Existing culvert in ground is 120 feet will be adding 20 feet. This is a total of 140 feet of culvert. At that time we will slope
the banks to meet the head wall. When installing culvert the stream will be damned up and pumped around to keep
bottom of creek dry.

The existing slopes are temporary until weather permits to continue the Sugar Hill project. When weather permits a one
section
of pipe and pre -form head wall will be installed. At that time the slope will be addressed.

Checks should be made out to the "NC Division of Water Quality", with the specific name of the project or applicant
identified on the check. Please staple your check to the front of the application package.
The required fees are as follows:
Major water quality applications: $570
Greater than or equal to one acre of wetlands/waters AND/OR Greater than or equal to 150 feet of streams
(whether intermittent or perennial)
Minor water quality applications: $240
Less than one acre of wetlands/waters AND Less than 150 feet of streams (whether intermittent or perennial)

Mr. Gurley,
The PCN application you submitted on 11-26-18 is not solely for the record — written approval from DWR and USACE is
required. William Elliott indicated that USACE will be issuing a NW39 permit and DWR will be issuing corresponding
General Certification 4139.
Because this PCN is associated with a Notice of Violation, issued by DWR in November, written approval is required. See
paragraph J on page 2 of the attached GC4139.pdf document and below:

On November 26, 2018, the Division of Water Resources (Division) received your application dated November 26, 2018,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that
your application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:
• A fee of $240.00 is required with the PCN application. That can be submitted online or mailed in to the Raleigh
DWR office, as was discussed in previous emails.
• The application does not address DWR's concerns regarding the stability of the steep slope of the stream channel
above the new culvert, as well as the headwall of the culvert. The Notice of Violation issued to you required that
these issues be addressed in the Pre -Construction Notification form.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper
consideration of the application. Please provide a response by January 14, 2019.
