The PERCS Unit of the Division of Water Resources has reviewed the Industrial User Pretreatment Permit
(IUP) modifications submitted by the City of Statesville for the following Significant Industrial Users (SIUs).
The IUP modifications were received by the Division on March 15, 2019.

The review indicates, with the observation below, that the IUP modifications are adequate and the
minimum requirements of 15A NCAC 2H .0905 and .0916 and 40 CFR 403.8(f)(1)(iii) are met.
1. IUP Transmittal Letter: It appears that none of the IUP transmittal letters informed the SIUs of
their rights to adjudicate the IUPs. All future IUP submittals must inform the SIUs of their rights
to adjudicate the IUP. Please review Appendix 6-D of the Comprehensive Guidance on PERCS
website for suggestive wordings.
2. Allocation Table: It appears that modification effective dates on the updated Allocation Table
(AT) for the subject IUPs are incorrect, as the effective dates should be March 8, 2019, as listed in
the modified IUPs. Please update AT accordingly.
Federal and State pretreatment regulations require the local delegated pretreatment program to
effectively control and document the discharge of wastewater from Significant/Categorical Industrial
Users to the POTW. It is the POTW's responsibility to ensure that these objectives are consistently met.
