Morse 700 Shephard Street Hendersonville, North Carolina 28792 Subject: NOTICE OF VIOLATION (NOV-2018-PC-0478) NPDES Stormwater General Permit NCG070000 Selee Corporation Certificate of Coverage NCG070156 Henderson County Dear Mr. Morse: On December 6, 2018, Isaiah Reed, from the Asheville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR), conducted a site inspection for the Selee Corporation facility located at 700 Shephard Street, Henderson County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Alesia Griesmyer was also present during the inspection and her time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG070000 under Certificate of Coverage NCG070156. Permit coverage authorizes the discharge of stormwater from the facility to an unnamed tributary, and ultimately to receiving waters designated as King Creek, a Class C waterbody in the French Broad River Basin. Highway 70 1 Swannanoa, North Carolina 28778 828.296.4500 As a result of the site inspection, the following permit violations are noted: 1) Stormwater Pollution Prevention Plan (SPPP) A. A SPPP has not been properly implemented and was kept in various locations. 2) Secondary Containment Requirements and Records A. Secondary containment for a tank containing Mono Aluminophosphate was observed to be damaged and rendered non-functional due to a hole near the bottom of the containment wall. B. Secondary containment was not installed around the wastewater tank during the time of the inspection. Requested Response: You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your written response should include a reasonable explanation as to why the aforementioned violations occurred as well as a Plan of Action to prevent these violations from recurring. Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement to the Director of the Division of Energy, Mineral & Land Resources regarding these issues. Your above -mentioned response to this correspondence will be considered in this process. This office requires that the violations, as detailed above, be properly resolved. These violations and any future violations are subject to a civil penalty assessment of up to $25,000 per day for each violation. I met with Alicia Griesmyer on site. During the inspection, the following items were noted: 1) The secondary containment for the Mono Aluminophosphate tank is damaged and broken at one corner, and a hole was observed at the base of the wall where a pipe is installed through it. Due to the condition of the containment, it is not a functioning secondary containment structure. The permittee is directed to immediately repair and evaluate the secondary containment for any potential to allow a release of material should the secondary containment be needed. 2) There was no secondary containment observed around the wastewater tank in the same area as the Mono Aluminophosphate tank. The permittee is directed to immediately install secondary containment around all storage tanks as specified in that General Permit. 3) Due to visible pollutants being deposited from inside the dumpsters on site, it is recommended that the permittee install covers on the dumpsters to prevent further potential for impacts to stormwater. 4) The SWPPP (Stormwater Pollution Prevention Plan) was kept in various places. The entirety of the SWPPP should have a t least one hard copy containing all parts of the SWPPP on site.
