Dear Mr. Havens:
The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification and Jordan
I3uffer Authorization, for the aforementioned projecC Review of your application revealed it lacking necessary
information required for making an inCormed permit decision. The permit application was deficien[ in the following
areas:
1. Pennit Impact Drawings do not indicate any Stormwater BMPs. Per ISA NCAC 02H .0507(d)(2) and ISA
NCAC 02H .0506(b)(5), bridge deek drains shall not discharge directly into surface waters. Stormwater shall be
directed across the brid�e and pre-treated through site-appropriate means (grassed swales, pre-formed scour holes,
vegetated buffers, etc.) before entering [he stream. Additionally, per I SA NCAC 26.0267,a11 stormwa[er runoff
shall be directed as shee[Flow through buffers at non-erosive velocities. Please submit revised permit drawings
showing that these requirements are being met in order for DW R to approve these impac[s.
2. While the permit impact drawin�s do show [he requested 0.04 acres of wetland impact, they do not show [he
proposed 19,833 square feet of Jordan Buffer Impac[ requested. Please submi[ revised permit drawings showing [he
location of [he proposed buffer impacts.
3. The application indica[es that impacts will be occurring in property owned by the S[a[e of North Carolina as a
tract indica[ed as the Litde Beaver Creek Conservation Easement. The footprint in the conserva[ion easemen[ is
indicated in the application as approximately 2.06 acres. Please provide a written approval for Ihis encroachment
from the agency in charge of managing this conservation easement, to verify that the Town of Apex can build this
road o� this property.

Therefore, pursuant to ISA NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are
supplied the necessary information. You have 21 days ro respond in writin� with the requested information or
notitication to this office that the information is forthcoming. If, at the end of [he 2I days, this office has not
received [his informa[ion in writing, we will assume you are withdrawing your applica[ion and i[ will be re[urned.
Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of Ihis
letter) tha[ [he US Army Corps of Engineers place [he permit application on hold.
