System. The permit has been rescinded per the request from USDA FS.

SUBJECT: Division 13 2012 Bridge Replacement Program
Scoping Review Comments
In reply to your request,the NCDWQ offers the following comments for the projects listed below:
Project Specific Comments
100651 Bridge No.651 over Stony Fork Creek,NCSR 1109,Buncombe County
1. Stony Fork Creek is class C-trout waters of the State. NCDWQ recommends that the most protective
sediment and erosion control BMP's be implemented to reduce the risk of turbidity violations in trout
waters. In addition, all disturbances within trout buffers shall be conducted in accordance with the
NC Division of Land Resources and NC Wildlife Resources Commission.
2. Should NC Wildlife Resources Commission(NCWRC) identify these waters as naturally reproducing
trout waters,NCDOT will be required to observe the NCWRC recommended moratoria for trout.
3. There appears to be wetlands adjacent to the project on both sides of Stony Fork Creek.
560059 Bridge No.59 over Walnut Creek,NCSR 1390,Madison County
1. Walnut Creek is class C waters.
2. NCDWQ has no specific comments for this bridge project.

1. The Henry Fork River is classified as C-ORW waters. NCDWQ recommends that the most protective
sediment and erosion control BMP's be implemented to reduce the risk of turbidity violations in
ORW waters.
2. In addition,NCDWQ will require that NCDOT strictly adhere to North Carolina regulations entitled
"Design Standards in Sensitive Watersheds" [I 5A NCAC 04B .0124] throughout design and
construction of the project.
3. NCDOT may be required to obtain a State Stormwater permit for this project in accordance with 15A
NCAC 2H.1000. This will depend on the amount of new impervious surface on the new bridge.

General Comments Regarding Bridge Replacement Projects
1. NCDWQ is very concerned with sediment and erosion impacts that could result from these projects.
NCDOT shall address these concerns by describing the potential impacts that may occur to the
aquatic environments and any mitigating factors that would reduce the impacts.
2. If foundation test borings are necessary; it shall be noted in the document Geotechnical work is
approved under General 401 Certification Number 3687/Nationwide Permit No. 6 for Survey
Activities.

3. Any Low Impact Bridge Projects must fall under Nationwide Permit No. 3 to qualify for Low Impact;
otherwise, standard permitting procedures will be required. Example (Regional General Permit No.
31,Nationwide Permit No. 23,Nationwide Permit No. 13, etc.)
4. Whenever possible,NCDWQ prefers spanning structures. Spanning structures usually do not require
work within the stream or grubbing of the stream banks and do not require stream channel
realignment. The horizontal and vertical clearances provided by bridges shall allow for human and
wildlife passage beneath the structure. Fish passage and navigation by canoeists and boaters shall not
be blocked. Bridge supports(bents) should not be placed in the stream when possible.
5. Bridge deck drains shall not discharge directly into the stream. Stormwater shall be directed across
the bridge and pre-treated through site-appropriate means (grassed swales,pre-formed scour holes,
vegetated buffers, etc.)before entering the stream. Please refer to the most current version of
NCDWQ's Stormwater Best Management Practices.
6. Strict adherence to the most recent version of NCDOT's Best Management Practices For Bridge
Demolition and Removal approved by the US Army Corps of Engineers is a condition of the 401 Water
Quality Certification.
7. Bridge piles and bents shall be constructed using driven piles(hammer or vibratory)or drilled shaft
construction methods.More specifically,jetting or other methods of pile driving are prohibited without
prior written approval from NCDWQ first.
8. No drill slurry or water that has been in contact with uncured concrete shall be allowed to enter surface
waters. This water shall be captured,treated,and disposed of properly.
9. All pile driving or drilling activities shall be enclosed in turbidity curtains unless otherwise approved by
NCDWQ in this certification.
10. All bridge construction shall be performed from the existing bridge,temporary work bridges,
temporary causeways, or floating or sunken barges. If work conditions require barges,they shall be
floated into position and then sunk. The barges shall not be sunk and then dragged into position.Under
no circumstances should barges be dragged along the bottom of the surface water.
11. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP
measures from the most current version of NCDOT Construction and Maintenance Activities manual
such as sandbags,rock berms, cofferdams and other diversion structures shall be used to prevent
excavation in flowing water.
12. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact
between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall
not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and
fish kills.
13. Heavy equipment shall be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the introduction of other pollutants into the stream. This equipment
shall be inspected daily and maintained to prevent contamination of surface waters from leaking fuels,
lubricants,hydraulic fluids,or other toxic materials.

14. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction
contours and elevations. Disturbed areas shall be seeded or mulched to stabilize the soil and
appropriate native woody species shall be planted. When using temporary structures the area shall be
cleared but not grubbed. Clearing the area with chain saws, mowers, bush-hogs, or other mechanized
equipment and leaving the stumps and root mat intact allows the area to re-vegetate naturally and
minimizes soil disturbance.
15. Sediment and erosion control measures sufficient to protect water resources must be implemented and
maintained in accordance with the most recent version of North Carolina Sediment and Erosion Control
Planning and Design Manual and the most recent version of NCS000250.
16. In most cases, the NCDWQ prefers the replacement of the existing structure at the same location with
road closure. If road closure is not feasible, a temporary detour shall be designed and located to avoid
wetland impacts,minimize the need for clearing and to avoid destabilizing stream banks. If the
structure will be on a new alignment,the old structure shall be removed and the approach fills removed
from the 100-year floodplain. Approach fills shall be removed and restored to the natural ground
elevation. The area shall be stabilized with grass and planted with native tree species. Tall fescue shall
not be used in riparian areas.

Special Order by Consent (SOC) whereby the subject WWTP was granted relaxed effluent
limitations for TSS and Fecal Coliform from those imposed by the NPDES Permit, in exchange
for Murphy's commitment to a schedule of wastewater treatment plant improvements that will
return the WWTP to compliance with the terms of the NPDES Permit. The SOC contains
provisions for the assessment of stipulated penalties when modified limits are exceeded or
schedule dates are not met.
A review of Murphy WWTP's monitoring report for December 2011 showed the following

You are directed to immediately take whatever remedial actions are necessary to correct the
problems that have led to this violation. Section III of the SOC stipulates that a penalty in the amount
of$1,000 be paid for noncompliance with any modified limit contained in the SOC. However, Section
IV of the SOC lists circumstances under which stipulated penalties are not due, essentially stating
this provision is applicable when the Division of Water Quality can be satisfied the non-compliance
was caused by events or circumstances beyond the control of TWSA.
If you have information that will prove to the Division that any or all of the criteria set forth in
Section IV have been met, you must submit this information in writing to the Asheville Regional
Office within ten (10) days after receipt of this notice. In the absence of evidence justifying the
application of the provision within Section IV, this Office will proceed with assessment of stipulated
penalties as provided for in the SOC.

This approval is valid solely for the purpose and design described in your application (unless modified below). Should
your project change,you must notify the DWQ and submit a new application. If the property is sold,the new owner must
be given a copy of this Certification and approval letter, and is thereby responsible for complying with all conditions. If
total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the
future)exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h)(6) and
(7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
Condition(s)of Certification:
1. There shall be no excavation from, or waste disposal into,jurisdictional wetlands or waters associated with this permit
without appropriate modification. Should waste or borrow sites, or access roads to waste or borrow sites, be located
in wetlands or streams, compensatory mitigation will be required since that is a direct impact from road construction
activities.
2. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by this
Certification. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall
be removed and the natural grade restored upon completion of the project.
3. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design,
installation and operation and maintenance of such Best Management Practices in order to protect surface waters
standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, an6_—_"-''
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with
the requirements of the Sedimentation Pollution Control Act.
4. Unless otherwise approved in this certification, placement of culverts and other structures in open waters and
streams shall be placed below the elevation of the streambed by one foot for all culverts with a diameter
greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48
inches, to allow low flow passage of water and aquatic life. Design and placement of culverts and other
structures including temporary erosion control measures shall not be conducted in a manner that may result in
dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above
structures. The applicant is required to provide evidence that the equilibrium is being maintained if requested
in writing by NCDWQ. If this condition is unable to be met due to bedrock or other limiting features
encountered during construction, please contact NCDWQ for guidance on how to proceed and to determine
whether or not a permit modification will be required.
5. NCDOT will need to adhere to all appropriate in-water work moratoria(including the use of pile driving or vibration
_techniques�prescribed_by_the North_Caralina_Wildlife Resources-Commission.

6. If multiple pipes or barrels are required,they shall be designed to mimic natural stream cross section as closely as
possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream
channel should be avoided. Stream channel widening at the inlet or outlet end of structures typically decreases water
velocity causing sediment deposition that requires increased maintenance and disrupts aquatic life passage.
7. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measures from the
most current version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock berms,
cofferdams and other diversion structures shall be used to prevent excavation in flowing water.
8. The stream channel shall be excavated no deeper than the natural bed material of the stream, to the maximum extent
practicable. Efforts must be made to minimize impacts to the stream banks, as well as to vegetation responsible for
maintaining stream bank stability. Any applicable riparian buffer impact for access to stream channel shall be
temporary and be revegetated with native riparian species.
9. The dimension, pattern and profile of the stream, above and below the crossing, shall not be modified. Disturbed
floodplains and streams shall be restored to natural geomorphic conditions.
10. Native riparian vegetation (e.g. rhododendron, dog hobble, willows, alders, sycamores, dogwoods, black walnut and
red maple) must be reestablished within the construction limits of the project by the end of the growing season
following completion of construction.
11. The use of rip-rap above the Normal High Water Mark shall be minimized. Any rip-rap placed for stream
stabilization shall be placed in stream channels in such a manner that it does not impede aquatic life passage.
12. Rip-rap shall not be placed in the active thalweg channel or placed in the streambed in a manner that precludes aquatic
life passage. Bioengineering boulders or structures should be properly designed, sized and installed.
13. Heavy equipment shall be operated from the banks rather than in the stream channels in order to minimize
sedimentation and reduce the introduction of other pollutants into the stream.
14. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent
contamination of stream waters from fuels, lubricants,hydraulic fluids, or other toxic materials.
15. The Permittee shall ensure that the final design drawings adhere to the permit and to the permit drawings submitted
for approval.
16. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is
prohibited.
17. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact between curing
concrete and stream water. Water that inadvertently contacts uncured concrete shall not be discharged to surface
waters due to the potential for elevated pH and possible aquatic life and fish kills.
18. No rock, sand or other materials shall be dredged from the stream channel, except where authorized by this
certification.
19. A copy of this Water Quality Certification shall be maintained on the construction site at all times. In addition, the
Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer
and the on-site project manager.
20. All fill slopes located in jurisdictional wetlands shall be placed at slopes no flatter than 3:1, unless otherwise
authorized by this certification.
21. During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or
protected riparian buffers.
22. The outside buffer,wetland or water boundary located within the construction corridor approved by this authorization
shall be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the
fencing are prohibited unless otherwise authorized by this certification.
23. The permittee and its authorized agents shall conduct its activities in a manner consistent with State water quality
standards(including-.any requirements_resulting from compliance with §303(d)of the CleanWater Act)and any other
appropriate requirements of State and Federallaw. if NUDWQ determines that such standards or laws are not being
met(including the failure to sustain a designated or achieved use)or that State of Federal law is being violated, or that
further conditions are necessary to assure compliance,NCDWQ may reevaluate and modify this certification.

24. The issuance of this certification does not exempt the Permittee form complying with any and all statutes, rules,
regulations or ordinances that may be imposed by other government agencies (i.e. local, state, and federal) having
jurisdiction, including but not limited to applicable buffer rules, stormwater management rules, soil erosion and
sedimentation control requirements, etc.
25. The Permittee shall report any violations of this certification to the Division of Water Quality within 24-hours of
discovery.
26. Upon completion of the project (including any impacts at associated borrow or waste sites), the NCDOT Division
Engineer shall complete and return the enclosed "Certification of Completion Form" to notify NCDWQ when all
work included in the §401 Certification has been completed.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the expiration of the 404
or CAMA permit.
If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty(60)
days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter
150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail Service
Center,Raleigh,N.C. 27699-6714. If modifications are made to an original Certification,you have the right to an
adjudicatory hearing on the modifications upon written request within sixty(60)days following receipt of the
Certification. Unless such demands are made,this Certification shall be final and binding.

Permit No. WQ0035860, dated April 9, 2012, to The City of Lenoir for the construction and operation of
the subject wastewater collection system extension. This permit shall be effective from the date of
issuance until rescinded and shall be subject to the conditions and limitations as specified therein. This
cover letter shall be considered apart of this permit and.is therefore incorporated therein by reference.
Please pay particular attention to Permit Condition 3 which requires that the wastewater
collection facilities be properly operated and maintained in accordance with 15A NCAC 2T .0300 or any
individual system-wide collection system permit issued to the Permittee.
Permitting of this project does not constitute an acceptance of any part of the project that does
not meet 15A NCAC 2T .0300; the Division of Water Quality's (Division) Gravity Sewer Minimum
Design Criteria adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria
for the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable,
unless specifically mentioned herein. Division approval is based on acceptance of the certification
provided by the North Carolina-licensed Professional Engineer named in the application. It shall be the -
Permittee's responsibility to ensure that the as-constructed project meets the appropriate design criteria
and rules. Failure to comply may result in penalties in accordance with North Carolina General Statute
§143-215.6A through §143-215.6C, construction of additional or replacement wastewater collection
facilities, and/or referral of the North Carolina-licensed Professional Engineer to the licensing board.

amended, and other applicable Laws, Rules, and Regulations, permission is hereby granted to the City w
of Lenoir for the construction and operation of approximately 3,810 linear feet of 8-inch gravity sewer
and 2,115 linear feet of 12-inch gravity sewer; as part of the project NC DOT Project U2211-B Utility
Relocations, and the discharge of 0 gallons per day of collected domestic/commercial wastewater into
the City of Lenoir's existing sewerage system, pursuant to the application received March 21, 2012 and
in conformity with 15A NCAC 2T .0300; the Division's Gravity Sewer Minimum Design Criteria adopted
February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting data
subsequently filed and approved by the Department of Environment and Natural Resources and
considered a part of this permit;
The sewage and wastewater collected by this system shall be treated in the City of Lenoir's
Gunpowder Creek Wastewater Treatment Facility (Permit No. NC0023736) prior to being discharged
into the receiving stream.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and
binding.

This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T .0300; the Division of Water Quality's
(Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the
Division's Minimum Design Criteria for the Fast-Track Permitting of Pump Stations and Force
Mains adopted June 1, 2000 as applicable; and other supporting materials unless specifically
mentioned herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system-wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0300. if an individual
permit is not required, the following performance,,criteria shall be met as provided in 15A NCAC 2T
.0300:
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan shall be developed and implemented.
d. Pump stations that are not connected to a telemetry system shall be inspected every day (i.e.
365 days per year). Pump stations that are connected to a telemetry system shall be
inspected at least once per week.
e. High-priority sewer lines shall be inspected at least once per every six-month period of time.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g. Inspection and maintenance records shall be maintained for a period of at least three years.
h. Overflows and bypasses shall be reported to the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), 'and public notice shall be provided as required by
North Carolina General Statute §143-215.1'C.., .

4. This permit shall not be transferable. In the:event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be
considered on its merits and may or may not be approved.
5. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State.
6. Upon completion of construction and prior to operation of-these permitted facilities, a certification, a
copy of the construction record drawings, as well as 'supporting design calculations for any pump
stations permitted as part of this project shall be received from a North Carolina-licensed
Professional Engineer certifying that the facilities have been installed in accordance with this
permit; 15A NCAC 2T .0300; the Division's Gravity Sewer Design Criteria adopted February 12,
1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting of Pump
Station and Force Main adopted June 1, 2000 as applicable; and other supporting materials. If this
project is to be completed in phases and partially certified, you shall retain the responsibility to
track further construction approved under the same permit, and shall provide a final certificate of
completion once the entire project has been completed. A copy of the construction record
drawings, indicating the facilities constructed in the phase being certified, shall be submitted with
each partial certification. Mail the Engineer's Certification, one copy of the "Construction Record
Drawings," and one copy of the supporting design calculations to the Non-Discharge Permitting
Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
7. A copy of the construction record drawings shall be maintained on file by the Permittee for the life
of the wastewater collection facilities.
8. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T .0300; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast-Track'Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
10. The issuance of this permit shall not exempt the Permittee from complying with any and all
statutes, rules, regulations, or ordinances that may be imposed by other government agencies
(local, state and federal) which have jurisdiction, including but not limited to applicable river buffer
rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4
and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands
under 15A NCAC 2B .0200 and 15A NCAC 2H .0500.
11. Noncompliance Notification:
The Permittee shall report by telephone to a water quality staff member at the Asheville Regional
Office, telephone number (828) 296-4500, as soon as possible, but in no case more than 24 hours
or on the next working day, following the occurrence or first knowledge of the occurrence of either
of the following:

a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters
without treatment of all or any portion of the influent to such station or facility.
Voice mail messages or faxed information is permissible but this shall not be considered as the
initial verbal report. Overflows and spills occurring outside normal business hours may also be
reported to the Division of Emergency Management at telephone number (800) 858-0368 or (919)
733-3300. Persons reporting any of the above occurrences shall file a spill report by completing
Part I of Form CS-.SSO (or the most current Division approved form), within five days following first
knowledge of the occurrence. This report shall outline the actions taken or proposed to ensure that
the problem does not recur. Per Condition 1(2), Part II of Form CS-SSO (or the most current
Division approved form) can also be completed to show that the SSO was beyond control.

Inspection Summary:
Met with WCU representatives;Terry Rioff, Wiley Danner, Bill Manware, Andy Degrove and Curtis Montieth to check the
sewerline receiving the geothermal drill water from the Harrill Hall construction site. This insepction was not a complete
inspection of the entire WCU Collection System. Aspects of the overall WCU Collection System management were
discussed, but the focus of this inspection was the sewerline associated with Harrill Hall.
The Harrill Hall residence is being built with Geothermal wells for energy efficiency. During the drilling of these
Geothermal wells large quantities of water was encountered. This geothermal drill water was being discharged to the
adjacent stream and causing water quality standard violations.After many attempts to continue the drilling operation,
while maintaining compliance with the surface water quality standards failed, the well drilling contractor was told to stop
drilling. The University and TWSA agreed to allow the drill water to be discharged to the Collection System and the
WWTP for treatment. This is a good viable solution to completing the project and to alleviate the drill water problem.
However, if WCU or TWSA have problems to their systems from the drill water they have the authority to tell the
contractor to discontinue discharging to their system.
Note: Follow up conversation with Andy Degrove indicated the well drilling is completed and preliminary inspections of the
Collection System did not reveal any problems associated with the drill water discharge.

On May 13, 2011, the Environmental Management Commission entered into the subject
Special Order by Consent (SOC) whereby the subject WWTP was granted relaxed effluent
limitations for TSS and Fecal Coliform from those imposed by the NPDES Permit, in exchange
for Murphy's commitment to a schedule of wastewater treatment plant improvements that will
return the WWTP to compliance with the terms of the NPDES Permit. The SOC contains
provisions for the assessment of stipulated penalties'when modified limits are exceeded or
schedule dates are not met.
A review of Murphy WWTP's monitoring report for November 2011 showed the following

You are directed to immediately take whatever remedial actions are necessary to correct the
problems that have led to this violation. Section III of the SOC stipulates that a penalty in the amount
of$2,000 be paid for noncompliance with any modified limit contained in the SOC. However, Section
IV of the SOC lists circumstances under which stipulated penalties are not due, essentially stating
this provision is applicable when the Division of Water Quality can be satisfied the non-compliance
was caused by events or circumstances beyond the control of the Murphy WWTP.
If you have information that will prove to the Division that any or all of the criteria set forth in
Section IV have been met, you must submit this information in writing to the Asheville Regional
Office within ten (10) days after receipt of this notice. In the absence of evidence justifying the
application of the provision within Section IV, this Office will proceed with assessment of stipulated
penalties as provided for in the SOC.

This letter is in follow-up to the NPDES Stormwater Permit Compliance Inspection conducted on
March 22, 2012. Linda Wiggs and I,Asheville Regional Office/Division of Water Quality
(ARO/DWQ), appreciated Nick McCracken's assistance during the inspection(as well as Jim
Giaque and yourself). The facility was found to be in compliance with permit NCS004105.
However, as we discussed after review of the facility, ARO/DWQ recommends the following:
• Better housekeeping and maintenance should be performed at SDO-8 to ensure that coal
dust residue does not discharge during storm events.
• Sediment should be removed from SDO 6-4 to increase detention time, which should lead
to better TSS results.
Enclosed is a copy of the Compliance Inspection Report, which contains additional observations
and comments for your reference. ARO/DWQ will continue to work with Evergreen during the
renewal process for the permit, which expires July 31, 2013.

Inspection Summary:
The individual stormwater permit includes outfalls at the paper mill and outfalls at the landfill. There are 9 stormwater
discharge outfalls (SDOs)at the mill and 18 SDOs at the landfill. During the previous permitting cycle, Evergreen was
given representative outfall status(ROS)on several outfalls. Currently, Evergreen is monitoring SDOs 1-9 at the mill and
SDOs 6-4 and 6-10 at the landfill
This permit is also unusual in that Camp Branch runs through the north side of the plant and Mingus Branch runs through
the south side of the plant(and Evergreen is required to monitor upstream and downstream of these branches). The
Pigeon River bisects the mill, but is bermed on both sides and has no outfalls other than those identified.
At the landfill, many outfalls are in stabilized drainage areas (and DWQ agrees with the ROS for those); SDO 6-4 and
SDO 6-15 appear to comprise the most active areas.
SDO 6-4 captures the entrance area of the landfill (and TSS values have been elevated in the past). At the time of the
inspection, the basin appeared to have an amount of sediment(and Evergreen was aware that it would be prudent to
remove the sediment and obtain greater detention). The ARO will recommend that this SDO continue to be monitored
with the upcoming permit renewal.
SDO 6-10 generates from a stabilized area near the leachate lagoons (which are pumped to the WWTP). DWQ will
recommend that analytical monitoring be suspended at this outfall upon the next permit renewal; due to this area being
stabilized,flow does not occur regularly.
SDO 6-15 encompasses the landfill cell currently in use. DWQ recommends that Evergreen begin analytical sampling
(qualitative sampling is being performed now)at this outfall. ARO/DWQ will recommend that this outfall be designated as
a Representative Outfall for qualitative and analytical sampling during the upcoming permit renewal.
Evergreen is aware that the area near SDO 6-17 and-18 is in need of maintenance (some rills and bare spots as this is a
newly planted area and just recently covered).
At the mill, much of the exposure area for the entire process plant,the WWTP, and the chip pile drains to the storm sewer
and is routed back to the WWTP. The drainage areas that don't drain to the storm sewer system are designated as
SDOs.
ARO/DWQ will recommend that SDO-9 be elimated (it encompasses only a parking area).
SDO-8 needs maintenance and better housekeeping practices. At the time of the inspection, there appeared to be
pathways in which coal/dust migrated directly to the drop inlets and out SDO-8. This could ultimately contribute to
adverse color and elevated TSS levels. The access road near this area was also experiencing some erosion which
should be corrected.
DWQ/ARO will discuss the need for monitoring of SDO-14 upon permit renewal. This outfall does not experience flow.
DWQ/ARO will work with Evergreen during the permit renewal process. DWQ will evaluate this permit to ensure it is
consistent with similar permits. Evergreen may wish to do preliminary monitoring on Mingus Branch for COD (and
continue with TSS).

This letter is in follow-up to the NPDES Stormwater Permit Compliance Inspection conducted on
March 20, 2012. Linda Wiggs and I, of the Asheville Regional Office/Division of Water Quality
(ARO/DWQ), appreciated the assistance of Josh Carnes, Environmental Manager, during review
of the site. The facility was found to be in compliance with permit NCS000295.
Enclosed is a copy of the Compliance Inspection Report, which contains additional observations
and comments for your reference.
ARO/DWQ recommends that the chip piles be moved approximately 25 feet from surface water
conveyances. This may,help to alleviate elevated benchmark values when sampling. Due to the.
older infrastructure at the plant, Jackson Paper should continue to evaluate any illicit discharges.
ARO/DWQ will work with DWQ's Raleigh Central Office through the renewal process to try to
reduce some of the required monitoring. Jackson Paper has performed ample sampling in the past
3 years and DWQ appreciates the efforts made at the plant. In order for this to be successful,
Jackson Paper should continue to practice good housekeeping and make continued efforts to
reduce pollutant contributions to surface waters.

Inspection Summary:
Susan Wilson and Linda Wiggs(ARO/DWQ)met Josh Carnes of Jackson Paper on March 20, 2012. Jackson Paper is
currently under an individual stormwater permit(effective May 1, 2009)which requires analytical and qualitative
monitoring on a monthly basis. Jackson Paper has diligently performed their required monitoring.
They have also conducted upstream and downstream monitoring, as well as an upstream DOT culvert that flows through
the site. Although some benchmarks have been exceeded-there is no direct correlation to instream values. Jackson
Paper has made modifications to the site to prevent excess runoff that may have been contributing to the elevated values
(particularly near the ditch line at the west of the property near the DOT culvert).
SDO-001 -this outfall is essentially the front parking area of the facility. There is a small area that may have some
exposure-but the majority of stormwater contribution comes from the drainage and runoff of the main highway that runs
in front of the plant. After conversations with Josh, there is not an adequate way to eliminate the highway runoff that this
outfall is receiving. ARO/DWQ will recommend to the Central Office that monitoring for this outfall be reduced or
eliminated-and good housekeeping practices be maintained in this area. This outfall has had some exceedances-that
were likely attributed to road runoff and/or the filter that was used in the drop inlet.
SDO-002-this outfall is basically a previous drainage/stream that has been culverted beneath the plant. This outfall has
only had a few turbidity exceedances in the past 2 years. DWQ/ARO will recommend to the Central Office that monitoring
for this outfall be reduced or eliminated.
SDO-003-this outfall receives the majority of flow around the chip piles (which are used for fuel at the plant). It has had
some elevated values. Jackson Paper is working to slow down some flow and provided some protection for this outfall.
Even though some of the values for this outfall have been elevated-they do not appear to be having an adverse effect on
Scott's Creek(based on pre-and post-sampling). ARO/DWQ will recommend that monitoring be reduced at this outfall.
ARO does recommend that Jackson Paper move chip piles approximately 25 ft away from surface water conveyances.
This may help reduce some elevated values. As stated previously,ARO also recommends that any illicit discharges be
identified.
In addition, ARO/DWQ does not expect Jackson Paper(Josh)to obtain samples in the middle of the night. It is
appropriate to mark"no flow"during a month if samples cannot be obtained during regular business hours.

improve the stormwater discharge outfalls (and this was noted with the permit renewal

possibility of monitoring reduction, elimination, or Representative Outfall Status (ROS)
at the facility.

Some of the smaller pump stations(Deerlake and Keystone Camp)were also inspected with no problems noted. No
problems were noted with any of the manholes that were inspected.
Even though all paper work is available in a work order format, it is suggested that cleaning records, routine inspection of
pumpstations, manholes, etc., be either kept separately or in a manner so they are easier to locate. An email will be sent
with several attached forms to assist you in this process should you chose to use them.
Updating the collection system map is an ongoing process.
Brevard has made good progress in operations and maintenance of the collection system with more I & I work planned.

The Division of Water Quality (DWQ)has performed a preliminary review of a 401 Water Quality Certification
application submitted for the above referenced property. Additional information will be required in order to
complete the review process.
Please provide the following information so that we may continue to review your project.
Additional Information/Clarification Requested:
1. The design drawings and application information do not provide detail regarding how the
proposed dimension,pattern, and profile of the restored stream have been determined. A typical
stream restoration design checklist has been attached with this letter. Please provide values for
channel morphology, floodplain structure,hydrologic &hydraulic analysis, in-stream structures,
habitats and vegetation, and site/watershed conditions. If the target values listed are not, or
cannot be met,please explain why. Riffle stone sizing should mimic the reference stream. As
you and your design engineer are aware, if target values are not met, a restored stream project
may be more subject to failure in the future.
2. No reference reach information has been provided. This must be provided as part of the stream
restoration information.
3. It is DWQ's understanding that two additional parcels are to be acquired by the Town(and those
parcels are part of the stream restoration area). Please clarify when those parcels will be
acquired and what sections of the stream restoration are affected. If those parcels are not
acquired in a timely fashion,the project cannot be issued as designed.

4. DWQ records indicated that the area of restoration, an unnamed tributary to Wash Creek, is
classified as a`B"waterbody, not"C" as noted in the application [ref Stream Index No. 6-55-7]'
5. There was some discussion during the on-site visit regarding modification of the intake for the
existing lake. Please provide information as to if that modification will be performed as part of
this work.
With regard to the stormwater outfalls (near the existing stream reach),the DWQ will require monitoring of
those outfalls (as a condition of the 401 WQC)to ensure that flow is not re-concentrating and causing erosion of
the restored stream buffer.

Order by Consent (SOC)whereby the subject WWTP was granted relaxed effluent limitations for TSS and
Fecal Coliform from those imposed by the NPDES Permit, in exchange for Murphy's commitment to a
schedule of wastewater treatment plant improvements that will return the WWTP to compliance with the
terms of the NPDES Permit. The SOC contains provisions for the assessment of stipulated penalties when
modified limits are exceeded or schedule dates are not met.

You are directed to immediately take whatever remedial actions are necessary to correct the
problems that have led to this violation. Section III of the SOC stipulates that a penalty in the amount of
$5,000 be paid for noncompliance with any modified limit contained in the SOC. However, Section IV of the
SOC lists circumstances under which stipulated penalties are not due, essentially stating this provision is
applicable when the Division of Water Quality can be satisfied the non-compliance was caused by events
or circumstances beyond the control of the Murphy WWTP.
If you have information that will prove to the Division that any or all of the criteria set forth in Section
IV have been met, you must submit this information in writing to the Asheville Regional Office within ten
(10) days after receipt of this notice. In the absence of evidence justifying the application of the provision
within Section IV, this Office will proceed with assessment of stipulated penalties as provided for in the
SOC.

Inspection Summary:
Facility is compliant but still has deficiencies that will be fixed. The illegal discharge from the garage no longer is allowed
to have flow. They have removed the roof drains from this discharge and are no longer doing any washing inside. So they
have done their best at this point to not have a discharge from this pipe, hence no analytical. At the discharge point there
is evidence of previous staining from oils but did not appear to have any recent impacts.
The plan is in 2 years to be able to install a wash pad with drains that flow to an oil/water seperator and tie the discharge
pipe to this same system.Also to do a pump and haul with the current pump and haul service for the oil/water seperator
once installed. Once all this is completed facility may decide to apply for a No Exposure.

This letter is in follow-up to the NPDES Stormwater Permit Compliance Inspection conducted on
March 27, 2012. The facility is working towards compliance with permit NCG120067. The
facility has complied with the conditions of Notice of Violation (NOV) issued March 22, 2011.
Sampling as required by the NOV at the outfalls was sporadic due to flows. The facility is no
longer under the NOV, but is still required to perform increased monitoring until further notice.
Below is a discussion of the continued requirements for the landfill.
Regarding submittal of the Monitoring Reports to the Regional Office, the analytical results shall
still be submitted; however the Qualitative Reports no longer need to be submitted. The
Qualitative Monitoring Requirements (table 4) still stand but submittal is no longer required.
In order to obtain sufficient analytical data, to gauge management strategies, the facility was
instructed that sampling can be performed if a discharge is taking place regardless of the 30 minute
timeline requirement. Footnote #2 in Table 1 is waived, which basically states that samples from
ponds shall be taken within the first 30 minutes of discharge from the pond. If a discharge from
any of the outfalls is occurring samples may be obtained even if it is outside of the first 30 minutes
of discharge. It is also not necessary for the facility to wait 72 hours between storm events.
Landfills tend to have elevated numbers due to lack'of housekeeping, ground cover or
maintenance, if these are the issues sampling outside these restraints is not going to change the
numbers significantly. It is more important to get data in order to gauge if improvements are
working or not.

SDO #1: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point(SWMP)#1 is the
discharge from the shop area. Because the facility has disconnected the roof drains and no longer
uses the illicit discharge from the building, obtaining.samples from this discharge is unlikely. This
discharge is associated with the NCG080678 permit.' See NCG080678 inspection report for
comments.
SDO#2: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point(SWMP) #2 is the
discharge from the transfer station area. To date one sample set has been obtained from the
outfall, it was collected on 9/6/2011 and only included COD and TSS parameters. There have not
been any Fecal Coliform numbers reported for this outfall. The outfall discharges to a large
headcut. If possible large stone can be placed at the base of this headcut in attempt to stabilize.
However, do not attempt to bring heave equipment into the valley to access the headcut as this will
only further destabilize the area. This outfall needs to continue being sampled monthly until more
data is obtained to establish compliance.
SDO#3: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #3 is the
basin#SB-2A discharge. The facility has been able to get sample results from this SDO. Fecal
Coliform is elevated. It is unclear what the facility can do to lower these numbers. The elevated
numbers could be from wildlife or from subsurface flows from the old unlined landfill reaching the
basin. The TSS numbers are also elevated. Landfill'personnel have ideas of how to reduce these
numbers. Two suggestions from the inspector are to fix erosion at the inlet pipes as noted in photo
41 and to install a device (baffles,etc)to alleviate short circuiting of flows to the outfall from the
inlet pipe on side of basin as noted in photo Q. Sampling at this outfall should continue on a
monthly basis until the TSS number decline. J
SDO#4: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP)#4 is the
basin#SB-lA discharge. The facility has also been able to sample from this SDO. As noted
above, it is unclear what the facility can do to reduce the fecal coliform numbers; they are likely
from the old landfill cell or wildlife. Improvements from last inspection to this drainage area,
specifically the drainage ditch, appear to have been successful. Sampling at this outfall can resume
under the semi-annual monitoring schedule in Table 2 of the permit.
SDO#5: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point(SWMP) #5 is the
drainage area at the north end of the site housing the compost piles, etc. Two traps converge flows
via a ditch to the outfall. Personnel need to continue sampling this outfall monthly to establish
compliance.
SDO#6: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #6 is the
trap#ST-3 located near SB-2A. Sampling at this outfall needs to continue monthly as well.
SDO#7: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #7 is the
new outfall at the north end of the property. If TSS is elevated at next sampling event then
monthly monitoring at this outfall will be required.

waters classified as C-trout;Outstanding Resource Waters of the State in the project study area. The
water quality classification of C-trout; ORW is one of the highest classifications in the State.
NCDWQ is extremely concerned with any impacts that may occur to streams with this classification.

General Comments Regarding Bridle Replacement Proiects
1. NCDWQ is very concerned with sediment and erosion impacts that could result from these projects.
NCDOT shall address these concerns by describing the potential impacts that may occur to the
aquatic environments and any mitigating factors that would reduce the impacts.
2. If foundation test borings are necessary; it shall be noted in the document Geotechnical work is
approved under General 401 Certification Number 3687/Nationwide Permit No. 6 for Survey
Activities.
3. Any Bridge considered a Low Impact Bridge Project must fall under Nationwide Permit No.3 to
qualify for Low Impact; otherwise, standard permitting procedures will be required.Example
(Regional General Permit No. 31,Nationwide Permit No. 23,Nationwide Permit No. 13, etc.)

4. NCDOT is respectfully reminded that all impacts, including but not limited to,bridging, fill,
excavation and clearing, and rip rap to jurisdictional wetlands, streams, and riparian buffers need to
be included in the final impact calculations. These impacts, in addition to any construction impacts,
temporary or otherwise, also need to be included as part of the 401 Water Quality Certification
Application.
5. Where streams must be crossed,NCDWQ prefers bridges be used in lieu of culverts. However,we
realize that economic considerations often require the use of culverts. Please be advised that culverts
should be countersunk to allow unimpeded passage by fish and other aquatic organisms. Moreover,
in areas where high quality wetlands or streams are impacted,a bridge may prove preferable. When
applicable,NCDOT should not install the bridge bents in the creek,to the maximum extent
practicable.
6. Whenever possible,NCDWQ prefers spanning structures. Spanning structures usually do not require
work within the stream or grubbing of the stream banks and do not require stream channel
realignment. The horizontal and vertical clearances provided by bridges shall allow for human and
wildlife passage beneath the structure. Fish passage and navigation by canoeists and boaters shall not
be blocked. Bridge supports(bents) should not be placed in the stream when possible.
7. Bridge deck drains shall not discharge directly into the stream. Stormwater shall be directed across
the bridge and pre-treated through site-appropriate means(grassed swales,pre-formed scour holes,
vegetated buffers,etc.)before entering the stream. Please refer to the most current version of
NCDWQ's Stormwater Best Management Practices.
8. Sediment and erosion control measures should not be placed in wetlands or streams.
9. Strict adherence to the most recent version of NCDOT's Best Management Practices For Bridge
Demolition and Removal approved by the US Army Corps of Engineers is a condition of the 401
Water Quality Certification.
10.Bridge piles and bents shall be constructed using driven piles(hammer or vibratory)or drilled shaft
construction methods.More specifically,jetting or other methods of pile driving are prohibited without
prior written approval from NCDWQ first.
11.No drill slurry or water that has been in contact with uncured concrete shall be allowed to enter surface
waters. This water shall be captured,treated,and disposed of properly.
12. All pile driving or drilling activities shall be enclosed in turbidity curtains unless otherwise approved by
NCDWQ in this certification.
13. All bridge construction shall be performed from the existing bridge,temporary work bridges,temporary
causeways, or floating or sunken barges. If work conditions require barges,they shall be floated into
position and then sunk. The barges shall not be sunk and then dragged into position.Under no
circumstances should barges be dragged along the bottom of the surface water.
14. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP
measures from the most current version of NCDOT Construction and Maintenance Activities manual
such as sandbags,rock berms,cofferdams and other diversion structures shall be used to prevent
excavation in flowing water.

15. If concrete is used during construction,a dry work area shall be maintained to prevent direct contact
between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall
not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and
fish kills.
16. Heavy equipment shall be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the introduction of other pollutants into the stream. This equipment
shall be inspected daily and maintained to prevent contamination of surface waters from leaking fuels,

17. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction
contours and elevations. Disturbed areas shall be seeded or mulched to stabilize the soil and
appropriate native woody species shall be planted. When using temporary structures the area shall be
cleared but not grubbed. Clearing the area with chain saws, mowers, bush-hogs, or other mechanized
equipment and leaving the stumps and root mat intact allows the area to re-vegetate naturally and
minimizes soil disturbance.
18.Borrow/waste areas should avoid wetlands to the maximum extent practical. Impacts to wetlands in
borrow/waste areas will need to be presented in the 401 Water Quality Certification and could
precipitate compensatory mitigation.

20. Unless otherwise authorized,placement of culverts and other structures in waters and streams shall be
placed below the elevation of the streambed by one foot for all culverts with a diameter greater than
48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches,to
allow low flow passage of water and aquatic life. Design and placement of culverts and other
structures including temporary erosion control measures shall not be conducted in a manner that may
result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down
stream of the above structures. The applicant is required to provide evidence that the equilibrium is
being maintained if requested in writing by NCDWQ. If this condition is unable to be met due to
bedrock or other limiting features encountered during construction,please contact NCDWQ for
guidance on how to proceed and to determine whether or not a permit modification will be required.
21. If multiple pipes or barrels are required,they shall be designed to mimic natural stream cross section
as closely as possible including pipes or barrels at flood plain elevation,floodplain benches,and/or
sills may be required where appropriate. Widening the stream channel should be avoided. Stream
channel widening at the inlet or outlet end of structures typically decreases water velocity causing
sediment deposition that requires increased maintenance and disrupts aquatic life passage.
22. Sediment and erosion control measures sufficient to protect water resources must be implemented and
maintained in accordance with the most recent version of North Carolina Sediment and Erosion Control
Planning and Design Manual and the most recent version of NCS000250.

23. hi most cases, the NCDWQ prefers the replacement of the existing structure at the same location with \
road closure. If road closure is not feasible, a temporary detour shall be designed and located to avoid
wetland impacts,minimize the need for clearing and to avoid destabilizing stream banks. If the
structure will be on a new alignment,the old structure shall be removed and the approach fills removed ` J
from the 100-year floodplain. Approach fills shall be removed and restored to the natural ground
elevation. The area shall be stabilized with grass and planted with native tree species. Tall fescue shall
not be used in riparian areas.
Thank you for requesting out input at this time. NCDOT is reminded that issuance of a 401 Water Quality
Certification requires that appropriate measures be instituted to ensure that water quality standards are met

This letter is in follow-up to the NPDES Stormwater Permit Compliance Inspection conducted on
March 15, 2012. This was the first inspection performed at this facility by the Division of Water
Quality. There were permit requirement deficiencies that the facility needs to address. The two
primary areas that need your attention are the Stormwater Pollution Prevention Plan and the
- Analytical and Qualitative Monitoring. Below is a discussion to assist you with compliance.
Stormwater Pollution Prevention Plan (SPPP):
A Stormwater Pollution Prevention Plan is basically a,paper trail or a document of what is
happening at the facility. Representatives need to review the Stormwater Permit and refer to Part
III, Section A (Part III Page 1 of 16 thru Page 4 of 16) Stormwater Pollution and Prevention Plan
(SPPP) for the required component of the SPPP. The McCrary Quarry needs to develop this
document, it is likely that you already have many of the components of the SPPP onsite or
available but have not pulled them together in a document. A couple of particularly important
areas of this SPPP for you to work on will be an up to date Site Plan(Part III Section A#1), and
the BMP Controls Inspection and Maintenance (Part II.I Section A#3.(b)).
Analytical and Qualitative Monitoring:
It is a permit requirement that Stormwater Discharge Outfall (SDO) locations be monitored for
pollution sources. You indicated you were told the quarry did not have any SDOs that needed to
be monitored. Determining what is and what is not a SDO for some mining operation can be
complicated. A SDO is anywhere that stormwater or wastewater leaves your site and is conveyed
to a waterbody. Your facility has three (3) SDO locations; with your proposed expansion there
will be more locations. Currently there is an upper SDO near the entrance, a mid SDO along the
road near the shop access and a lower SDO near the creek/railroad area. See the attached overview
for reference.

Analytical Monitoring requires samples be obtained during a rainfall event at each SDO. Of the
three SDOs you currently have, you will need to perform Analytical Monitoring (Part III Section B
Table 1)only at the lower SDO. See the attached SDO reference for assistance. As I mentioned
during the inspection I don't see this SDO having compliance issues. You should be able to meet
the permit benchmark numbers at this outfall as long as the watering area is maintained and does
not become rutted out. The other two SDOs do not have to be Analytically Monitored at this point
because the water is being discharged in a dispersed overland flow pattern with considerable
distance to the nearby stream. If your discharge were to cause an eroded gully that carried the
water directly down the mountain to this stream you would have to perform Analytical Monitoring
at the other two SDOs. So it is important to keep an eye on the other two SDO to make sure this
does not happen. This brings me to the Qualitative Monitoring requirement. Qualitative
Monitoring is a visual observation of your SDOs during rainfall events. This Qualitative
Monitoring (Part III Section D)has to take place at all your SDOs.
Representatives have to begin this monitoring program, which is required to take place twice a
year. The required timeline for the next sampling and observation event has to take place by the
end of June to be compliant with the permit requirements. Once you have completed the
monitoring and received your sample results please submit your Analytical and Qualitative
Monitoring forms to my attention at the email listed below or by mailed to my attention at DENR-
DWQ, 2090 HWY 70, Swannanoa NC 28778.

An outfall, a SDO, is where stormwater or wastewater leaves the site and has a direct
conveyance to a waterbody. The upper and mid SDOs can be observed by Qualitative
Monitoring instead of Analytical Monitoring as long as gullies do not form down the
slope creating a discrete conveyance to the nearby stream. These SDOs could be
granted Representative Outfall Status (ROS) if the owner would like to submit a request.
The lower SDO should be monitored Analytically and Qualitatively where the outfall from
the small wetland enters the stream (Tillery Crk).
