Overview
On August 1, 2014, the Fortress Wood Products facility conducted qualitative and
quantitative storm water sampling and analysis. Upon receipt of the lab analysis
by the facility, it was discovered that the Outfall had exceeded the benchmark
parameter for Total Recoverable Copper during the semi-annual inspections for
the fourth time placing the facility in Tier Three. This letter and explanation's
purpose is to notify NCDENR of the facility being placed into Tier Three.

Stormwater Management Facility Inspection
On September 12, 2014 Scott Fulcher conducted a "Storm Water Management
Inspection" of the facility, with hopes of finding issues pertaining to benchmark
exceedences of Total Recoverable Copper.
The "Stormwater Management Inspection" of the facility included;
• An extensive and detailed look at the topography of the facility and
the areas of the facility draining to the outfall.

• An extensive and detailed look at operations and best management
practices at the facility to determine whether or not particular
operations or changes in best management practices could have
caused or aggravated benchmark exceedences.
• An extensive and detailed examination of the outfall to determine
potential causes and remedies for benchmark exceedences.
Benchmark Exceedence Possible Cause(s)
Total Recoverable Copper — Above results indicate a pattern of exceeding
the copper benchmark at the outfall. Nothing unusual was observed during
the inspection. All BMP's in place are being practiced. One possibility for
the pattern of exceeding the benchmark is naturally occurring copper or
copper running onto Fortress Wood Products property and then exiting
through our outfall. The western boundary by the railroad track is the only
area that stormwater can run onto the property and contribute to the
facility exceeding the benchmark as there is a ditch diverting storm water
on the southern and eastern boundaries and all water flows in a
north/northeast direction off of the property due to topography. The
water from the railroad track on the western boundary sheets onto the
property making getting a stormwater sample difficult.
Identification of Potential Exceedence Solutions
Total Recoverable Copper - Fortress Wood Products will sample
stormwater in the ditch that flows from the southern to the eastern
boundaries that diverts water around the property to see if there may be
high amounts of naturally occurring copper. There is also a detention pond
on Fortress Wood Products' property that Outfall #1 empties into. In the
event the detention pond fills enough to discharge, we will sample the
stormwater leaving the detention pond to check the copper levels of water
that is being discharged from the pond. These samples will be taken in
addition to their normal outfall samplings at the next qualifying stormwater
event.

Description of Onsite Activities:
• Fortress will impregnate lumber with ACQ in pressure vessels. Treated lumber will be dried under
roof, but excess stock storage could be exposed. ACQ contains copper oxide and a quaternary
ammonium compound.
Documents Reviewed:
• NPDES stormwater permit application materials, received in final form December 12, 2012.
• EPA Sector -Specific Permit, 2008, SIC 2491 covered with benchmarks for Cu and As. Note, no
arsenic usage proposed at this new site.
• Past monitoring (2000--2004) data from sister facility showing benchmark exceedances for BOD,
COD, TSS, As, Cr, and Cu. Note that the new facility will only use ACQ, not the other metals.
• Integrated Report 303(d) List, 2012 Draft: Moving downstream, Hunts Fork, Rich Fork, Abbotts
Creek are all impaired for biological integrity.
• Yadkin River Basinwide Plan, 2008: no comment on this site (didn't exist in the proposed usage); No
comment on the UT; Hunt's Fork impaired benthos; Rich Fork has a TMDL for fecal coliform,
Abbott's Creek impaired for various parameters; High Rock Lake impaired for various parameters.

Central Office Review Summary:
1. Owner's Other Permits: NCS000280 issued to sister facility in Greensboro.
2. General Observations:
o Site history: Site was previously a building supply store. Limited stormwater risks from previous usage.
a Haz waste: Site will be a conditionally exempt small quantity generator. Limited stormwater risk.
o Copper and ammonium solutions in the process may present the more significant risks to stormwater.
o TSS: Existing detention basin and sediment pond should moderate TSS risks with little extra care.
3. Impairment: Receiving water listed as impaired for biological integrity on 303(d) IR.

5. Location: Very northwest corner of Randolph County. Adjacent to and north of 1-85; adjacent to and east of N-S
Railroad.

7. Analytical Monitoring Notes: Semi-annual for TSS, COD, Cu, Cl-,NO3-NO2 nitrogen, N144 nitrogen, and pH.
8. Qualitative Monitoring Notes: Semi-annual visual monitoring.
Permit Recommendations:
1. Analytical monitoring has been set to semi-annual during a measurable storm event as defined in Part II Section
B. The recommended monitoring is similar to most other industrial stormwater permits.
2. The permittee must document the total precipitation for each sampled event. If no discharge occurs during the
sampling period, the permittee must submit a monitoring report indicating "No Flow" within 30 days of the end
of the six-month sampling period.
3. Analytical monitoring parameters:
a. Metals: Copper, Based on Cu reported in the application materials and on the sister site benchmark
exceedances. Unlike some of the previous manufacturing operations at the sister facility, arsenic and
chromium are not included as part of this manufacturing process.
b. Others: Chlorides based on reported presence in the permit application, and at the sister facility.
Nitrate -nitrite nitrogen and ammonia nitrogen based on the permit application report that nitrogen
compounds will be present in the manufacturing process.
c. Conventional pollutants: TSS, pH, COD. TSS and COD based on sister facility exceedances.
Conclude that requiring both COD and BOD is needlessly redundant. pH monitoring is consistent with
most other industrial stormwater permits.
4. Benchmarks are referenced in the text for all analytical parameters.
5. Qualitative monitoring must be accomplished during a measureable storm event.
6. Standard vehicle maintenance area monitoring is included when triggered by motor oil and hydraulic oil usage.
7. The permittee is required to continue monitoring until the permit is renewed. See Footnote 1 of Table 2.
8. SPPP required; standard elements required for the content of the SPPP.

Central Office Review Summary:
1. Owner's Other Permits: NCS000280 issued to sister facility in Greensboro.
2. General Observations:
o Site history: Site was previously a building supply store. Limited stormwater risks from previous usage.
o Haz waste: Site will be a conditionally exempt small quantity generator. Limited stormwater risk.
o Copper and ammonium solutions in the process may present the more significant risks to stormwater.
o TSS: Existing detention basin and sediment pond should moderate TSS risks with little extra care.

Permit Recommendations:
1. Analytical monitoring has been set to semi-annual during a measurable storm event as defined in Part 11 Section
B. The recommended monitoring is similar to most other industrial stormwater permits.
2. The permittee must document the total precipitation for each sampled event. If no discharge occurs during the
sampling period, the permittee must submit a monitoring report indicating "No Flow" within 30 days of the end
of the six-month sampling period.
3. Analytical monitoring parameters:
a. Metals: Copper. Based on Cu reported in the application materials and on the sister site benchmark
exceedances. Unlike some of the previous manufacturing operations at the sister facility, arsenic and
chromium are not included as part of this manufacturing process.
b. Others: Chlorides based on reported presence in the permit application, and at the sister facility.
Nitrate -nitrite nitrogen and ammonia nitrogen based on the permit application report that nitrogen
compounds will be present in the manufacturing process.
c. Conventional pollutants: TSS, pH, COD, TSS and COD based on sister facility exceedances.
Conclude that requiring both COD and BOD is needlessly redundant. pH monitoring is consistent with
most other industrial stormwater permits.
4. Benchmarks are referenced in the text for all analytical parameters.
5. Qualitative monitoring must be accomplished during a measureable storm event.
6. Standard vehicle maintenance area monitoring is included when triggered by motor oil and hydraulic oil usage.
7. The permittee is required to continue monitoring until the permit is renewed. See Footnote I of Table 2.
8. SPPP required; standard elements required for the content of the SPPP. ,

In response to your application for coverage under the NPDES stormwater discharge permitting program, the
Division of Water Quality (Division) is forwarding herewith the subject state - NPDES permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This final permit includes no major changes from the draft permit published on the Stormwater Permitting
Unit website on February 22, 2013.
This permit contains analytical monitoring requirements on a semi-annual basis. Please note that failure to
complete the monitoring as required is a violation of the permit and any permit noncompliance constitutes a
violation of the Clean Water Act. Reference Part III, Section A, Item 2 "Duty to Comply", Item 9 "Penalties for
Tampering" and Item 10 "Penalties for Falsification of Reports" of your permit for further information.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447,
Raleigh, North Carolina 27611 -7447. Unless such demand is made, this permitting decision shall be final and
binding.
Please take notice this permit is not transferable. Part III, B.2. addresses the requirements to be followed in case
of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of
Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be
required.

Hi Dave,
The package for Fortress was date stamped into DWQ on Friday, Dec. 7, and I pulled it out of my inner -office mail box
this morning, Monday, Dec. 10.
note that the permit fee is not included in the package i received. According to North Carolina rule at 15A NCAC 2h
.0105(b), we must consider the application incomplete until the fee is received. We can't log in our receipt of the
application, and so we cannot begin processing the package, until the fee is received.
The fee for an individual NPDES stormwater permit is $860.
Our administrative procedures allow me to hold the incoming application for a few days, but I will return it as
incomplete if we don't receive the fee within approximately a week.
