Subject: DWR# 2017-1279 Durham Co EAP New Hope Creek Interceptor.
Good Morning Shelton,
The City of Durham is proposing to add an empty pipe casing under 40 within the DOT ROW parallel to the recently
permitted New Hope Creek Interceptor.
The pipe will be plugged at both ends.
No new impacts are proposed. The pipe will be installed within the permitted limits of disturbance.
Please see the attached correspondence with the USACE.
We just wanted to notify you that are plans have changed to include installing the second pipe.

However please modify before impacts. And note if the mitigation amounts change, the $$ will change as well. And if
they have new fees at that time, there may be a higher fee as well. Just something to consider.
Note the 401 expires on the same date as when the 404 expires.

Modify before the current 404 permit and 401 WQC expire. If the project extends longer, request and extension to the
USACE. But you can modify anytime before expiration. See the expiration dates on the 404 and 401 documents.

Shelton I was asking if there is a time line for how long after a permit has been issued can it be modified not approved?
When I told my client I was ready to submit the modification he told me the City had not decided yet whether to do the
modification or to permit it as a separate project later.
So my concern is they could wait a year and then ask me to submit a modification. Can they still modify a permit that
long after it has been approved or is there an expiration date as to when a permit can no longer be modified and would
need a new PCN as a separate project? Or can it be modified at any time while it is still open?

Same time by statute. 60 Days with complete application. But if all the info is there, 30-45 max, probably less. A lot on

The 401 and BA issued is valid and will be replaced once the modification is issued. Again, need to update the mitigation
info, plans, specifications.
Just send a cover letter noting the original DWR # and MODIFICATOIN for additional Buffer Impacts ONLY. No fee
required.
Describe that the only changes are to the Buffer impact location number...., describe impacts, include plan sheets,
mitigation letter to account for the total new impacts.
You can ask in the letter that I do the review since I issued the first one.
