On December 11, 2009, the staff of the NC Division of Water Quality (DNNIQ), Aquifer Protection Section
(AFS), were notified of a high freeboard level in one or more of the facilities lagoons.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1300; you have been
found to be in violation of your Certified Animal Waste Management flan (CAWMP) and the Swine
Waste System General Permit No. AWG100000 as follows:
Deficiency 1:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's CAWMP
in accordance with Condition V. 2. Of Swine waste System General Permit No. AWG 100000.
On December 11, 2009, a lagoon/storage pond level was documented at 18 inches of freeboard. A level of
19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan.
Continue to follow the proposed actions outlined in your Plan of Action (POA) submitted to the
Fayetteville Regional Office. Take all necessary additional steps to insure lagoon levels remain in
compliance with Section (2) of your permit.

If you have not already done so, provide a written response to this Notice of Deficiency once lagoon
levels are back in compliance.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to
the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that
twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance
with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.

Thank you for your recent submittal of the information requested in our letter dated April 16,
2003. The Fayetteville Regional Office has determined that no further enforcement actions will
be taken by the Division for the inadequate freeboard.
However, upon review and consideration of the information submitted, the Fayetteville Regional
Office has determined that an NOV is appropriate due to poor operation and management.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
These methods include, but are not limited to, water conservation practices, adding additional
application sites, updating your cropping systems, adding additional and/or more flexible
application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate
levels throughout the year. Our staff looks forward to continuing to work with you and your
Technical Specialist to evaluate and implement any needed changes to your system -

DWQ staff observed an irrigation event that was taking place next to the highway. The observations indicated nothing improper being

On Tuesday, October 10, 1995, this office was notified by our Raleigh Central Office
concerning a potential swine waste runoff problem at your swine farm located off SR 1128
in Bladen County. As the result of this complaint, your farm was investigated on this same
date. Please find enclosed a copy of our Compliance Inspection Report for your
Information. It is the opinion of this office that your facility is In compliance with 15A
NCAC 2H, Part .0217, and that animal waste management is being properly performed.

rye, etc.) and Coastal Bermuda. All
land observed had an established cover
crop in place and some fields were
being prepared for the winter cover.

Additional Comments: As a result of a complaint concerning runoff from the waste lagoon,
this facility was investigated on 10/10/95. This facility appeared well managed and
maintained. Records of application were available and the spray acreage ashan� est BT sFied
cover crop. Drift and the potential for runoff were discussed with Mr. Lewis. No runoff
was observed and the lagoon had adequate freeboar .
