective Action for Violation 1: Equipment calibration and sludge survey must be completed by July 31, 2007. If you need assistance with this matter, let us know in a response to this letter. Failing to perform the above corrective action may result in enforcement action.
