This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. The Division understands that you have made no significant changes to your facility since the last permit renewal. We have made the following updates for the permit renewal: 1. Regulatory citations have been added to the permit. 2. The facility map has been updated. 3. The facility classification Grade IV Biological Water Pollution Control System has been added to the effluent page. 4. Total Phosphorus (TP) effluent limits have been changed from Monitor & Report to 2.0 mg/L (weekly average) per the Neuse Permitting Summary Feb 2013. 5. Section A. (7.) has been added to reflect current language regarding electronic submission of effluent data. Federal regulations require electronic submittal of all discharge monitoring reports (DMRs). 6. The NC 2007-2014 Water Quality Standard (WQS) Triennial Review was approved by the NC Environmental Management Committee (EMC) on November 13, 2014. The US EPA subsequently approved the WQS revisions on April 6, 2016 with some exceptions. The NC Division of Water Resources is required to implement the new dissolved metal standards in all permits public noticed after April 6, 2016. The new standards for most metals include acute standards. Furthermore, the freshwater standards for several metals are expressed as the dissolved form of the metals, and seven metals have hardness -dependent equations. As a result, the Division will need site -specific effluent hardness data and instream hardness data, upstream of the discharge, for each facility monitoring these metals in order to calculate permit limitations. The metal of concern for this permit renewal is Zinc. To evaluate dissolved Zinc, a Reasonable Potential Analysis (RPA) was conducted using data reported on DMRs from November 2015 to March 2018. The Acute value is typically used as the daily maximum limit and Chronic value is typically used as the monthly average limit. However, the Chronic value for Zinc is less stringent. The monthly average limit must be more stringent or equal to the daily maximum limit. Therefore, the daily maximum limit and monthly average limit for Zinc will be the Acute value as follows: Parameter Outfall Monthl. Averaget Dail Maximum Limit Zinc 001 125.7 µg/L 125.7 µg/L Please note that on May 29, 2018 additional information was requested for Total Hardness. The total hardness data should have included five (5) days of Total Hardness (CaCO3 or (Ca + Mg)) data for the effluent and upstream of Outfall 001. This data would have been used in a recalculation of Zinc limits for the draft permit. However, no response was received within 60 calendar days [per 15A NCAC 211.0107(b)]. Therefore, the permit renewal was drafted without the benefit of the requested Hardness data. Therefore, a default hardness of 25 mg/L was used to calculate effluent limits for Zinc as indicated above. 7. A schedule of compliance [Section A. (3.)] has been added for the Total Zinc limits in Section A. (1.). Compliance with this limit shall commence on April 1, 2023, approximately 48 months form the permit effective date. 8. Effluent and upstream quarterly monitoring for Total Hardness have been added. 9. Division personnel have reviewed and approved your permit modification request to reduce the effluent and influent monitoring frequencies for Biochemical Oxygen Demand (BOD5), Total Suspended Solids (TSS), Ammonia, and Fecal Coliform from daily to 2/week monitoring. The modification was based upon an evaluation of three years of facility effluent monitoring data. The facility's performance satisfies the criteria established in the "DWQ Guidance Regarding the Reduction of Monitoring Frequencies in NPDES Permits for Exceptionally Performing Facilities" as approved by the Director of the Division of Water Resources on October 22, 2012 and justifies reduced monitoring for these parameters. Please note that additional NPDES permit requirements will include: • Eligible facilities may be granted a reduction from existing permit monitoring frequencies to a 2/week minimum frequency for the four target parameters. Reductions will be made for both effluent and influent sampling. • Where monitoring is reduced to twice per week, it must occur on any two non- consecutive days during the calendar week (Sunday through Saturday). • Required monitoring frequency reductions establish new permit minimums for monitoring. As always, facilities may monitor more often than required in the permit. • If a reportable event, as defined by the permit [e.g., Part II (E) (6 & 9)] occurs, any facility granted reduced monitoring frequencies will be encouraged to monitor on a daily basis until the episode is resolved. 10. Total Mercury must be monitored once during the permit cycle. Mercury monitoring is included to provide a database for future mercury management and TMDL evaluation. See Special Condition A. (2.). Please note that DMRs may need to be amended based on the information below. The following was noted from review of DMR data for the period Oct2015 to Sep2018 (3 years) for this permit renewal: DocuSign Envelope ID: 713338A4-3347-4D43-AA05-88EOF55E3FOD Mr. Craft Page 3 of 4 • Monthly TN loading should be reported 12 times a year. Reporting of Monthly TN Loading for February, March and April is missing. • Data was reported as zero (0) for Ammonia, BOD, Fecal Coliform, and TSS. Reporting zero for any parameter, with few exceptions such as temperature, is inadequate reporting. The method PQL should be reported along with the data modifier "less than" (<) instead of zero. Minimum detection and reporting levels (MDLs & PQLs) are defined by the DWR Water Sciences Section as follows: Each analytical procedure has a Practical Quantitation Limit (PQL), which is defined as "the lowest concentration that can be reliably achieved within specified limits of precision and accuracy during routine laboratory operating conditions." PQLs are subjectively set at some multiple of typical Method Detection Limits (MDLs) for reagent water (generally 3 to 5 times the MDL). The PQL for a procedure may also be defined by: a reporting limit or minimum limit (ML) specified by the analytical method; sample volume and buret graduations; and/or minimum measurement values that are method - defined. The established PQL for a procedure serves as a reliable and routinely achievable reporting limit for a biological or chemical parameter (http s:Hdeg .nc.gov/about/divisions/water-resource s/water-resources-data/water-s_ciences- home-page/microbioloa�-inor anics-branch/methods-pgls-qa). In accordance with NPDES Standard Conditions Part H Section D. 4., the following is required for test procedures: To meet the intent of the monitoring required by this permit, all test procedures must produce minimum detection and reporting levels that are below the permit discharge requirements and all data generated must be reported down to the minimum detection or lower reporting level of the procedure. If no approved methods are determined capable of achieving minimum detection and reporting levels below permit discharge requirements, then the most sensitive (method with the lowest possible detection and reporting level) approved method must be used. • Units of Measure (UoM) — mg/L vs. µg/L: For Total zinc please carefully report the correct units of measurement in eDMR. When your contract lab report results in mg/L the conversion is to µg/L is to multiply by 1000. When converting from µg/L to mg/L the result is divided by 1000. Please report results for Zinc in µg/L for consistency with permits limits. • For 2016, annual TN loading (parameter code QY600) was reported in February 2016. For 2018 the yearly parameter QY600 for yearly TN was reported 6 times. This parameter QY600 should only be reported once per year in December. The parameter code QM600 should be used for monthly reporting of TN. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty (30) days after receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of North Carolina General Statutes, and you must file it with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall remain final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or any other Federal, State, or Local governmental permits that may be required. TN Load is the mass quantity of Total Nitrogen (TN) discharged in a given period of time and requires Total Monthly Flow (TMF). See Special Condition A. (4.), Calculation of TN Load. 4. The monthly average effluent BOD5 and TSS concentrations shall not exceed 15% of their respective influent value (85% removal). 5. Total Residual Chlorine (TRC) compliance is required for chlorine or chlorine derivative used for disinfection. The Division shall consider all effluent TRC values reported below 50 µg/1 to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 µg/l. 6. Instream samples shall be collected three times per week (3/week) during the months of June through September and once per week (1/week) the remainder of the year. Instream monitoring is provisionally waived based on the Town of La Grange's membership in the Lower Neuse River Basin Association (LNBA). If at any time during the term of this permit, membership in the LNBA is terminated, the Permittee shall notify the Division immediately, and immediately begin conducting instream monitoring as stipulated in this permit. 7. For a given wastewater sample, TN = TKN + (NO3-N + NO2-N), where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and (NO3-N + NO2-N) are nitrate and nitrite nitrogen, respectively. 8. Compliance with this limit shall be determined in accordance with Special Condition A. (5.) of this permit, Annual Limits for Total Nitrogen. 9. Compliance with this limit shall commence on Aril 1, 2023, approximately 48 months form the permit effective date. See Compliance Schedule Condition A. (3.). 10. Effluent hardness sampling should be performed in conjunction with testing for hardness dependent metals (Zinc). 11. The Permittee shall sample instream hardness, upstream of the facility's discharge. The sample shall be representative of the hardness in the receiving stream. If the Permittee is a member of the Monitoring Coalition Program, sampling for instream hardness may be waived as long as the Monitoring Coalition agrees to sample hardness at the nearest upstream location, at a minimum frequency of quarterly, and the Permittee has obtained approval from DWR Water Quality Permitting Section that the upstream station being monitored by the Coalition is representative of the receiving stream for this discharge. The Permittee is responsible for submitting instream hardness test results with its permit renewal application package. If Coalition membership is cancelled or the Coalition terminates instream hardness sampling at the approved station, the Permittee will immediately notify the Division and resume sampling for instream hardness, upstream of its discharge. 12. Mercury must be monitored once during the permit cycle. See Special Condition A. (2). (b.) There shall be no discharge of floating solids or visible foam in other than trace amounts. A. (2.) EFFLUENT MERCURY ANALYSIS [G. S. 143-215.1(b)] The permittee shall provide in the next permit renewal application, at least one effluent mercury analysis using EPA Method 1631E. This mercury sample must be taken within 12 months prior to the application date. Any additional effluent mercury samples taken from the effective date of the permit until the application date shall also be submitted with the renewal application. The mercury analysis must be provided with the application, or the application may be returned as incomplete and the permittee considered non -compliant. Part I, Page 2 of 7 DocuSign Envelope ID: 713338A4-3347-4D43-AA05-88EOF55E3FOD NPDES Permit NCO021644 A. (3.) SCHEDULE OF COMPLIANCE (OUTFALL 001) [G. S. 143-215.1(b)] 1. Within one year from the effective day of the permit the Permittee shall submit to the Division of Water Resources a Corrective Action Plan summarizing the actions to be taken to achieve compliance with the Total Zinc limits at Outfall 001 and a schedule of activities to implement the Plan. 2. Within two years from the effective date of the permit submit a report to the Division summarizing actions taken in accordance with the Corrective Action Plan. 3. Within three years from the effective date of the permit submit a report to the Division summarizing actions taken in accordance with the Corrective Action Plan. 4. Within four years from the effective date of the permit submit a report to the Division summarizing actions taken in accordance with the Corrective Action Plan. 5. Achieve compliance with Total Zinc limits specified in Section A. (2.) by April 1. 2023. Upon approval of the Corrective Action Plan by the Division, the report and actions become an enforceable part of this permit. Any modifications to the schedule shall be requested to the Division at least ninety (90) days before the deadline. Modifications to the schedule in excess of four months will be subject to public notice. A. (4.) CALCULATION OF TOTAL NITROGEN LOADS [G. S. 143-215.1(b)] (a.) The Permittee shall calculate monthly and annual TN Loads as follows: (i.) Monthly TN Load (pounds/month) = TN x TMF x 8.34 where: TN = the average Total Nitrogen concentration (mg/L) of the composite samples collected during the month TMF = the Total Monthly Flow of wastewater discharged during the month (MG/month) 8.34 = conversion factor, from (mg/L x MG) to pounds (ii.) Annual TN Load (pounds/year) = Sum of the 12 Monthly TN Loads for the calendar year (b.) The Permittee shall report monthly Total Nitrogen results (mg/L and pounds/month) in the appropriate discharge monitoring report for each month and shall report each year's results (pounds/year) with the December report for that year. A. (5.) ANNUAL LIMITS FOR TOTAL NITROGEN [G.S. 143-215.1(b)] (a.) Total Nitrogen (TN) allocations and TN Load limits for NPDES dischargers in the Neuse River basin apply on a calendar year basis. (b.) For any given calendar year, the Permittee shall be in compliance with the annual TN Load limit in this Permit if- (i.) the Permittee's annual TN discharge is less than or equal to its TN Load limit, or (ii.) the Permittee is a co-permittee member of a compliance association. (c.) If the Permittee is not a co-permittee member of a compliance association and the Permittee's cumulative annual TN discharge exceeds the effective TN Load limit in this permit at any point during the calendar year, the Permittee is in violation of its TN Load limit, and each day of a continuing violation shall constitute a separate violation. (d.) The TN Load limit in this Permit (if any) may be modified as the result of allowable changes in the Permittee's TN allocation. (i.) Allowable changes include those resulting from purchase of TN allocation from the Wetlands Restoration Fund; purchase, sale, trade, or lease of allocation between the Permittee and other dischargers; regionalization; and other transactions approved by the Division. The Permittee may request a modification of the TN Load limit in this Permit to reflect allowable changes in its TN allocation. Upon receipt of timely and proper application, the Division will modify the permit as appropriate and in accordance with state and federal program requirements. (iii.) Association roster(s) and members' TN allocations will be updated annually and in accordance with state and federal program requirements. (iii.) If the Permittee intends to join or leave a compliance association, the Division must be notified of the proposed action in accordance with the procedures defined in the association's NPDES permit. (A) Upon receipt of timely and proper notification, the Division will modify the permit as appropriate and in accordance with state and federal program requirements. (B) Membership changes in a compliance association become effective on January 1 of the year following modification of the association's permit. (f.) ELECTRONIC REPORTING OF MONITORING REPORTS [NCGS 143-215.1 (b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. (a)1 The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DEQ / Division of Water Resources / Water Quality Permitting Section ATTENTION: Central Files 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. Electronic Submissions In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of each electronic submission. The permittee should use the EPA's website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective.
