On August 9, 2002 the Division of Water Quality received your, Notice of Intent (NOI) requesting coverage under- general wastewater permit NCGI60000. A review of the application materials shows that the drainage from the sediment pond will be diffused through a level spreader apparatus- Since this type of discharge is designed to produce sheet flow rather than a point source discharge it is not subject to stormwater permitting at this time. If after, the system is installed the level spreader does not work properly and does indeed pinduce a channelized, point source, flow it will become subject to stoimwater permitting regulations. No worries Rick -- thank you for looking into this for us. Both of these facilities are within the Raleigh Regional Office territory (specifically, the one for which they have the 2003 exemption letter is located in Kittrell). I discussed this with them last week and they had proposed that they just go ahead and apply for permits for both of the facilities anyway, to be on the safe side (since we assumed that the level spreader exemption was no longer applicable).
