Violation 1: Failure to maintain land application equipment in accordance with your permit and Certified Animal Waste Management Pian: (Permit No. AWS090166, Section 11 1) On 3-05-2007 during an inspection of your farm, DWO noticed that your irrigation equipment was not operating properly. The spray guns were not turning as designed. Required Corrective action for Violation 1: If you have not already done so, immediately cease application of animal waste and take all necessary steps to insure this violation does not reoccur. (Permit No. AWS090166, Section ll 4) Also on 3-05-2007, DWQ noticed excessive ponding and runoff during an application event. Required Corrective action for Violation 2: If you have not already done so, immediately cease discharging and begin efforts to recover the discharged animal waste. This waste must be handled as prescribed by your CAWMP and applicable state law. Additionally, take all necessary steps to ensure this violation does not reoccur. In addition to the specified corrective action above, the Division of Water Quality requests that you submit the following items on or before April 20, 2007: 1. Please have the farm Operator in Charge (OIC) include an explanation as to how this violation occurred. 2. Please have the OIC include a list of the steps that will be taken to prevent this violation from occurring in the future. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation.
