CENTRAL FILES DWR SECTION Rescission of NPDES Stormwater Permit Permit Number: NCS000100 Chatham County Dear Mr. Kubel: On January 11, 2017, the Division of Energy, Mineral and Land Resources received your request to rescind your NPDES Stormwater Permit Number NCS000100. In accordance with your request, Stormwater Permit Number NCS000100 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. If something changes and your facility would again require stormwater or wastewater discharge permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the proper permit coverage. If the facility is in the process of being sold, your will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. General Observations: The plant operations most likely to cause stormwater pollution are material storage, drainage processes, loading and unloading, and V= 4,ste disposal practices. Impairment: Neither, the Haw River not Shaddox Creek is listed on the 303d list of impaired waters; however, they both are Water Supply Waters. The 2005 Basinwide Plan states the Haw River is Supporting aquatic life but Moncure Plywood (NC0023442) had silpi ficant violations of dissolved oxygen permit limits. Shaddox Creek is Not Rated for aquatic life on an evaluated basis because Sierrapine Limited (NC0040701) had significant violations with TSS permit lii,iits. The facility has installed screens to solve the TSS violations. However, both of these issues could have adversely impacted aquatic life. 4. Threatened and Endangered: Based on the Natural Heritage Virtual Workroom there is one federal endangered plant species within two mile of the facility is the Ptilimnium nodosum (Harperella). One state threatened species Moxostoma sp. 3 (Carolina Redhorse). 5. Location: Facility discharges stormwater to two waterbodies: an unnamed tributary to Haw River and Shaddox Creek. 6. Industrial Changes Since Previous Permit: The only change since the last renewal application was the shutdown and decommissioning of a beaming operation in 2007. Anal3qical Monitoring Notes: See Table 1. There was no data collected in the fall of 2007, 2008 and 2009 because rainfall events that occurred during those time periods (September — November) were not representative storm events. The last reviewer noted the facility stores several chemicals outside that may be pollutants of concern. TPA, glycol, fuel and diesel oil tanks, gasoline tanks, caustic, and finish oil tanks are not stored under roof, according to the site map. Many of these tanks have secondary containment with diked -area inspections required before release. The majority of these areas drain to the NPDES wastewater outfall and fall under another permit (NC0001899), which also includes acute toxicity monitoring. (Information for previous staff report by Bethany Georgoulias) The facility uses antimony as a catalyst, and drift from two process water cooling towers is the likely source of the metal in stormwater runoff. Antimony (Sb) was kept in the previous permit even though the reported values were below the benchmarks because process water cooling tower drift still has potential to contaminate stormwater. The old benchmark in the permit was 4.5 mg/l but it is now 0.09 mg/l which is %2 FAV. The EPA's human health and organism consumption criteria is 0.006 mg/l. This value reflects the drinking water standard (not a stream standard for water supply waters in North Carolina). This value is important to note because there are values at outfall 3 and 4 that are above this value. The reviewer recommends retaining Antimony in order to continue monitor this parameter. This industry is covered in the EPA Multi -Sector permit under Sector C: Chemicals and Allied Products. The permit includes zinc monitoring; however, this site is not a likely source. Based on the pervious staff report, years ago, the site used a zinc coating and a zinc -containing anti -corrosive material (Zinc is monitored at the NPDES wastewater outfall 002, where some stormwater drained); however the site no longer uses any zinc or chromates.
