A stream system with adjacent wetlands and ponds flows along the eastern property boundary. The offsite sewer easement lies between this stream system (UT to Basal Creek) and moderate -density residential land and existing sanitary sewer easement. General land use in the vicinity of the project is a mix of agricultural, residential, and industrial. 4b. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts could be avoided & minimized to the mabmum extent practicable. The only proposed permanent loss impact for the project are two (2) non -forested wetland fingers (Impacts W1 -3A & W1 -4A) for a stormwater control measure (SCM). The applicant is proposing to utilize a Nationwide Permit 18 for this 0.07 acres of wetland fill, and is proposing compensatory mitigation at a 2:1 ratio. In addition to the permanent loss impacts for the SCM's, the applicant is proposing temporary wetland impacts for construction activities (Impacts W1 -3B & W1 -4B). All other proposed wetland impacts onsite and offsite are for a sanitary sewer connection. Proposed wetland impacts within the permanent maintenance corridor were identified as "permanent -no permanent loss" impacts and compensatory mitigation at a 1:1 ratio is being proposed. On the southern side of the property, connecting sanitary sewer from Phase 1 to Phase 3, the applicant is proposing the Bore & Jack construction method within a high quality wetland. Temporary wetland impacts are proposed on either side of the permanent maintenance corridor to allowfor construction activities and equipment turn -around. Offsite at the northern most portion of the sanitary sewer connection, there is a proposed temporary stream impact for an open -cut sanitary sewer impact. And finally, the remaining impacts are to riparian buffers. Compensatory mitigation is proposed for all parallel (non -perpendicular) riparian buffer impacts to Zone 1, minus the areas where wetland mitigation is being proposed. The offsite sanitary sewer connection was along an eAsting easement, the easement was shifted to avoid/minimize impacts to wetland and Zone 1 riparian buffer to the ma>amum e)dent practicable. The entire offsite utility easement resides behind eAsting residential so avoidance of all impacts was not feasible. Temporary wetland impacts will be brought back to pre - construction contours and re -vegetated with a wetland seed mix, and the temporary stream impact will be brought back to pre -construction stream bed elevation and the stream banks will be stabilized. 1b. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Briar Gate Subdivision project is a residential development. Additionally, the project is located within Fuquay-Varina jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; and finally 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements.
