Based on your responses, items 2a -c, 3, 4, 5, and 7 have been resolved. However, the following items require additional clarification: 1a. The Corps appreciates your efforts to reduce wetland impacts. However, direct wetland impacts are still proposed for Lots 29, 71, and 72, with no indication of efforts to avoid or minimize impacts to Wetland Area 3 as required by NWP General Conditions 23(a) and (b); 1b. The Corps recognizes your efforts to incorporate retaining walls into upland areas in Lots 103-106 in order to avoid direct wetland impacts. As you did for Lot 53, please show the retaining wall location for these Lots of the plan sheets; 1c. It is unclear how the bypass offsite storm sewer outfall will retain hydrology to the remainder of Wetland Area 2 such that it will remain jurisdictional after Lot development. Given that the outlet is down - gradient of the portion of Wetland Area 2 between Lots 57 and 103, it is apparent that this area would become an indirect wetland impact by removal of hydrologic input once the proposed up -gradient road in constructed; 6. Has a delineation of potential waters of the US been completed in the project area of the proposed 40' bore under the continuation of Stream T1 (outside of the PJD Review Area)? Given the extent of wetlands on the reminder of the site, it is likely that wetlands occur adjacent to this portion of Stream T1 as well, extending beyond a 40' bore length. The same concerns goes for the proposed temporary impact area at Back Creek near the tie-in with the existing sewer. Please provide information on how you determined the extent of potential waters of the US in these areas. If no on-site delineation was conducted, please do so and provide the relevant information for the Corps' evaluation. Please submit the requested information above (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file.
