Dear Mr. Gillespie:
On July 9, 1998, staff from the Fayetteville Regional Office of the Division of
Water Quality inspected the Gillespie Farms swine facility. It was observed that
the receiving crop needs some improvement. It was also noted that record keeping
needed some improvement. The Certified Animal Waste Management Plan
(CAWMP) did not include all the fields in which waste was being applied. Mr.
Gillespie cleared some additional land for spraying so that he would not have to
use some of the land that was originally listed in the CAWMP since it was close
to a neighboring residence. However, the CAWMP was never updated to include
the additional acreage.
In regard to the deficiencies noted during the inspection, the following actions
are requested:
1. Consult with a technical specialist for assistance in regards to determine what
chemicals can be applied to the coastal bermuda to aid in weed control. -
2. Need to recalculate each entry on the IRR -2 forms in order to correct the
nitrogen balance for each one of the fields since a mathematical error was made
when calculating the records the first time.

3. Contact a technical specialist in order to update the CAWMP to include the appropriate fields in
which waste is going to be applied on.
Please provide a written response to this office on or before July 31, 1998 regarding corrective
actions taken or planned. Nothing in this letter should be taken as absolving this facility of the
responsibility and liability of any violations that have or may result from these deficiencies. If you

Dear Mr. Gillespie:
On June 8,1999, staff from the Fayetteville Regional Office of the Division of Water
Quality conducted a routine inspection on your swine facility located in Bladen County. It
was noted that the newest coastal bermuda field was weak in some areas. It was also
noted that freeboard records were not being maintained weekly as required by the General
Permit issued to this facility on September 24, 1998. General Permit condition 111.2 states
that "Waste lagoon and storage pond levels shall be recorded weekly on forms supplied or
approved by the DWQ.".
The last waste sample taken for this facility was dated in January of 1999. General
Permit condition 111.4 states that "An analysis of the animal waste shall be conducted as
close to the time of application as practical and at least 60 days (before or after) of the date
of application.". Some pumping events have not been covered by a current waste analysis.
The Division of Water Quality requests that the following items be performed:
1. Keep weeds and other grasses controlled in the coastal bermuda througout the current
growing season to allow coastal to spread. Evaluate the coastal at the end of the growing
season to determine if some areas will require resprigging.
2. Immediately begin recording weekly freeboard levels in order to be in compliance with
the General Permit.
3. Take a waste sample as close to the date of application as practical but at least 60 days
before or 60 days atter application as required by General Permit condition 111.4 and the
CAWMP.

Thank you for your recent submittal of the information requested in our letter dated April 16,
2003. The Fayetteville Regional Office has determined that no further enforcement actions will
be taken by the Division for the inadequate freeboard.
However, upon review and consideration of the information submitted, the Fayetteville Regional
Office has determined that an NOV is appropriate due to poor operation and management.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
These methods include, but are not limited to, water conservation practices, adding additional
application sites, updating your cropping systems, adding additional and/or more flexible
application equipment, and maintaining the lagoon Ievels at the lowest allowable and appropriate
levels throughout the year. Our staff looks forward to -continuing to work with you and your
Technical Specialist to evaluate and implement any needed changes to your system.

Dear Mr. Gillespie:
On January 26, 2010, staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section
(APS) were notified by Dean Morris of a high freeboard level in the lagoon 1. We wish to thank Mr.
Morris for notifying DWQ of this incident.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG100000 that you are covered to operate under, as follows:
Deficiency 1:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified
Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste System General
Permit No. AWG 100000.
On January 26, 2010 a lagoon/storage pond level was documented at 17 inches in lagoon 1. A level of
19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan.

Required Corrective Action for Deficiency 1:
DWQ has received a copy of your 30 Day Plan of Action (POA) for the high freeboard occurrence.
Take all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your
permit.
You are required to take any necessary action to correct the above deficiency and to provide a
written response to this Notice within 30 days of receipt of this letter. Please include in your
response all corrective actions already taken and a schedule for completion of any corrective actions not
addressed.
