On March 7, 2002, staff from the Fayetteville Regional Office of the Division of Water
Quality performed a routine inspection of the Tar Kiln Farm in Bladen County_ The inspection
revealed that over -application had occurred on the small grain crop by six pounds for the 2001-
2002 season.
In regard to the deficiency noted during the inspection, the following action is requested:
Avoid over -application of nitrogen to crops as outlined in your CAWMP.
Please provide a written response to this office on or before April 19, 2002 as to the actions
taken or proposed to be taken to resolve this deficiency. Nothing in this letter should be taken as
absolving this facility of the responsibility and liability of any violations that have resulted or may
result from this deficiency.

Dear Mr. Gooden:
On February 28, 2009, staff from the Fayetteville Regional Office of the Division of Water Quality, conducted
an inspection of the Tar Kiln Farm in Bladen County. The inspection revealed that the farm needed a copy of the lagoon
design, and irrigation rec arils were not being maintained correctly. In addition, waste samples were not being collected
as required, the lagoon dike did not have a suitable grass cover, and the waste application field had a drainage problem
resulting in a poor summer and winter crop.
The Division of Water Quality requests that the following items be addressed:
Contact a drainage and crop specialist for assistance in improving the waste application field by lowering the
groundwater to assist in the establishment of the required crops.
2. Begin collecting waste samples within sixty (60) days of waste application.
3. Curtail driving on the lagoon dike and prepare the site and establish a suitable grass cover to prevent
erosion.
4. Irrigation records are required to be maintained seasonally (by cr6p) on a separate IRR -2 form for each
field (pull).
5. Contact the local MRCS office (Sam Warren) for a copy of all lagoon design information to include storage
calculations and as built drawings.

Dear Mr. Gooden.
You are hereby notified that, having been deemed permitted to have a
non discharge permit for the subject animal waste disposal system pursuant
to 15A NCAC 2H.0217, you have been found to be in violation of your 2H
.0217 Permit.
On March 17, 1998, staff from the Fayetteville Regional Office of the
Division of Water Quality conducted an annual inspection of your swine
farms located off Twisted Hickory Road in Bladen County. The inspection
revealed that no winter crop (small grain) was established on three of the
facilities, the lagoons did not have the required freeboard at the White Bay
Nursery and the Twisted Hickory Nursery, and the lagoon banks needed a
suitable cover grass on the Little Crib facility (09-76) and the Twisted
Hickory facility (09-152). The pump records (IRR -1 form) were completed
but no plant available nitrogen (PAN) records were completed (IRR -2
forms) for the fields or pulls on all facilities. The nitrogen balance had been
exceeded for the crop (rye) on all the facilities by as much as 400 pounds.
Further investigation identified that waste analysis samples were not
collected within 60 days of waste application and no soil samples had been

collected from the fields. The certified animal waste management plans (CAWMP) did not have
the required certification forms, or maps of the facility and spray fields and the emergency action
plan, mortality plan, and insect and rodent checklist were not available for the waste management
plan. The spray fields for White Bay Nursery, Cowford Nursery, and Tar Kiln Nursery were
never planted with a rye overseed as required in the CAWMP. Animal waste was ponded in the
waste application field at the time of the inspection at the Tar Kiln Nursery. In addition, animal
waste from the Clay Hill Nursery was identified in a ditch adjacent to the entrance to the Twisted
Hickory Nursery that had run-off of the spray field.
The Division of Water Quality requests that the following items be addressed:
Immediately begin maintaining records of waste application on the crops in accordance
with your CAWMP and your operators certification to prevent over application of plant
available nitrogen (PAN). Collect waste analysis samples within 60 days of waste
application and collect soil samples annually to assist in the production of better crops.
Apply waste to the crops at the appropriate times in accordance with your CAWMP.
2. Lower the lagoon level to the required freeboard on a suitable waste application field as
soon as weather permits.
3. Calibrate the waste application equipment to insure that the application rate does not
exceed the infiltration rate of the soil resulting in ponding and run-off.
4. Contact a technical specialist for assistance in revising your CAWMP to include all the
required components.
S. Establish a suitable cover grass on the inside slopes of the Twisted Hickory and the Little
Crib Nursery lagoon dikes.
6. Plant all required crops as identified in your CAWMP to allow waste application and
nutrient uptake of the PAN.
Please be advised that this notice does not prevent the Division of Water Quality from taking
enforcement actions for this violation or any past or future violation. Furthermore, the Division
of Water Quality has the authority to levy a civil penalty of not more than $10,000.00 per day per
violation.
