Dear Mr. Havens:
The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification and Jordan
Buffer Authoriza[ion, for [he aforementioned projecL Review of your applica[ion revealed it lacking necessary
information required for making an infortned permi[ decision. The permit application was deficient in the followin�
areas:
1. Permit Impact Drawings do not indicate any Stormwater BMPs. Per ISA NCAC 02H .0507(d)(2) and ISA
NCAC 02H .0506(b)(5), bridge deck drains shall not discharge directly into surface waters. Stormwater shall be
direc[ed across the bridge and pre-trea[ed through site-appropriare means (grassed swales, pre-formed scour holes,
vegetated buffers, etc.) before entering [he s[ream. Addi[ionally, per 15A NCAC 2B.0267,a1I s[ormwater runoff
shall be directed as sheetFlow throu�h buffers at non-erosive velocities. Please submit revised permit drawings
showing that these requiremen[s are being met in order for DW R to approve these impacts.
2. While the permit impact drawines do show [he reques[ed 0.04 acres of wetland impact, they do not show [he
proposed 19,833 square feet of Jordan Buffer Impact requested. Please submit revised permit drawings showing the
location ofthe proposed buffer impacts.
3. The application indica[es [hat impac[s will be occurzing in property owned by the Sta[e ofNorth Carolina as a
trac[ indica[ed as Ihe I.ittle Beaver Creek Conserva[ion Easement. '1'he footprint in the conserva[ion easement is
indicated in the application as approximately 2.06 acres. Please provide a written approval for this encroachment
from the agency in charge of managing this conserva[ion easement, to verify thal the Town of Apex can build Ihis
road on this property.

supplied the necessary information. You have 21 days [o respond in writing wi[h [he reques[ed information or
notification to this office that the information is forthcoming. I I; at [he end of the 21 days, Ihis ottice has not
received [his informa[ion in wri[ing, we will assume you are withdrawing your applica[ion and it will be returned.
Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of this
letter) that the US Army Corps of Engineers place the permit applica[ion on hold.
