REQUEST FOR MORE INFORMATION
Dear Mr. Nelson:
On December 28, 2006, the Division of Water Quality (DWQ) received your application dated Decmber
22, 2006 with additional information received on February 2, 2007 to impact 1,349 square feet of Zone 1
protected riparian buffers and 1,206 square feet of Zone 2 protected riparian buffers to construct the
proposed residential subdivision and aerial sanitary sewer crossing. The DWQ has determined that your
application remains incomplete and/or provided inaccurate information as discussed below. The DWQ
will require additional information in order to process your application to impact protected wetland,
streams and/or buffers on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A NCAC 2H
.0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Geotechnical Report
Your geotechnical report references auger refusal at a depth of 13 feet. You must reach bedrock
at a depth of 3-5 feet in order to have the required soils to allow for a bottomless culvert per,

ENGINEER -1999. This report states, "When a shallow (3-5 foot max. depth) non-erosive rock
foundation is found throughout the proposed site, the structure can be built on footings without a
bottom allowing retention of the natural channel bed. Please revise your plans to show you are
not using a bottomless culvert in the proposed location.
2. Diffuse Flow
On February 6, 2007 DWQ had a meeting with you to discuss the possible alternatives for diffuse
flow at your site. Please submit the revised plan sheets reflecting the diffuse flow provisions
discussed in the meeting. Also be sure to include all applicable worksheets and operation and
maintenance agreements. o°e

Please respond within three weeks of the date of this letter by sending this information to me in writing
and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks,
we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Mr. Ian McMillan at 919-733-1786 if you have any
