Dear Mr. Andrews:
On October 4, 2007, I, Trent Allen from the Fayetteville Regional Office of the Division of
Water Quality, conducted a site inspection at the Industrial and Agricultural Chemicals, Inc, facility
located at 2042 Buie -Phil Road, Robeson County, North Carolina. Mr. Andrews was also present during
the inspection and his time and assistance is greatly appreciated. Stormwater from this facility drains to
Burnt Swamp, a Class C-SW waters located in the Lumber River Basin. The site visit and file review
revealed that the subject project is covered by NPDES Stormwater General Perm] t-NCS000236.
Accordingly, the following observations were noted during the Division of Water Quality
inspection (please see the attached addendum f6r information about your permit):

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act and then delegated to the Division of Water Quality for implementation in
North Carolina. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or'an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There are
currently 19 active general stormwater permits in North Carolina. One condition that is applicable to
both the general permits and individual stormwater permits is the requirement to develop and implement
site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to
include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent
pollutant discharge.

monitoring forms, and a Notice of Intent [which is the application of for coverage under a NPDES
General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said;
please see the above -mentioned web site in order to obtain a copy of the permit such that you may fully
comply with all the conditions therein. Failure to properly comply with conditions of the permit, like
those bulleted below, constitutes violations and is subject civil penalty assessment of up to
$25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit
coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered
by the General Permit. That is, the permittee is authorized to discharge stormwater, process
wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit
expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most
of the permits have following condition requirements (you must read your entire permit to ensure
full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan

b Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility
along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring
results shall also be maintained on -site. The Permittee shall retain records of all
monitoring information, including all calibration and maintenance records and all original
strip chart recordings for continuous monitoring instrumentation, and copies of all reports
required by this general permit for a period of least 5 years for the date of the sample
measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the
general permit. In order to receive automatic authorization to discharge beyond the
expiration date, the permittee shall submit fomis and fees as are required by the agency
authorized to issue permits no later than 180-days prior to expiration date. Any permittee
that has not requested renewal at least 180 days prior to expiration, or any permittee that
does not have a permit after the expiration and has not requested renewal at least 180
days prior to expiration, will be subject to enforcement. Failure to -renew your permit is
a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is
not transferable to any person expect after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the Certificate of
Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of
Water Quality views changes of name or ownership as a modification that requires the
Director's approval and reissuance of the permit. Name and ownership changes required
you to complete a Narnelownership Change Form from the Division and mail it back to
the Division of Water Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Our office has received your letter dated 3/12/2001. Your letter was in response to a Notice of Violation our
office issued IAC on February 28, 2001. We have reviewed the permit, your letter, and the circumstances surrounding
the facility not collecting a second sample for the calendar year 2000. Our office is aware of the type discharge at IAC.
We do realize that the discharge is in response to storm events. However, your NPDES permit contains a clause on the
limits page which states, "should a representative storm event not occur at this facility during a quarter, the permittee
sliall provide a record of storm events for the quarter demonstrating that a representative storm event had not occurred
and sampling could not be conducted." To avoid future enforcement from our office, we recommend that you inform
the Environmental Sciences Branch by letter should circumstances beyond the facility's control prevent collection and
analysis of toxicity samples. Our office would also strongly encourage you to establish contacts with multiple labs in
the event that your primary lab is unable to conduct toxicity testing for you. To assist you in this effort, I am enclosing
a copy of a list of laboratories currently certified by us to conduct toxicity testing.
Based on all the information presented to us, our office believes there was ample opportunity to collect two
samples for the catendar year 2000; therefore, we have decided not to rescind the Notice of Violation which issued
February 28, 2001. If you have any questions concerning this letter or your toxicity test requirement please contact Ms,
Kristie Robeson with the Aquatic Toxicology Unit at (919) 733-2136.

Dear Mr. Andrews:
on December 30, 1996, staff of the Fayetteville Regional Office conducted
an inspection of the Industrial and Agricultural Chemicals site in order to
evaluate compliance with the subject permit. The following items were noted:
1. Considerable progress has been made in regards to secondary
containment around all liquid chemical bulk storage tanks. In addition to
secondary containment, most of these areas are now sheltered.
2. Development of wetland vegetation has been hampered by continuing
construction and ditching in the upper reaches of the drainage ditches.
Sloping of ditch banks is recommended in order to provide greater
opportunity for successful plant growth.
3. Additional dry storage areas have been constructed, leaving virtually
none of your products or raw materials exposed to the elements.
4. No evidence of any type of spill or excessive dust emission was noted.

As discussed during the meeting, the "new" ditch on the northern end of

is opened and allowed to discharge. It is possible that an additional
discharge point could include separate monitoring requirements. This would be
determined after a more detailed review of the potential contaminant sources

I have received a letter from Mr. Ken Eagleson. I have enclosed
a copy of the letter. Our company is supposed to perform rvo
Aquatic Toxicity tests. We were unable to obtain a representative
stormwater sample until April of 1995. We did the toxicit.- testing
at that time. We did not have another stormwater event un_'_1 October
of 1995. We sent these samples to Oxford Labs who cannot d_ aquatic
testing. We had planned to get another sample after this eemp-le
but did not have an -other stormwater event.
I want to clarify that we might have had another stormwater event
during these times but, they might have been at night or ow a week-
end when no one was here. Also, since we have to ship the ;ample
for aquatic testing to Burlington the rainwater event has :-• be
Monday through Thursday or it will exceed the thirty six hc-_r time
period for aquatic testing.
In April I returner to our facility at night to obtain the _squired
samples. I would be happy to make every human effort to o'-lain
three samples this year to make up for the missed samples. 1 have the
required sample bottles and the carrier from Burlington Re_earch and
have been waiting for some time to get samples this spring for our
first quarter sampling but have not been able to because t_re has not
been a representati-,e storm water event so far in January t= February
at a time that I could obtain them. Please let me know if -:ou have any
questions.

This is to inform you that the Environmental Sciences Branch of the Division of Environmental Manageme`.t has not
received your remaining semi-annual toxicity self-monioring test result for calendar year 1995 as required by yo_ permit.
As you know, Permit NCS000236 became effective Feeruary 1, 1994, and contains a semi-annual toxicity self -monitoring
requirement. Failure to monitor according -to the retirements of the permit represents a violation of the m�nitoring
requirements contained in NCS000236 and of Title 15 of the North Carolina Administrative Code, Chapter 2, S_bchapter
2B, Section .0506 (a)(1)(A) which states, "monthly moaitoring reports shall be filed no later than 30 days after we end of
the reporting period for which the report is made."
Dual reporting requirements exist for facilities which are required to conduct toxicity monitoring spr..ified by
individual NPDES Permits. Facilities are required by tlx NPDES Permit to complete and submit an Aquatic Toxicity (AT)
Test Form to the Environmental Sciences Branch as well as report the results of all effluent test characteristics (hcluding
toxicity) on a Discharge Monitoring Report Form (DMR) to the Division's Central Files.
To prevent fia-Lher action, please submit this reFort by March 14, 1996, or notify this office of any problem which
may have prevented the report from being received o:- time. You will be considered noncompliant with the zporting
requirements contained in your NPDES Permit unfit }r.Iu make acceptable demonstration to the Environmental Sciences
Branch that the second of two required toxicity self -monitoring report forms for calendar year 1995 was submin-d to this
office within the 30 day reporting period. In addition, if within the next twelve (12) months, future reports are no: received
within the required time frame, you may be assessed a cMl penalty.
You may wish to consider submitting future toxicty test results via certified mail to the address located at `I.: bottom
of this page to assist you in determining whether your toxicity test results were received on time by the Environmental
