The site is current vacant, forested land. Rural residential properties exist immediately south of the site. Hunters Crossing subdivision exists to the south just beyond these larger rural
residential properties. Young Forest subdivision exists to the north. North White Street, railroad tracks and commercial/industrial businesses exist to the West. Del Webb at Traditions
subdivision exists to the east. This subdivision Will be consistent with these surrounding subdivisions.

Permanent & Temporary buffer impacts at the road crossings were combined in the impact areas provided above as simply "permanent' under the
"road crossing" use.
(EN1.07) Are buffer impacts associated with a "T' turnaround area that would result in road impacts to the buffer other than crossings of surface
waters and as such are considered "Allowable Ad Mitigation". Payment into a private buffer mitigation bank is proposed. The impacts could not be
avoided due to safety vehicle turn around requirements. It should be noted however that the permanent impacts have been limited to Zone 2 with only
some temporary construction impacts to Zone 1. Mitigation however is proposed for both zones.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The developer hired S&EC to delineate all wetlands, streams and Neuse Buffers on the property. This designer then used this information to try to
avoid impacts to the greatest extent possible. Those impacts that could not be avoided were minimized. Minimization efforts included the use of
headwalls at the stream crossings and retaining walls elsewhere.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
An erosion and sediment control permit and construction stormwater permit will be obtained prior to land clearing in an effort to protect downstream
waters during construction. A post -construction stormwater management plan will be approved by the Town to treat runoff from impervious surface
and protect downstream voters post -construction.

Comments:
A stormwater managment plan will be approved by the Town of Wake Forest for this project. The plan proposes the use of two wet detention ponds discharging through the buffer to the
streams. The plan also proposes a sand filter (near the "T" road turnaround area) that will discharge to a low flat area outside of the buffer and wetlands at non-erosive velocities.

404/401, Neuse Buffers, stormwater management, etc.).

Re Project: Goldston -North White Street Subdivision
This document confirms that DS Traditions Sub LLC (Applicant) for the Goldston -North White Street
Subdivision (Project) has expressed an interest to utilize 4,191 Sguare Feet of Riparian Buffer
Mitigation Credits from one of the following banks, EBX-Neuse I, LLC Neuse Riparian Buffer
Umbrella Mitigation Bank, RES Neuse Buffer and Nutrient Offset Umbrella Mitigation Bank, or EBX
Upper Neuse Riparian Buffer Umbrella Mitigation Bank. Specific bank sites that may be debited are
Arrington Bridge I, Buffalo Branch, Selma Mill, Cedar Grove, Hatley, Ezell, Polecat, Hannah Bridge,
Meadow Spring, and Stone Creek, all located in HUC 03020201. As the official Bank Sponsor, EBX-
Neuse 1, LLC and EBX, attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following
information:
