(1) For a corporation: by a responsible corporate officer. For the purpose of this permit, a responsible corporate officer means: (a) a
president, secretary, treasurer or vice president of the corporation in charge of a principal business function, or any other person who
performs similar policy or decision making functions for the corporation, or (b) the manager of one or more manufacturing production or
operating facilities employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter
1980 dollars), if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
(2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or
(3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected
official.
Certification: North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of
a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly renders inaccurate
any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental

On August 9, 2002 the Division of Water Quality received your, Notice of Intent (NOI) requesting
coverage under- general wastewater permit NCG160000. A review of the application materials shows that the
drainage from the sediment pond will be diffused through a level spreader- apparatus- Since this type of
discharge is designed to produce sheet flow rather than a point source discharge it is not subject to stormwater
permitting at this time.
If after the system is installed the level spreader- does not work properly and does indeed produce a
channelized, point source, flow it will become subject to stormwater permitting regulations_

No worries Rick — thank- you for looking into this for us. Both of these facilities are within the Raleigh Regional Office territory
(specifically, the one for which they have the 2003 exemption letter is located in Kittrell). I discussed this with them last week and
they had proposed that they just go ahead and apply for permits for both of the facilities anyway, to be on the safe side (since we
assumed that the level spreader exemption was no longer applicable). Let me know your thoughts on this and whether you agree
with that plan.

perspectitic of level spreaders being point sources after that date.

decide on if our view has changed or not on if a permit is needed_ Do you know what Regional Office that is in?

NCDEQ Stonnwater decided that sites that have both Concrete and Asphalt operations could just have the NC G14 permit since
most of the sampling requirements are the same but the Concrete (NCG14) has better requirements. And to keep the permittee
