Box 759 Rose IIill, NC 28458 SUBJECT: NOTICE OF DEFICIENCY Murphy Family Farms Bladen County Company Farms Bladen County Dear Mr. Adams: On May 28, 1997, June 1, 1997, and June 2, 1997, staff from the Fayetteville Regional Office of the Division of Water Quality inspected the following company swine facilities: Edge Sow Farm, Singletary Farm, Squires Fara, Edge Farm;'Evergreen Farm, Fox Fire Farms, 242 Sow Farm, Bladen Sow Farm, Cain Complex, and French's Creek Farms. It was observed that the record keeping of the waste applications was either inaccurate or incomplete due to an out of date waste analysis sample. The most recent sample collection date at the time of the inspections was January 3, 1997. Please be aware that waste analysis samples must be collected within 60 days either before or after waste application to comply with the certified animal waste management plan and the General Permit . Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have or may result from these deficiencies. Wachovia Building. After researching the facts, I submit that the deficiencies you found are more appropriate for an NOD. The reasons supporting my request are detailed by farm as follows: Bladen Boar Stud The irrigation system has been designed and flagged in the field and is awaiting installation by Mr. Billy Hall. Because of the low number of animals at this facility and the fact that there is currently 32" of freeboard in the new lagoon, we have not made irrigation installation and crop establishment a high priority due to other more pressing situations to manage. Sufficient irrigation equipment, though not on the farm, is owned by our company and could be moved to the farm within one hour to handle irrigation if required. The reason a crop has not been established is due to the fact that coastal sprigs will likely die in that sandy soil unless we can irrigate them (water and nutrients) regularly during any dry weather. Until recently there has not been sufficient lagoon volume to warrant sprigging. Evergreen Sow Farm There are 26 cow/calf pairs stocked on this farm. It is impractical and expensive to move cattle around chasing the explosive growth of rye that commonly occurs in April of every year. Even on farms where cattle are, we harvest rye for hay where there is sufficient quantity and this is planned for Evergreen. Over application of Nz is a function of El Nino's excessive rainfall as we demonstrated during our meeting on Tuesday, April 14, 1998. This is a natural phenomenon that is out of our control and 1 feel it is unreasonable to penalize us. A tint to the puddle indicating effluent probably was a result of the rain washing prior irrigated effluent into the depressed area. The inside slope of the lagoon dike will get some attention. Lisbon 1 & 2 Sow Farms The freeboard was approximately 15 inches which is a direct result of excess rainfall. The coastal Bermuda stand is difficult to assess in the spring when it is mostly dormant, especially for a new stand. These farms were sprigged just last year and because the stand is new, weed growth is normal. As of today, the weeds have been sprayed and rye has been cut and these management practices were planned prior to your inspection. Michael Norris or John Bizic will call you to request that you have another look at the stand. The other deficiencies that you noted are already corrected. Peters Creek The lagoon had approximately 11 inches of freeboard because of excess rainfall. My position on over -application of nitrogen has been stated earlier. On April 8, 1998, staff from the Fayetteville Regional Office of the Division of Water Quality conducted an annual inspection of your swine farm located off SR 1319 in Bladen County. Immediately remove the rye overseed to prevent damage to the bermuda grass stand by mechanical means or place an adequate herd of cattle on the facility to graze the rye overseed. 2. Modify the spray fields or remove the depressional areas in the spray fields from the CAWMP to prevent ponding of waste. 3. Establish a suitable cover grass on the inside slope of the lagoon dike down to the pump on level to prevent erosion of the structure. 4. Curtail the application of waste on the spray fields to prevent overapplication of plant available nitrogen (PAI) when the rate approved in the CAWMP has been met. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $10,000.00 per day per violation. Please provide a written response to this office on or before May 15, 1998, regarding corrective actions taken or planned. Annual permit fees are billed following the issuance of the permit and then annually thereafter on the anniversary of that date. Your animal waste management system permit was issued on 6/1/98. Your annual permit fee for the period of 6/l/98 - 5/31/99 is $200.00. Your payment was due 8/7/98. Because this fee was not fully paid within 30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 NCAC 2H.0205 (c) (4). and G.S. 143-215.1 (b) (3). Effective 60 days from receipt of this notice, the subject permit is hereby revoked unless the required Annual Animal Waste Management System Permit fee for your animal operation is received within that time. Operation of an animal waste management system without a valid permit is a violation of North Carolina General Statute 143-215.1 and is subject to the assessment of a civil penalty of up to $10,000 per day. We as a rule calibrate and set our irrigation equipment to apply the desired amount, e.g. 0.6 inch, and stay consistent across the field, slightly adjusting travel speed only when necessary. If we do not hear back from you, I'll assume no further action is necessary. Thank you. The liquid level of the lagoon was reported as 18 inches. General Permit condition'V.3 states that "The maximum waste level in lagoons/storage ponds snail not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoonststorage ponds must not exceed the level that provides adequate storage to contain the 25 -year, 24-hour storm event plus as additional 1 foot of structural freeboard.". . The Division of Water Quality will take no further action for this reported incident at this time. However, you are asked to please notify this office in writing within 15 days of receipt of this tetter as to what date the lagoon was lowered to the required freeboard level. This information is essential in determining if the lagoon was lowered within the specified time frame in which the Plan of Action (POA) allotted. It will also close this event out within your file. We sprayed these bermuda fields earlier this summer with 24D broadleaf weed herbicide. We are unsure what, if anything, we can spray to control other grasses. Of these farms, only Evergreen is grazed, and the nitrogen rate (i 50 & 180 Lbs.) for the fields in question given by technical specialist Kraig Westerbeek is low to reflect a stand of mixed bermuda, fescue, and native grasses. The other farms have very low nitrogen concentrations in the lagoons, making it impossible to optimally fertilize the bermuda; however, across the fields green summer grasses are growing and have been baled and removed at a nitrogen rate greater than or equal to our applications. 2) At Bladen Boar (9-167), we experimented with an alternative crop of field peas in response to previous unsuccessful attempts to grow Bermuda. The reason crop establishment is difficult is that by nature and design the small boar studs use a relatively low amount of water and therefore require a low amount of wastewater to be irrigated. The field peas we planted this year came up beautifully and then, due to the isolation of this site and being surrounded by woodland bays, deer grazed the crop to the ground. Due to the health status of this farm, dry litter from another farm is not an option. Our plan is to seed rye this winter. Freeboard is currently 39". We will consider any improvements you suggest. 3) We have tentatively set up a meeting on October 4"' with Dr. Jim Green of NCSU, Regional Agronomist Rick Morris, CES, and also invite your staff along with SWC to discuss what can and should be done to improve bermuda stands on several farms in the Bladen area.
