You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste
disposal system pursuant to 15A NCAC 2T. 1300, you have been found to be in violation of your 2T .1300 Permit
Violation 1: Failure to maintain waste levels in your waste structure(s) in accordance with
the facility Certified Animal Waste Management Plan. (Permit AWS090000, Section V 2.)
On 11/22/2006 a waste structure liquid level was documented at 17 inches of freeboard at lagoon 1. A level of 19
inches is the maximum level allowed by your permit. Subsequent to the reported high freeboard the Division of
Water Quality requested record documentation to assess the overall management of the waste system.
Correct application of Plant Available Nitrogen (PAN) is a major component of your nutrient management plan.
According to a review of your -records, only about 21 % of your PAN was applied during 2006-2007 complete crop
cycle. Inadequate management of the nutrient management plan contributed to high lagoon levels, compounded by
high rainfalls.
Required Corrective Action for Violation 1:
At this time, the incident is closed. The Division strongly recommends that you review your facilities and procedures
with the goal of eliminating future high freeboards, which could lead to mandatory review of your Waste Utilization
Plan by a Technical Specialist, Notices of Violation or civil penalties in the future if freeboard noncompliance
remains an issue.
If you are not aware, you now may pump up to eight (8) inches below the "Stop Pump" mark between June 15 and
October 31 provided that the criteria in NRCS Standard for Waste Treatment Lagoon No. 359 are met.

Odum Nursery Swine Farm

Dear Mr. Odum:
On April 23, 1998, staff from the Fayetteville Regional Office of the
Division of Water Quality inspected the Odum swine nursery facility. It was
observed during.the annual inspection of the facility that a suitable cover
grass needs to be established on the inside slopes of lagoon dikes down to
the pump on level, that the bermuda grass was poor to non-existent in the
pastures and that the pump records were incomplete and the operator in
charge was different from the registered person for the farm.
The Division requests that the following items be addressed at the
facility:
1. Establish a suitable cover grass on the inside slopes of the lagoon dikes
and bare spots. Consult with a technical specialist for assistance.
2. Establish the required crops in the specified fields as outlined in the
certified animal waste management plan (CAWMP).
3. The pump records indicate that the operator in charge (Darrell Coble)
is not the registered operator for the facility. Consult with a technical
specialist for the appropriate forms for changing the operator in charge
designation and for the third party form for a contract pumper. -

4. Consult with a technical specialist concerning maintaining waste application records in
accordance with the CAWMP by fields or pulls and by crops.
Please submit a written response on or before June 4, 1998 as to the actions taken or
proposed to be taken to resolve this deficiency. Nothing in this letter should be taken as
absolving this facility of the responsibility and liability of any violations that have or may result

ONE INCH BETWEEN THE THUMB AND INDEX FINGER, THE MURPHY

4. THE LAGOON IS BEING PLACED IN A AREA WITH THE WATER TABLE

4. THE LAGOON IS BEING PLACED IN A AREA WITH THE WATER TABLE
