JAY ZIMMERMAN Director On April 28, 2016 staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section inspected the Hilton Monroe Farm and the permitted waste disposal system. We wish to thank Mr. Hilton Monroe, who was present and assisted during the inspection. As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your permit as follows: Violation 1: Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facilities Certified Animal Waste Management Plan. (Permit No. AWS090045 Section V 2). On October 5, 2015 a lagoon/storage pond level was documented at 8 inches of freeboard at your lagoon. A level of 19 inches is the maximum level allowed by your permit. During a site visit on October 5, 2015 you stated that your irrigation pump had been broken in June and you had not repaired it. A review of your pumping records showed that you failed to maximize the available PAN because the pump was broken which prevented you from maintaining compliant lagoon levels after receiving a 12 inch rain event. Additional non -compliant lagoon levels were reported in February and March 2016 of 18 inches. On April 28, 2016 during a routine compliance inspection your records were reviewed. Take all necessary additional steps to insure lagoon levels remain in compliance with Section (V 2) of your permit. In the future repair your irrigation system in a timely manner to prevent non -compliant lagoon level. The Division of Water Resources requests that, in addition to the specified corrective action above, please submit the following items on or before July 10, 2016 L , An explanation from the OIC for this farm regarding how this violation occurred. 2. A list from the OIC concerning the steps that will he taken to prevent this violation from occurring in the future. You are required to take any necessary action to correct the above violations on or before July 10, 2016 and to provide a written response to this Notice by July 10, 2016. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A. Submit a written request for remission including a detailed justification for such request: Please be aware that a request for remission is limited to consideration of the five factors listed below, as they may relate to the'reasonableness of the amount of the civil penalty assessed. Requesting remission is not the proper procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing, such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and agreement that no factual or legal issues are in dispute. Please -prepare a detailed statement that establishes why you believe the civil penalty should be .remitted, and .submit it to the Division of Water Quality at the address listed below. I_ FINDINGS OF FACT: A. Hilton L. Monroe owns and operates Hilton Monroe Farm, a permitted swine operation in Bladen County. B_ Hilton L. Monroe was issued Certificate of Coverage AWS090097 by DWQ, under General Permit AWG100000 for Hilton Monroe Farm on October 1, 2009, effective upon issuance, with an expiration date of September 30, 2014. C. Condition II.5 of the General Permit AWG 100000 states in part that "In no case shall land application rates result in excessive ponding or any runoff during any given application event". D. On March 7, 2012, DWQ staff from Fayetteville Regional Office observed wastewater ponding and runoff from a spray field during a flyover of the facility. DWQ staff inspected the facility and documented excessive ponding and wastewater runoff into a low lying, wooded area adjacent to the facility. E. On March 16, 2012, DWQ issued a Notice of Violation/Notice of Intent to Enforce (NOV/NOl) to Hilton L. Monroe identifying violations of N_C.G.S. 143-215.1 and General Permit No. AWG100000. The violations include land application of waste at a rate that resulted in excessive ponding and runoff of wastewater. F. The NOVINOl was sent by certified mail, return receipt requested and received on March 30, 2012. G_ The cost to the State of the enforcement procedures in this matter totaled $1097.19. Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. Hilton L. Monroe, is a "person" within the meaning of N.C.G.S. 143-215.6A pursuant to N.C.G.S. 143-212(4). B. A permit for an animal waste management system is required by N.C.G.S. 143-215_1. C. The above -cited failure to prevent excessive ponding and runoff violated Condition No. II. 5 of the General Permit AWG 100000. D. N_C.G.S. 143-215.6A(a)(2) provides that a civil penalty of not more than $25,000.00 may be assessed against a person who fails to apply for or to secure a permit required by N.C.G.S. 143- 215.1, or who violates or fails to act in accordance with the terms, conditions, or requirements of a permit required by N.C.G.S. 143-215.1. E. N.C.G.S. 143-215.3(a)(9) and N.C.G.S. 143B-282.1(b)(8) provides that the reasonable costs of any investigation, inspection or monitoring survey may be assessed against a person who violates any regulations, standards, or limitations adopted by the Environmental Management Commission or violates any terms or conditions of any permit issued pursuant to N.C.G.S. 143- 215.1, or special order or other document issued pursuant to N.C.G.S. 143-215.2_ F. The Supervisor of the Animal Feeding Operations Unit, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality, has the authority to assess civil penalties in this matter. Based upon the above Findings of Fact and Conclusions of Law, I make the following: Ill. DECISION: Accordingly, Hilton L. Each day of a continuing violation may be considered a separate violation subject to a maximum $25,000.00 per day penalty. Civil penalties and investigative cost may be assessed for any other rules and statutes for which penalties have not yet been assessed. V. My explanation regarding how this occurred: The marker was on 20" and I wanted to spray down to keep the freeboard down in case of rain. I was gone 20-30 minutes at the most from the irrigation site and was on my way back when I noticed ponding occurring and water running to the front of the reel and that is when I immediately shut it down. By that time, the state person in the helicopter saw me on the tractor returning to the reel. It had rained 3 days before and I did not think it was as wet as it was in that field This field had ryegrass in it and this is where I thought I needed to spray due to the cover crop being in that field. My explanation on the steps to prevent this from occurring in the future: I will use better judgment on picking a better time to spray and having better eyesight on what my fields look like before I spray. I will also work to get my lagoon down so I am not concerned before it rains. I am very concerned about the environment and I try to be very observant on what is going on in the fields. I have not had any violations in the past and I want to work to keep it that way in the future. Spray records to show the dates of irrigation and the amounts of water irrigated on all fields. (July 2011 — March 2012) You are required to take any necessary action to immediately correct the above violations and to provide a written response to this Notice by April 14, 2012. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. As a result of the violations in this Notice, this office is considering a recommendation for a civil penalty assessment to the Director of the Division. If you wish to present an explanation for the violations cited, or if you believe there are other factors, which should be considered, please send such information to me in writing within ten (10) days following receipt of this letter. Your response will be reviewed, and, if an enforcement action is still deemed appropriate, it will be forwarded to the Director and included for consideration. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215. (c) No person shall construct or operate an animal waste management system for an animal operation or operate an animal waste management system for a dry litter poultry facility that is required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), without first obtaining an individual permit or a general permit under this Article. The Commission shall develop a system of individual and general permits for animal operations and dry litter poultry facilities based on species, number of animals, and other relevant factors. It is the intent of the General Assembly that most animal waste management systems be permitted under a general permit. The Commission, in its discretion, may require that an animal waste management system be permitted under an individual permit if the Commission determines that an individual permit is necessary to protect water quality, public health, or the environment. The owner or operator of an animal operation shall submit an application for a permit at least 180 days prior to construction of a new animal waste management system or expansion of an existing animal waste management system and shall obtain the permit prior to commencement of the construction or expansion. The owner or operator of a dry litter poultry facility that is required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), shall submit an application for a permit at least 180 days prior to operation of a new animal waste management system. (al) An owner or operator of an animal waste management system for an animal operation or a dry litter poultry facility that is required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), shall apply for an individual National Pollutant Discharge Elimination System (NPDES) permit or a general NPDES permit under this Article and may not discharge into waters of the State except in compliance with an NPDES permit. (b) An animal waste management system that is not required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), shall be designed, constructed, and operated so that the animal operation served by the animal waste management system does not cause pollution in the waters of the State except as may result because of rainfall from a storm event more severe than the 25-year, 24-hour storm. (bl) An existing animal waste management system that is required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), shall be designed, constructed, maintained, and operated in accordance with 40 Code of Federal Regulations § 412, as amended at 73 Federal Register 70418 (November 20, 2008), so that the animal operation served by the animal waste management system does not cause pollution in waters of the State except as may result because of rainfall from a storm event more severe than the 25-year, 24-hour storm. A new animal operation or dry litter poultry facility that is required to be permitted under 40 Code of Federal Regulations § 412.46, as amended at 73 Federal Register 70418 (November 20, 2008), shall be designed, constructed, maintained, and operated so that there is no discharge of pollutants to waters of the State. (c) The Commission shall act on a permit application as quickly as possible and may conduct any inquiry or investigation it considers necessary before acting on an application. (d) All applications for permits or for renewal of an existing permit shall be in writing, and the Commission may prescribe the form of the applications. All applications shall include an animal waste management system plan approved by a technical specialist. The Commission may require an applicant to submit additional information the Commission considers necessary to evaluate the application. Permits and renewals issued pursuant to this section shall be effective until the date specified therein or until rescinded unless modified or revoked by the Commission. (e) An animal waste management plan for an animal operation shall include all of the following components: (1) A checklist of potential odor sources and a choice of site -specific, cost-effective remedial best management practices to minimize those sources. (2) A checklist of potential insect sources and a choice of site -specific, cost-effective best management practices to minimize insect problems. (3) Provisions that set forth acceptable methods of disposing of mortalities. (4) Provisions regarding best management practices for riparian buffers or equivalent controls, particularly along perennial streams. (5) Provisions regarding the use of emergency spillways and site -specific emergency management plans that set forth operating procedures to follow during emergencies in order to minimize the risk of environmental damage. (6) Provisions regarding periodic testing of waste products used as nutrient sources as close to the time of application as practical and at least within 60 days of the date of application and periodic testing, at least annually, of soils at crop sites where the waste products are applied. Nitrogen shall be a rate -determining element. Phosphorus shall be evaluated according to the nutrient management standard approved by the Soil and Water Conservation Commission of the Department of Agriculture and Consumer Services and the Natural Resources Conservation Service of the United States Department of Agriculture for facilities that are required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008). If the evaluation demonstrates the need to limit the application of phosphorus in order to comply with the nutrient management standard, then phosphorus shall be a rate -determining element. Zinc and copper levels in the soils shall be monitored, and alternative crop sites shall be used when these metals approach excess levels. (7) Provisions regarding waste utilization plans that assure a balance between nitrogen application rates and nitrogen crop requirements, that assure that lime is applied to maintain pH in the optimum range for crop production, and that include corrective action, including revisions to the waste utilization plan based on data of crop yields and crops analysis, that will be taken if this balance is not achieved as determined by testing conducted pursuant to subdivision (6) of this subsection. (8) Provisions regarding the completion and maintenance of records on forms developed by the Department, which records shall include information addressed in subdivisions (6) and (7) of this subsection, including the dates and rates that waste products are applied to soils at crop sites, and shall be made available upon request by the Department. (f) Any owner or operator of a dry litter poultry facility that is not required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), but that involves 30,000 or more birds shall develop an animal waste management plan that complies with the testing and record -keeping requirements under subdivisions (6) through (8) of subsection (e) of this section. Any operator of this type of animal waste management system shall retain records required under this section and by the Department on -site for three years_ (fl) An animal waste management plan for a dry litter poultry facility required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), shall include the components set out in subdivisions (3), (6), (7), and (8) of subsection (e) of this section, and to the extent required by 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), for land application discharges, subdivision (4) of subsection (e) of this section. (g) The Commission shall encourage the development of alternative and innovative animal waste management technologies. The Commission shall provide sufficient flexibility in the regulatory process to allow for the timely evaluation of alternative and innovative animal waste management technologies and shall encourage operators of animal waste management systems to participate in the evaluation of these technologies. The Commission shall provide sufficient flexibility in the regulatory process to allow for the prompt implementation of alternative and innovative animal waste management technologies that are demonstrated to provide improved protection to public health and the environment. (h) The owner or operator of an animal waste management system shall: (1) In the event of a discharge of 1,000 gallons or more of animal waste to the surface waters of the State, issue a press release to all print and electronic news media that provide general coverage in the county where the discharge occurred setting out the details of the discharge. The owner or operator shall issue the press release within 48 hours after the owner or operator has determined that the discharge has reached the surface waters of the State. The owner or operator shall retain a copy of the press release and a list of the news media to which it was distributed for at least one year after the discharge and shall provide a copy of the press release and the list of the news media to which it was distributed to any person upon request. (2) In the event of a discharge of 15,000 gallons or more of animal waste to the surface waters of the State, publish a notice of the discharge in a newspaper having general circulation in the county in which the discharge occurs and in each county downstream from the point of discharge that is significantly affected by the discharge. The Secretary shall determine, at the Secretary's sole discretion, which counties are significantly affected by the discharge and shall approve the form and content of the notice and the newspapers in which the notice is to be published. The notice shall be captioned "NOTICE OF DISCHARGE OF ANIMAL WASTE". The owner or operator shall publish the notice within 10 days after the Secretary has determined the counties that are significantly affected by the discharge and approved the form and content of the notice and the newspapers in which the notice is to be published. The owner or operator shall file a copy of the notice and proof of publication with the Department within 30 days after the notice is published. Publication of a notice of discharge under this subdivision is in addition to the requirement to issue a press release under subdivision (1) of this subsection. (i) A person who obtains an individual permit under G.S. 143-215.1 for an animal waste management system that serves a public livestock market shall not be required to obtain a permit under this Part and is not subject to the requirements of this Part. Irrigation equipment complies with the CAWMP. The pump was repaired on May 6 when pumping resumed. I now have a complete design as a result of changing from all above ground pipe - to hydrant system and partial solid set system upgrades. 5. Normally, animals are fenced off of lagoon dikes. Cattle had gotten out of fenced area due to a lightening strike to my electric box which was repaired on or about May 3rd. At the time of the inspection, waste application records were inadequate and the irrigation system had not been installed as designed. In addition, several of the waste application fields require sprigging with berinuda grass to comply with the :1 _ CAWMP. In regard to the'deficiencies noted during the inspection, the following, actions are requested: 1. Consult vith a technical specialist in regard to the establishment of the required crop (bermuda grass) per your certified animal waste management plan(CAWMP). . 2. Consult with a technical speclatlist in regard to maintaining irrigation records in accordance with the CAWMP by pull or zone. In addition, the waste application equipment must be repaired and calibrated in t order to maintain the required records accurately. Please provide a written response to this office on or before August 15,1998, regarding corrective actions taken or planned.
