I appreciated your assistance; as well as the assistance of Mr. Bill Lewis, Environmental and Safety Specialist, and Mr. Henry Boswell, Corporate Regulatory Manager. Please review the attached Basinwide Information Management System (BIMS) inspection checklists summarizing the inspections. Below is a list of findings developed from the inspections: I. NPDES Permit NCG500289 Inspection: 1. The current permit was reissued August 1, 2007 and expires September 30, 2012. Resinall Corp. produces synthetic resins for graphic arts and the adhesive industry. 2. This facility is permitted to discharge non -contact cooling water, cooling tower and boiler blowdown, condensate and similar wastewaters, to an unnamed tributary to Kirby's Creek, in subbasin 30102 of the Chowan River Basin. Cooling water is being recycled. A list of significant spills occurring in the last three years is included as a part of the Stormwater Pollution Prevention Plan. Documentation for specific years would be a more efficient way of recording future significant spills. 2. Secondary containment is required and used extensively at this facility. Secondary containment was inspected during the tour of the facility and was found to be compliant. 3. Analytical and qualitative monitoring results were reviewed and found to be compliant with the permit. 4. Both outfalls were inspected and were in compliance with the, permit. The treatment system is considered to be in compliance with the NPDES permit, and the facility is also in compliance with the general stormwater permit, at the time of these inspections. It was a pleasure meeting all of you, and thanks for the help that was given. The permit expired March 31, 2005, and an application for renewal was submitted to DWQ September 2004. The plant was in compliance with the permit, and had anchored the program around a well -written and updated Stormwater Pollution Prevention Plan. Please see the attached checklist noting the topics that were covered during the inspection. Annual analytical data gathered during the past permit cycle, submitted with the permit renewal, was sparse. Two reasons were given: 1) 2004 was a dry year in which no flow could be sampled, and 2) Resinall stopped sampling when the permit expired. If no flow occurs in the future, please submit a report form marked "No Flow to Sample" so DWQ will know the sampling was not being ignored. The old permit did not explicitly address what to do after the permit expired, but it is expected that a facility will. continue to operate under the conditions and responsibilities of the old permit until a new one is issued. These instructions will be more clearly worded in future permits. See CFR40,§ 122.6 Continuation of expiring permits. (a) EPA permits. When EPA is the permit -issuing authority, the conditions of an expired permit continue in force under 5 U.S.C. 558(c) until the effective date of a new permit.
