Barnhardt, Fayetteville Regional Office Supervisor Robert Marble — Washington Regional Office Date: December 16, 2008 Re: Remission Request for Wayne Smith / Wayne and Susan Smith Farm Enforcement Case PC-2008-0073 SUMMARY A civil penalty of $3381.83 was assessed against Wayne Smith for failing to properly operate and maintain equipment and spray fields at all times, by applying animal waste to a wooded area not included in the CAWMP, and by failing to prevent excessive ponding and runoff. CASE BACKGROUND April 30, 2008 -Inspection On April 30, 2008, during routine flight operations, DWQ personnel observed animal waste being applied outside the limits of the spray field at the facility at approximately 11.00 am. The spray gun was at the end of the field and spraying waste into the wooded area beyond the limits of the spray field. DWQ personnel arrived on site at approximately 12:30 pm to conduct an investigation. The spray gun was still located in the same spot as seen from the air. Animal waste was still -being applied into the trees off of the spray field. Animal waste was ponded in several locations off of the spray field. Upon arrival, DWQ personnel observed the reel not moving and found the motor was not on. There was no evidence of repair work or maintenance on the reel at the time DWQ arrived on site. Based on the lagoon records and current lagoon levels the estimated volume of lagoon effluent was 35,926 gallons. April 30, 2008 - Sampling Sample ware taken from point of discharge for nitrogen, phosphorus, fecal coliform and BOD analyses. Lab results shown below. September 2 2008 — Assessment of Civil Penalties A civil penalty of $3381,83 including $881.83 in investigative costs was issued to Wayne Smith for: Applying Waste to a wood area ......................................... $2,500.00 Enforcement Costs. .......................................................... . $883.81 Total Civil Penalty............................................................$3383.81 September 24, 2008 — Justification For Remission Regest All of the five factors were checked on the Justification form, and did provide a written response: Kraig Westerbeek from Murphy -Brown LLC on behalf of Wayne Smith responded to the civil penalty assessment, saying that the discharge was accidental whereby the gun cart was pulled to a position too close to the wood area, and the retrieval mechanism on the reel malfunctioned. He also stated that the irrigation reel was repaired to insure proper retrieval of sprayer. See the 9/24/08 remission request for more details. Mr. Smith is a contract grower for Murphy Brown. In most cases, I simply advise our growers when they are preparing correspondence responding to these sorts of issues. However, after reviewing the Division's assessment in this case, and after conversation with Mr. Smith, I was compelled to write this response based on our opinion that the fine amount seems excessive compared to the impact on the environment. In addition, it does not appear that the stellar compliance history of this producer was considered in the assessment process. The facts of the case are not in dispute. On April 30, 2008, Mr. Smith performed an irrigation event that allowed a small amount of wastewater to be applied to a wooded area adjacent to his spray field. The wastewater applied never left the property, nor entered state or federal waters, but was contained and absorbed in a forested area owned by Mr. Smith. The overspray was not planned, and was clearly inadvertent, or a result of an accident as described in item 2. (3) of the assessment notice. Mr. Smith takes great care to prevent such incidents from occurring. However, in this case, the gun cart was pulled to a position too close to the wooded area, and the retrieval mechanism on the reel malfunctioned, allowing it to remain in that position for an undesired period of time. Upon being made aware of the issue by Division staff, Mr. Smith immediately halted application activities. I believe it is clear that the violator in this case promptly abated continuing environmental damage resulting from the violation as described in item 2. (2) of the assessment notice. In response to the accidental discharge, the farm owner took the initiative to make needed repairs to the irrigation equipment used on the farm. The irrigation reel has been repaired to insure that proper retrieval rates are achieved, and contacted an irrigation specialist to mark end of pull stops for each pull. The fine amount of $3,381 for a farm this size is significant. There is no doubt that payment of this fine will prevent Mr. Smith from considering additional capitol and/or R&M improvements on this farm in the coming year. On behalf of Mr. Smith, I ask that the Division reconsider the amount of the fine imposed in this case based on the information above. D. Condition No. Il. 2 the General Permit states in part "No waste shall be applied upon areas not included in the CAWMP." E. Condition No. 11.4 of the General Permit states in part that "land application rates shall be in accordance with the CAWMP. In no case shall land application rates exceed the agronomic rate of the nutrient of concern for the receiving crop. In no case shall land application rates result in excessive ponding or any runoff during any given application event." F. On April 30, 2008 DWQ staff from the Fayetteville Regional Office conducted aerial surveillance and observed animal waste being applied outside the limits of the spray field on the Wayne and Susan Smith Farm. DWQ staff conducted a site visit immediately and confirmed that animal waste still -being applied into a wooded area beyond the limits of spray field established -by the CAWNIP. The spray gun was still located in the same spot as seen from the air. Animal waste was ponded in several locations off of the spray field. G. Wayne Smith does not have a permit for the above described activities. H. The costs to the State of the enforcement procedures in this matter totaled $881.83. Based upon the above Findings of Fact, I make the following: H. CONCLUSIONS OF LAW. Wayne Smith is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). J. A permit for an animal waste management system is required by G.S. 143-215.1. K. The above -cited failure to properly operate and maintain the land application equipment and fields violated Condition No. 11. 1. of the State General Permit. L. The above -cited failure to apply animal waste in accordance with the facility's Permit as specified in the CAWMP violated Condition No. 11.2, and II_4 of the General Permit. M. Mr. Smith is a contract grower for Murphy -Brown. In most cases, I simply advise our growers when they are preparing correspondence responding to these sorts of issues. However, after reviewing the Division's assessment in this case, and after conversation with Mr. Smith, I was compelled to write this response based on our opinion that the fine amount seems excessive compared to the impact on the environment. In addition, it does not appear that the stellar compliance history of this producer was considered in the assessment process. The facts of the case are not in dispute. On April 30, 2008, Mr. Smith performed an irrigation event that allowed a small amount of wastewater to be applied to a wooded area adjacent to his spray field. The wastewater applied never left the property, nor entered state or federal waters, but was contained and absorbed in a forested area owned by Mr. Smith. The overspray was not planned, and was clearly inadvertent, or a result of an accident as described in item 2. (3) of the assessment notice. Mr. Smith takes great care to prevent such incidents from occurring. However, in this Case, the gun cart was pulled to a position too close to the wooded area, and the retrieval mechanism on the reel malfimctioned, allowing it to remain in that position for an undesired period of time. Upon being made aware of the issue by Division staff, Mr. Smith immediately halted application activities. I believe it is clear that the violator in this case promptly abated continuing environmental damage resulting from the violation as described in item 2. (2) of the assessment notice. In response to the accidental discharge, the farm owner took the initiative to make needed repairs to the irrigation equipment used on the farm. The irrigation reel has been repaired to insure that proper retrieval rates are achieved, and contacted an irrigation specialist to mark end of pull stops for each pull. The fine amount of $3,381 for a farm this size is significant. There is no doubt that payment of this fine will prevent Mr. Smith from considering additional capitol and/or R&M improvements on this farm in the coming year. Director Division of Water Quality On March 7, 2008, you or an employee of your farm notified the Fayetteville Regional Office Division of Water Quality, as required by the Swine Waste Management General Permit AWG100000 Section III 13(c), that the freeboard level of the lagoon was 26 inches, which is less than the 27 inch minimum required for your farm. The General Permit, Section V 2, states "The maximum waste level in lagoons/storage ponds shall not exceed that specified in the facility's CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional one (1) foot of structural freeboard. We appreciate your cooperation in self -reporting high freeboards, pumping down your lagoon, and malting your records available. Please bear in mind that high freeboards must be reported by phone, email, fax, or personal contact within 24 hours. Plans of Action (POAs) must be fled within 24 hours for structural and 48 hours for storm storage high freeboards. They EXPIRE after five (5) days for structural and thirty (30) days for storage high freeboards. At that time, the situation should be resolved or, upon request, the Division may grant extensions for adverse conditions. Required Corrective Action: At this time, the incident is closed. The Division strongly recommends that you review your facilities and procedures with the goal of eliminating future high freeboards, which could lead to mandatory review of your Waste Utilization Plan by a Technical Specialist, Notices of Violation, or civil penalties, if freeboard noncompliance remains an issue due to waste plan or system design problems. If this is a Farrow to Wean or Farrow to Feeder operation, there may also be one boar for each 15 sows. Where boars are unneccessary, they may be replaced by an equivalent number of sows. Any of the sows may be replaced by gilts at a rate of 4 gilts for every 3 sows The COC shall be effective from the date of issuance until September 30, 2009. Pursuant to this COC, you are authorized and required to operate the system in conformity with the conditions and limitations as specified in the General Permit, the facility's CAWMP, and this COC. An adequate system for collecting and maintaining the required monitoring data and operational information must be established for this facility. Any increase in waste production greater than the certified design capacity or increase in number of animals authorized by this COC (as provided above) will require a modification to the CAWMP and this COC and must be completed prior to actual increase in either wastewater flow or number of animals. From 1997 to 1999, we operated with a lagoon marker that was set for 19 inches of freeboard. In 1999, the inspector began to question the lagoon markers against the design. In April of 2002, Brown's of Carolina finally installed new markers with heavy rainfall factor. On March 7, 2004, we had a severe windstorm which completely removed the top of our office at the hog houses. This office stores our water tanks, pumps, and meditators for our hogs. We took on the job ourselves of rebuilding which proved to be too much as this was also the time of the year to spray in addition to working a full time job elsewhere. But the main mistake was that we were still under the impression that we were to call DWQ at 19 inches but we now know that it is 27 inches and in the future when we call, we should talk to a person and not a recording. Now that we are aware of having to call at 27 inches instead of 19 inches this problem should not arise again. Lagoon is in good shape at this time.
